Patents expire 20 years from the date the patent was issued.

Sorry Kent, that's not quite correct. For patent applications filed on or before June 8, 1995, the expiration date of patents 17 years from the date of patent issue, or 20 years from the date of filing...whichever is longer. For applications filed after June 8, 1995 the expiration date is 20 years from the date of filing for plant or utility applications.

The patent application for Goldrush was filed on June 2, 1993 and the patent issued on December 5, 1995. The 20 years from filing is after the 17 years from issue date, so that patent expired on June 2, 2013.

The patent application for Pristine was filed on December 22, 1995 and , so that patent expires December 22, 2015.

There are also terminal disclaimers and term extensions for patent office delays to make things even more complicated, but luckily those are rare for plant patents.

Brian,

Not to mention the Trademarks on names which may never expire!

Thanks for the clarification.

Well, we can always claim ignorance with these "confusing" rules.
