Dear Members,
It is an agonizing experience
since the AAGM held on 25th Oct 2015. We once again THANK YOU ALL for giving me
and my committee an opportunity to serve the society to the best of our knowledge
and capacity.
We once again assure you that
no decision has been implemented which would have resulted into any loss to any
member of the society or the Garden View Co- Operative Housing Society Ltd.
You all must be wondering
over, how we are still corresponding with you, since we have resigned during
AAGM. It is rather unfortunate, but the reality must be known to all of you/us.
After we resigned during the
AAGM , the self declared care taking committee took over the immediate possession of all the records,
society office including computer, official email, AppartmentAdda admin right,
etc immediately post AAGM and, we did not object or create any obstacle, so
that the Society and the members should not suffer.
It is pertinent to express the distress of being leveled
as corrupt during the AAGM, and more agonizing was to understand through an
email that some of my colleagues in the managing committee had resigned in
block without even once during their association having aired their dissent to
any decision. It must have been done under some stress or fear as the same is
only privy to them. We respect their valuable services provided to the society
in their respective area of work and thank them, notwithstanding any
shortcoming in our collective and individual discharge of duty, which will be
looked into by the new committee as and when it takes charge of the society.
After couple of days, Mr. Venugopal the self-designated Chairman
of care-taking committee asked us for formal handing over. As per our
understanding and to avoid any legal implication we decided to seek guidance
from Dy. Registrar (Guardian of all Co Operative housing society difficulties) on handing and taking over
modalities, the decision was taken in the interest to safeguard outgoing
committee and care taking committee and obviously all other members .
We must bring to your notice a fact which can be seen
from the records of the proceedings of the AAGM. Mr. Manish Shrivastav –
Treasurer kept requesting the members during the AAGM that let us define the
process of handing over but the same was not heard by the members.
We requested Mr. Venugopal to jointly meet the Dy.Registrar
and present a unified resolve to continue the Society operation further without
any complication with lawful handing over and taking over. This must be
understood by all the members that this handing over was not normal, it was
being done under serious charges during the AAGM on the working of the committee
and specifically the Chairman, hence the handing over has to be in complete
detail along with the actions of the last four years etc. However, the Dy. Registrar
spoke to us separately (Office Bearers of Current MC & so called self declared care taking committee). The Dy. Registrar advised us to
continue providing service to the society till further instruction from his office.
This was verbally told to us. Therefore, after the meeting we confirmed the
deliberations with the Dy. Registrar as a record of discussion vide our letter dated
06/11/2015. Copy of the letter to Dy. Registrar is enclosed for your reference.
It is pertinent to inform you that till
date,we do not know what transpired between the care taking committee and Dy.
Registrar during the meeting after we left the office of the Dy. Registrar. But after the meeting with Dy. Registrar,the Care
taking committee stopped working at the society and deserted the society office
without even informing the outgoing Chairman, Secretary or any other MC members,
the society and other assets were in their possession/custody for about 10 days
since AAGM.
We have started looking after day to day needs of the
society after the meeting and advice from Dy. Registrar. We assure you that we
have not taken any policy decision during this period. We have given an update
on the event of the society as demanded by Dy. Registrar wide our letters 7/11/2015
and another follow up letter dated on 26/11/2015, which is enclosed for your reference.
As advised by Dy. Registrar we are proceeding on the
formalities to be completed and submitted to his office so that he can take
further action as deemed fit. It is our endeavor to ensure that interest of the
members of the society and its property is fully secured.
Please feel free to write to us on your view either
directly. However please ensure that we
jointly represent the society in a unified manner and should sit down event by
event to take steps towards functioning of society office and any improvement
etc. A very critical issue of conveyance deed registration is pending for
conclusion in the final stages and our unified strength will get us a very
honorable decision in our favor.
Notwithstanding above, as we did in the AAGM, any time
any stricture or shortcoming is noticed with regard to our working for the
society, we assure you that you can investigate independently any time.
Another discussion is scheduled on 21/12/2015 with Dy.
Registrar with reference to his letter – P-WARD/GARDENVIEWAPPARTMENT/1771/2015,
dated 04/12/2015 copy enclosed. After the meeting the details of proceeding
will be again conveyed to each member.
Trust we have given a detailed account of all our
actions till date from the fateful day of the AAGM held on 25 Oct 2015
