I am glad to know that the mfgglobal legal cell is providing free legal advice.
I have been in Bahrain for the last 18 years and is currently in independent practice as a Legal Consultant. I am the Convener of the Legal Cell of the Indian Community Relief Fund functioning under the auspices of the Indian Embassy, Bahrain. I have been providing free legal advice to Indian workers in Bahrain for a few years as explained below:
1) The Embassy conducts an open house on the last Friday of every month where the Indian workers are allowed to meet H.E. the Ambassador and senior officials of the Embassy. I attend the open house and assist in answsering questions from the workers.
2) For nearly a year I was doing a live radio programme interacting with and answering questions on Bahrain employment related matters on RadioVoiceBahrain, FM 104.2, an Indian Radio Channel in Bahrain.
3) I have also provided such advice through Kairali TV as a part of the programme called "Desert Scan" in a few episodes telecast a few months ago.
4) I was instrumental in starting a service for providing advice in Indian languages at the Labour Markets Regulatory Authority (LMRA), the government body responsible for regulating employment of expatriates in Bahrain. For a few months from the inception of this service, I was spending one and a half a hours a day, five days a week, at the LMRA to answer calls and providing advice in Malayalam, Tamil, Hindi and Marathi. Later, we trained other volunteers who took over that responsiblity.
5) As my telephone number was announced on the Radio during my programmes, I continue to receive calls regularly from the Indian workers in Bahrain seeking advice.
6) I post articles on Bahrain employment related matters on the website www.nribahrain.com under the Expert Group "Legal and Workforce".

We are receiving several grievances regarding the modalities of terminating employment contract by employees. Since the nature of grievances is almost similar, I am providing some general advice to safeguard the interest of those who want to resign/terminate their employment contract with the employer.
1. Please verify the employment offer letter before acceptance. This offer letter contains terms regarding resignation/termination of services. Some companies insist a time span of one month for giving notice by the employee and some others insist three months time period. Yet some companies keep the notice period vague. Insist clarification on this point before you accept the offer.
2. Remember that once you sign the offer letter thereby signifying the acceptance of the terms, the contract becomes complete. Both the employer as well as the employee should abide by the terms of the employment contract.
3. Before signing the employment contract, kindly ask for the rules & regulations(if codified) and read them before you agree to the terms of employment.
4. In case of subsequent organizational changes, such as take overs, amalgamations, etc., please do request the employer in writing if any conditions of your first employment offer is going to adversely affect you. This clarification is essential to avoid future problems.
5. If the original contract is not altered by subsequent organizational change, you can say that the notice period is such and such and as per the particular clause, you may be relieved on the expiry of the notice period.
6. In case you are not going to serve the company during the notice period, please verify what is the compensation you are required to pay to the employer and offer the same.
7. In most IT/ITES companies, please note that an employee is required to sign NON DISCLOSURE AGREEMENTS. Please verify the terms and evaluate how such terms would affect your future employment elsewhere.
8. In spite of offering the notice of resignation or compensation in lieu of the notice period, if the company is withholding acceptance of your resignation and/or the employer is not relieving you, you have to consult a trusted lawyer of your choice to explore the possibility of a litigation.
9. Even among the most literate and highly qualified Keralites, we have observed that they do not keep even office copies of their correspondence with the employer. They should always maintain a file containing all particulars regarding their employment. When things go smoothly, these particulars may not be of much use but in case there are conflicts of interest, these particulars would be of immense help.
PLEASE REMEMBER THAT LITIGATION IS NOT THE ONLY WAY TO RESOLVE CONFLICT. IF THE LAW IS ON YOUR SIDE YOU WIN.OTHERWISE, YOU LOSE. TO KNOW THAT LAW IS ON YOUR SIDE, YOU MUST HAVE EVIDENCE WITH YOU TO SHOW THAT YOU HAVE BEEN WRONGED.
