The Massachusetts Supreme Judicial Court issued a ground-breaking decision on racial justice in Commonwealth v. Long, SJC-12868, when they agreed that the previous remedy for addressing racially motivated traffic stops under the equal protection clause of the state and federal constitutions, a statistical showing articulated in Commonwealth v. Lora, was inadequate and unworkable.

The SJC announced a new standard for defendants to challenge police stops for Selective Enforcement of the Traffic Laws Based on Race.

Now, the SJC has placed the ultimate burden on the Commonwealth if a motor vehicle has been motivated by race.

We will discuss the following:

  • What is the new standard for judges to determine if a traffic stop was motivated by race?
  • What guidance was given by the SJC to judges in determining an impermissible basis for the MV stop?
  • What effect does Commonwealth v. Long (2020) have on each police officer?
  • If the motion judge finds for the defendant that the stop was motivated by race, what impact would that have on the police officer’s certification with P.O.S.T.?
