Dear Committee members,

With the DPDP Framework moving toward full operationalisation in May 2027, many RWAs are reassessing how personal data is collected and managed.

Given the seriousness with which we approach data privacy, we have sought a thorough understanding of the law and, in particular, questions around whether advertising creates legal risk for RWAs.

Key Highlights

  1. Mygate is fully committed to supporting resident welfare associations ("RWAs") in fulfilling their responsibilities within the DPDP framework.

  2. Advertisements on the Mygate platform are already aligned with the DPDP Framework, as advertisements do not result in automatic data sharing; only residents can choose to share his/her data with a brand via their use of the application.

  3. The penalty, of a maximum of 250 crore INR per instance, is applicable only when there is a failure to manage personal information (eg, a failure to implement security safeguards, failure to inform users of a breach, etc.) and is not linked with advertising per se.

  4. Role-based dashboards on Mygate help RWAs control who can access what data, reducing internal misuse risks. Centralised records and audit trails make it easier for them to respond to access, correction or deletion requests.
