Dear respected members
In our compound all existing societies were amalgamated and formed a new society on June 25 for redevelopment.
The maintenance charges were fixed as a lump sum without giving composition of charges. Some members objected to this and refused to pay the charges unless bifurcation details are given.
Since the clarification is given now, the members who have not paid earlier , paid now.
However the Mc now passed a resolution for payment of interest @21% PA from members for a delayed period .
The defaulted members have now made an objection that no resolution can be passed by society to effect action retrospectively( back dated) and it can be progressive basis only. Hence they refused to pay interest and made the claim that such action is illegal. The Mc claimed that they will go for recovery proceedings.
I would like to know from learned members whether the defaulting members stand is correct and can refuse such payment when they defaulted in payments in time
