We currently have 9 Libertarian Party affiliates on board (Idaho, Kentucky, Maine, Maryland, Mississippi, Nebraska, Oregon, Pennsylvania, and Tennessee), but our goal is to include all 51 chapters and the national party.
Paul Rossi, cc’d here, can add anyone to the vehicle filed by Idaho and the other affiliates. In addition to Idaho, we already have support from 4 Congressmembers, Project Veritas, Attorney General Ken Paxton, Young Americans for Liberty, and many others.

Dear Liberty Lovers!
I’m reaching out with an important update on Barton v. SEC. The U.S. Supreme Court has taken the unusual step of ordering a response from the Solicitor General after the SG initially waived—an uncommon move (less than 1% of cases) that signals one or more Justices view the petition as raising substantial constitutional or statutory issues. The case is now under active review.
Momentum around this case has accelerated quickly. By Nov 18th 23 organizations signed onto nine separate amicus briefs representing a wide cross-section of America: criminal-justice reform groups, political parties, major think tanks, civil-liberties and First Amendment organizations, crypto-policy advocates, and more. In addition, multiple Members of Congress and statewide elected officials have filed in support. Collectively, these amici represent over 80 million Americans, all urging the Court to grant cert and address the constitutional limits of civil asset forfeiture and the erosion of the Seventh Amendment jury-trial right.
As you may know, Justice Gorsuch’s October 15 dissent specifically highlighted these issues as “long overdue” and “ripe for review”—and this case is now the vehicle. Public attention is also growing: Tim was just on Newsmax, and there have been multiple meetings with DOJ leadership and many other stakeholders (loomer/stone here).
The Solicitor General’s response is due December 26, so we need to add you guys to the vehicle by then... and this is the optimal window for additional amici. If your organization is interested in filing a short, targeted brief—or joining an existing coalition brief—we can fully assist with drafting, coordination, and timely submission. I’d be glad to share the petition, existing filings, and a summary of the key issues.
