Imprisonment is un-Islamic and inhuman
Imprisonment as a punishment for a crime is the worst violation of a human right. That is why it is not provided in the Fiqh of any school of Sharia, while many other punishments are provided for various crimes. Imprisonment was never provided under the Muslim rule anywhere in the world. In fact, there were no jails for ordinary criminals (only for state rebels).
There were no jails in South Asia until the British rule came. Nor was imprisonment provided for any crime until the Indian Penal Code was enforced. We must abolish this inhuman punishment.
The attached paper discusses all aspects of imprisonment and suggests alternative punishments.
