Docx and doc file can doesn't have a file lock

If I open a docx file from a office 2007 with usera and userb opens the same
file with office 2003 (compatible pack installed).
The user B does not get the "Read only" message, so the file locking
function is not working. So the data on the documents is differents.

Is there a solution for that.

Is there a KB from microsoft exposing the problem that I can read.
