Hi there!
My name is Heather, and I’m the HMIS coordinator at MDHA-Metropolitan Development and Housing Agency- in Nashville, TN.
I have just learned that our attorney is advising that MDHA (we are both the CoC lead and the HMIS lead agency) to not allow agencies to use HMIS/Service Point for storing any data except for what is specifically required by HUD. (Our attorney actually went so far as to first recommend that we not even allow agencies to store APR required data, and to only capture UDE’s…) I feel certain that any changes like these would have a dramatic impact on the service we could offer as both an HMIS lead agency and also a CoC lead agency.
I’m wondering if your city/state has any experience dealing with legal concerns around liability of the agency that is the HMIS lead? I am hoping to find some (government based if possible) organizations that are HMIS lead agencies who have already hashed out these concerns with a legal team and have procedures and protocols in place…If you could possibly provide any of the following for me, I’d be so grateful! This recommendation from our attorney is moving along at breakneck speed, and our meeting to discuss this is Wednesday of this week. I apologize for the short notice nature of my request!
Please feel free to forward this email to any agency that you think might be able to assist with information!
1) Briefly summarize your local policy and procedure for agencies to use HMIS
2) Explain the legal process behind your current policies
3) Forward me blank copies of user agreements, ROI’s, MOU’s etc.
4) give me contact info of your legal team that determined your community use of HMIS is not a huge liability
5) give me contact info of any other CoCs that you are in contact with who might be able to help me with this?
