Cannot sell or rent the Mhada flat

If you have read the terms & conditions in the booklet, then you should know that this Mhada flat cannot be sold or given on rent for the next three years.

For this purpose, Mhada collected a duly signed paper stating that we agree to all the conditions, when we did the paperwork. This has given Mhada the authority to cancell the allotted flats if we do not follow their rules. For the same purpose, they collected the family photo also.

I feel the Mhada people will do one routine enquire (or may not do as well), after everyone gets settled down in the new flats, for confirmation of the details given to them.

I have heard that the brokers have already collected a big sum of money for these cancelled flats and for the mhada officials, so that they can secure these cancelled flats. So, we have to watch out as they will find every reason to cancell the flats.

So Mr. Predeep Nehe, If possible, ask any one of your family members to stay there rather thinking of giving for rent.

I am re-stating the terms and conditions which I thought can be hinderance for selling / renting out as per my findings.

1.Information Broucher's ( Mahiti Pustika ) Page no 8 : 5th Paraghraph :

Maharashtra Gruhanirman va Khetravikas Milkat Vyavasthapan vinium 1981 madhil tardudinusar mandalachya sadanikeche 5 varshyachya kalavadhiparyant vikri karata yenar nahi.Sadanikechi anadhikrut vikri , hastantaran jhalyache aadhalun aalyas sambandhit sadanika dharakavirduha kaydeshir karvai keli jayeel.

( Meaning : As per MHADB GR 1981 Mhada alloted flat can not be sold till 5 years.
Legal action will be taken against respective owner in case In case of Illegal sell of the allotment,transfer found to be done.

2.Namuna "AP " : APPENDIX ( This is one which we have sighed and submitted seperately at HDFC bank after successful winning the draw )
Page no 22 . Point no 3 : The allotee shall use and occupy for the purpose of residence only.

But these two conditions never speaks about prohibition from giving the our flat on rent after posession.
Can anyone please bring any points ahead in case I have missed.

Dear All,
 
I have just one small query:
 
I have paid my inititial 25 per cent: I will be collecting the NOC for the Home loan purpose tomorrow.
 
I now have to get the rest of the amount  disbursed from the bank.
 
Can some one advise me on the next steps:
 
Will the bank disburse the rest of the amount based in POL and the NOC ? 
 
Do i have to finish the stam duty & registarton first and only then Bank will provide me with the rest of the amount after i handover the orginal agreement?

Plss help
