sub Election of new committee due to resignation of five members

Dear All  esteemed learned members

In Our Mhada society having membership of 20, the five(5) committee members(including treasurer) resigned thereby making the committee is not having a quorum to conduct meeting /minority out of elected members strength  of eight(8), in protest against finalisation terms of redevelopment agreement  by chairman and secretary . 

( as stated in their letter)  

In a communication to members ,secretary mentioned that they have right  to select new members and according issued notice of SGM for election on 4.1.25

The agenda of notice is as follows:- 

                                                                     NOTICE 

Notice is hereby given that the Special general Meeting of the members of the Mahavir Prem cooperative housing society limited will be held on 04.01.2025 at 4.00 p.m. at Flat no 6228 to transact the following business:

 1. To discuss on resignation letters received from Five (5) Committee members through What’s App/Mail/hard copies

 2. To conduct the election for the appointment of new Managing Committee. 

3. To appoint an Election Officer who will conduct the Election.

 4. To discuss on status of re-development of our Building.

 5. Vote of Thanks.

Note In case of no quorum, the meeting will be adjourned for half an hour and then the meeting will be conducted by members present

My query to our  learned members are:

a. Though indent may be noble to constitute a full committee for operational convenience whether they are in order or right to call SGM without informing the Registrar co-op soc. about the situation of the committee ( Committee is not having proper strength with the resignation ) and seeking his guidance or advice.

b. Whether till the secretary has power to call such a meeting or he is to be considered deemed ex secretary in view of the strength of committee.?

c.  Whether as per item no 3 and 4 they can appoint election officers on their own and conduct election on the same day. ? 

d. Neutral members like me are confused in a sense whether the secretary/chairman is right conducting a meeting for electing  new members by conducting an election or they are not giving  full facts about their position in such a situation .  ( i.e in normal election procedure the election officer is appointed by the registrar after submission of details and calling details procedure   )

I look forward your valuable input to inform the members about the right of provision ( incidentally one question whether can resigned members  contest the election if held ? ) of law

sir first you should inform this matter to dy registrar and  tell them to appoint an administrator in your society as 5 members had resign within six months 

administrator will hold an election and new committee will form and then you can go for redevelopment
