番茄花园涉嫌侵权微软版权，奥运期间，8月15日，其网站主人洪磊被拘捕，儿子身陷牢狱，洪父卧病不起。美国自称知识产权保护是很完善的，因此美国法

番茄花园案有指导性意义。洪磊可能想不到，最终帮他的可能是一个美国法官。在两个非常类似的美国联邦法院案例中，一个中国人起诉SUN 公司
（SUN MICROSYSTEMS）（购买8个许可，却无限制使用）和SYMANTEC（赛门铁克）（购买一个许可，大肆拷贝）盗版，美国加州法官
MARTINJ. JENKINS却两次判中国人告负，并命令中国人支付盗版公司巨额律师费。
番茄花园的案情与SYMANTEC（赛门铁克）的案情相似。但番茄花园不存在欺骗行为，番茄花园虽然也改动了视窗软件，但从没有隐瞒其修改事实，是得

微软是美国公司，其软件的开发是在美国，它的知识产权注册在美国，保护当然根据美国法律。美国号称是知识产权保护完善的国家，其判例精神具有很强的参

价值。如果美国公司MICROSOFT的知识产权按美国法律都不受保护，却要寻求中国法保护，那是很荒唐、很可笑的。

This is very clever. Sun's grand plot to finish off its old
enemy Microsoft. It intentionally stole software from some Chinese,
then bot cheap judges to rule in its favour, knowing the judges are
not willing to let Chinese win a lawsuit. The judges bot by Sun make
the new law and the new law must be followed by other judges under
stare decisis. Now, Microsoft lost protection of its software, and
will die soon.

SUN盗版案是签了文件的, "one user can only use the software on one
computer for one license". 但法官说违背"一个人只准在一台机器上使用软件"的条款不是侵权。
