Our appeal received 160 responses from individuals and NGOs asking for the immediate withdrawal of the ultra vires order No 245/2022 dated 6th June 2022. Enclosed is the letter that was delivered to the Commissioner of Police (CP) Mumbai.
Further to our appeal on 11th June eepresentatives from almost 20 NGOs attended a meeting with CP Mr Sanjay Pandey. and shared their ground realities of difficulties faced by women and children in registering cases of sexual offences. We asked for the immediate withdrawal of the order. Mr. Sanjay Pandey assured us he would put the order in abeyance and requested time to draft a revised order.
On 16th June 2022 a PIL filed by a tribal woman from Nandurbar settled in Mumbai (the police have refused to take cognizance of her daughter's sexual assault by a policeman, even after a passage of ten months) was heard by the Bombay High Court. Her Advocate Mr. Arjun Kadam submitted that there was no legal basis for the circular.
On 17th June 2022 women's groups held a press conference against the order
On 18th June we received the revised circular issued by the Mumbai Police directing police officials to immediately register an FIR of molestation or crimes under POCSO Act in cases where they do not suspect any foul play.
