Disputes under the Maharashtra Co-operative Societies Act, 1960.

It is 32 years from the death of a original member and the society does not know with whom it has to deal with and recover its dues. Unfortunately, neither the "Co-operative" society nor the "Co-operative"  Department do not differentiate between a "NOMINEE" and a "SUCCESSOR" and therefore has two more disputes, whereas the number of members are just 11. These 11 members have lost their right to residence for the last 5 years but are in no mood to settle down. The society has a huge outstanding for the last several years but no steps for recovery are possible as the 3 members are not defined due to disputes.
 
Some members have moved the Mumbai High Court for reasons known to them and have made the District Joint Registrar and the Dy. Registrar as Respondents to their plea.

There is no effective control either of the society or the Registrar and the Government is not interested in any way.

This raises the question whether the MCS Act, 1960 is an effective implementable law or it needs to be scrapped.  

Could there be a good discussion on such laws, especially when the Prime Minister announces reforms to take the country to Amrat-Kaal by 2047?
