Jury awards almost $250,000 to man assaulted by officer

UPPER MARLBORO -- A Forestville man struck in the head with a metal
baton by a
Prince George's County police officer has been awarded $249,565 by a
jury in
Prince George's County Circuit Court.

Leslie W. Moore, 26, was awarded $225,000 for pain and suffering and
about
$24,000 for plastic surgery to repair the scar that resulted from
being hit
Sept. 9, 1999, by Officer Jesse Spence outside a District Heights KFC
restaurant.

The jury returned its decision Wednesday after a two-day trial and six
hours of
deliberation. Jurors determined Spence acted with malice, used
excessive force
and falsely arrested Moore, who spent two days in jail on charges of
assault and resisting arrest.

According to Moore's testimony and lawsuit, Moore was smoking with a
friend
outside the restaurant. A police officer drove up and questioned the
pair about
what they were doing and Moore said he worked at the restaurant.

Two more officers arrived and Moore's friend, Shawn Foster, exchanged
words and
began to struggle with the officers. Spence then hit Moore on the head
with the
baton and kicked him in the ribs, Moore testified.

Spence testified Moore was trying to interfere with the arrest of
Foster and
that Moore pushed him.

Charges against Moore were eventually dropped.

A veteran Baltimore police officer was placed on administrative duties
yesterday after a brief internal hearing into allegations that she
falsely arrested an 18-year-old man on drug charges last week, police
officials said.

Jacqueline Folio, 41, who joined the department in 1989, will be
transferred from the Southeastern District to juvenile detention
duties pending the outcome of the agency's internal disciplinary
process, police officials said.

Folio, who also lost her police powers, could not be reached for
comment.

Yesterday's hearing stemmed from Folio's actions during an integrity
sting Thursday night, police officials said.

Folio was on patrol near the 3000 block of E. Pratt St. when she
received a call to investigate drug activity, according to police
officials.

She found a bag containing suspected drugs and cash, which had been
planted earlier by internal affairs detectives during a random
integrity check. She put the bag in her pocket, police officials said.

Within minutes, Folio had arrested an 18-year-old man for possessing
the drugs and cash.

Folio wrote in court documents that she saw the teen-ager place the
drugs behind a bush. But sources familiar with the investigation say
the 18-year-old never touched the bag and the area was being watched
by internal affairs detectives.

Police internal affairs officials interviewed the 18-year-old, Leon
Burgess, at the city jail and tape-recorded his statements. Burgess
was not charged with any crimes and said last week that he felt his
rights had been violated.

A Baltimore police officer was arrested on federal drug charges
yesterday morning, becoming the second city officer arrested in the
past 10 days, federal and city officials said.

Eduardo Munoz Jr., 32, who works in the department's criminal
intelligence unit and joined the force in 2000, was arrested with an
alleged co-conspirator about 6 a.m. yesterday, federal officials said.

Federal authorities declined to release further details about the case
or detail the drug charges lodged against Munoz. The officer is being
held in federal custody pending a detention hearing scheduled
tomorrow, federal officials said.

Ragina C. Averella, the city department's chief spokeswoman, declined
to comment on specifics in the case because the agency's "internal
affairs division [and] ... federal authorities are conducting an
ongoing investigation."

Munoz is the second city police officer to be arrested since March 21,
when Aleacia Hill, 25, was arrested on drug charges in Baltimore
County.

Hill, who was suspended without pay from the force, was also indicted
on city charges of drug conspiracy and misconduct in office last week.

City officer sold drugs and gun, U.S. charges

A Baltimore police officer who worked in one of his agency's most
sensitive units was charged with federal narcotics violations after he
was accused of selling a gun and cocaine to a confidential informant
working for authorities during a monthlong investigation, court
records show.

Eduardo Munoz Jr., 32, who joined the department in 2000, was being
held without bail pending a detention hearing in U.S. District Court
in Baltimore scheduled for today. He has been suspended from the
department without pay, police officials said.

Munoz worked as a Spanish-speaking interpreter in the city
department's criminal intelligence unit, which keeps tabs on drug gang
activity and investigates potential terrorism threats. City police
officials declined to elaborate on Munoz's duties in the unit.

It is unclear how long Munoz is alleged to have been operating a drug
ring, according to court records filed in federal court. Federal
agents wrote in court papers, in which Munoz is charged with
conspiring to possess and intending to distribute drugs, that they
began to investigate the officer about a month ago.

That is when a confidential informant told the agents with the Bureau
of Alcohol, Tobacco, Firearms and Explosives and the Drug Enforcement
Administration that Munoz and another man were selling drugs out of an
auto body shop in the 900 block of S. Wolfe St. in Southeast
Baltimore, the records show.

Munoz and Jose Raul Estela, 29, were selling about 3 kilograms of
cocaine a month, mostly to other Hispanics, the informant told agents,
according to the court documents.

Munoz tried to give a handgun to the informant in late February, the
agents wrote, but the informant refused to take the weapon.

Agents began staging a series of meetings during the next month
between the informant and the two suspects at their auto body shop.
Agents monitored the meetings with electronic surveillance equipment,
the records show.

The informant bought a .357-caliber revolver and several ounces of
cocaine from Munoz and Estela during the meetings, the agents wrote.

Agents arrested Munoz and Estela on Monday and seized 9 ounces of
cocaine at the auto body shop. Agents found about $750 on Munoz --
about $600 had been given to him by the informant for cocaine, the
agents wrote.

Munoz is the second city officer arrested on drug charges since March
21, when Officer Aleacia Hill, 25, was charged in Baltimore County
with possessing drugs and obliterating the serial number of a handgun.

Hill was later indicted by a city grand jury on drug conspiracy and
misconduct in office charges.

City officers charged in separate domestic assault incidents

Two Baltimore police officers were arrested during the weekend and
charged in unrelated incidents with domestic assault.

Officer Ralph P. Oakes, 34, a 10-year member of the force assigned to
the child abuse section of the Criminal Investigation Division, was
arrested Friday night and charged with assaulting his wife that
evening, said Agent Donny Moses, a department spokesman.

Oakes' wife was taken to Harbor Hospital, but refused treatment and
was released Saturday morning, Moses said.

The officer, a South Baltimore resident, was released from Central
Booking and Intake Center on $15,000 bail, and was suspended with pay
pending a departmental hearing, Moses said.

Officer Michael B. Nelson Jr., who entered the department nine months
ago and was in training at the Western District, was arrested Saturday
night at an East Baltimore residence and charged with assaulting his
girlfriend. Because Nelson was on probationary status, he is not
entitled to a hearing and faces possible dismissal, Moses said. Bail
information was not available last night.
