what is the upgrade path if you have a service contract?

There is no change to the upgrade path. If you download the
evaluation now you will have the full software for 30 days (English
only by the way). When you get your box it will contain an activation
ID and when you run the Eval we prompt you to see if you have the code
yet. When you answer yes, you can enter it and the product will be
activated identically to the scenarios where you had waited for the
box and installed the software then. Basically you get up to 30 days
free peek and no uninstall when you get the real package.
If the package takes longer to deliver and the software disables, you
will still be able to enter the activation code when you get it but
you would be blocked from the product for that time period. Unless
something has changed fairly recently, I believe that activation code
is not associated with your software until the package is ready to
ship. So calling support on your maintenance contract would not be of
much help as they would not have it until ship time.
Again, I hope we get the orders out and shipped before 30 days. Of
course, if you purchase via a 3rd party supplier I really don't know
how that works.

so if i have a maintenance contract I STILL have to buy 10.5?

No. If you have a maintenance contract that gives you access to the
new version you still get a new box, don't you? I know that
maintenance contracts expire but if your contract gives you access to
10.5, you will get the new version automatically. My whole post was
that even if you do, you can start using 10.5 today and you won't have
to uninstall when you get the formal delivery package.
