MEETING WITH CHAIRMAN LOK GROUP ON APRIL 21ST AT 2 PM

Dear All , 

Our  secretary  Mr Khot , has informed me that  a meeting with  the Chairman  of Lok group is planned to be held on Saturday  April  21st, at  2 pm in their office. Please make it convenient to attend and also  inform other interested members. 

Chairman / Secretary ,   

I would request you to go through the  last two meetings minutes and carry   them  for  ready reference.   Needless to say  we are sick and  tired of the same old excuses  given by the Lok Chairman  and his croonies. 

Please share the  agenda  with us  and  let us know whether  the  MC  has proposed any  fresh strategy to  counter  the  lethargic  attitude of Lok. It was long back suggested to  move the consumer / civil  court  and  to that effect our legal  representative had studied the  agreement signed by members with  the builder and  other documents received from Lok.  What are the steps being taken  in  this regard?

Dear All,

I am sure you all have seen the attached article on Property tax and can now be clear that it is the void in law making and interpretation that makes us the victim. This must be borne in mind while  taking a tough posture during negotiation with builder.

I express my willingness to join meeting with builder on coming Saturday provided MC is clear on what they want in favour of us and there is substantive agenda to discuss or negotiate. Get Minutes signed then and there to build up our side of papers for legal process ahead.

Hope we do not again loose sight while on the table with LOK Chairman. Our single demand of giving us OC followed by conveyance must be met in time bound manner. if not, MC must take steps as discussed earlier with legal counsel to move (how long and for what we are waiting) for deemed conveyance.

P.S. If only Avdeshji was given a patient hearing and he would have made us understand all the provisions involved in common man's language. Taking BMC official (lower level collector) on face value was not in our interest since they are only busy to protect their job or busy making money from gullible audience.

Dear Secretary,

My suggestion would be to have a sync-up discussion today evening
(Thursday being a weekly off for society opeartions) around 7:30pm
with members who are planning to attend the meeting.

The only item which has progressed is the construction of boundary
wall near A1, rest all I presume is in the same state as of last
meeting - resting in peace.

Dear   Chairman / Secretary , 

Please circulate the  draft   minutes of the  meeting . The minutes  are important  and will help  us  when  we fight  in the consumer court .  

The  meeting  once again  highlighted the fact that  neither Mr Gandhi  nor his team  have  bothered to  review the  pending issues which we have  been  highlighting  repeatedly.  One more monsoon will pass  with  no  progress .  

It is now high time  that the    long pending  issue of  deemed conveyance route  must be  immediately perused  by  our laywer .

Dear Secretary,

As requested I have reviewed the draft minutes and find it to be
generic and incomplete. Most of the specifics and some items discussed
are missing. Below is the list of my comments. I would also recommend
the draft to be shared with other members present on the day.

1. SBI Mortgage - Mr. Gandhi shared the details of latest LHCL
proposal to SBI. The proposal was re-negotiated since the LHCL could
not comply to their previous committments. They could settle only
Rs.30 crore out of Rs.60 crore. LHCL latest proposal was to pay Rs.85
crore. SBI has acknowledged the receipt and are in process to
evaluate. Mr. Sudhir Gokarnkar and Mr. Rajaraman raised their
apprehensions about such proposal and LHCL finances to which Mr.
Gandhi assured that on first payment of Rs. 5 crore SBI would release
the property documents atleast for 14 days as required by BMC for A5
pending construction approvals. Mr. Gandhi confirmed that the entire
layout as per records is Lok Sarita, Lok Yamuna is an extension of Lok
Sarita and the mortgage is on the complete layout. He also assured to
share regular updates on the progress with SBI.

2. Partial OC - Members raised their grievances that LHCL has failed
to start the pending construction of A5 wing and also apply for
complete OC of all 5 wings as committed by Mr Gandhi during the
October meeting. Mr Gandhi assured to immediately initiate the process
of partial OC.

3. Lift in A4 and A5 wing: A5 members highlighted their hardships due
to non-availability of lift in A5 wing. Mrs. Eugine also shared her
inconvenience and daily stress faced by her senior citizen mother. She
complained with pain that her mother has health issues and using
stairs from third floor adds to her suffering. Mr Gandhi has assured
to immediately carry out the inspection and installation of lift in A5
wing. He also assured to carry out the inspection of the A4 wing lift
and resolve the frequent problems. Mr Rajaraman stressed to replace
the service from Eros to OTIS as there has been repeated failures in
Eros service due to usage of sub-standard materials.

4. Usage of additional FSI to complete A5 construction: Mr Sudhir
Gokarnkar argued and notified that LHCL cannot use the additional FSI
since its under LYCHS right of usage during re-development. LHCL must
pursue the TDR option to construct the pending A5 wing.

5. Conveyance, Water line and sewage: Mr Gandhi assured that this too
will be addressed once the property documents are released by SBI as
required by BMC. He directed Mr Sanjay Shetye and Mr Rathod to
immediately take necessary steps to resolve and perform cleaning of
septic and sewage tanks.

6. Fencing near hill side of A1 and A2: There has been no progress on
the repeated escalations inspite of the major accidents during the
year 2011 monsoon. Mr Gandhi had personally visited these accident
spots within LYCHS premises. He assured to fix this issue before onset
of monsoon this year.

7. Construction of boundary wall near A1: Members thanks Mr. Gandhi on
completing the construction of boundary wall as per committment. They
requested to complete the wire fencing above the wall.

Mr. Gandhi thanked every one and also promised to meet after fortnight
to share the progress.

Dear  All , 

It is rather disturbing to  note that  none of the  current MC  members bother to use this  forum to  share their  views / concerns  even when their names are included in the group.  This   total silence from MC  members to  all our mails   makes me wonder  whether there is a code of conduct or curfew  being  imposed on such  members !  Even  mails marked to the  official  society email id remains  un-responded.  Why this  kolaveri ? 

Unless issues are brought out in the  open  and  discussed fearlessly ,  we will never be able to  implement  good governance in our society .  Please understand  that we are all together in our fight  against the injustice  meted out to us  by the  builder .  Unless everyone understands and  speak up  for our  common rights,  the  builder  will make our  lives miserable. 

The  MoM is an important  document  and should  be  drafted well  to ensure  we have a strong case against the  builder when  we apply for  deemed conveyance. 

BY THE  WAY,   WHAT  IS THE PROGRESS  ON  DEEMED CONVEYANCE ?

I AGREE.

Surprisingly the draft never arrived in my mail box and looks like a selective approach. Next time I won't feel like accepting the invite to join such meeting that is nothing but pushing things under carpet. INFORMATION is at best blocked.

Dear  All ....

Despite  Lok Chairman's  promise of meeting our members in our complex , we have  been called for another meeting today at his office . This  once again  speaks  volumes about his promises and commitments ! 

Anyway  , we should  assemble  at Lok office  by 3.30 pm and continue to  express our  deep disappointment  and  anguish  with the  inordinate delay  in solving  our issues .  We must  give him an  ultimatum beyond which  we must  stop him form  entering our  Society  premises and take over his A1 office.  

Just to  kindle your collective memories , I have enclosed Sudhir's drafted minutes  of the meeting held on April  21, 2012 .  Yes,    2012 !   You can see that   nothing  has changed even today !! 

It is now  a decade since we took  possession of  flats in Lok Yamuna and still we are where we were ten years ago . 

So  friends the  saying , 

"IF WE CONTINUE TO DO WHATEVER WE WERE DOING , WE WILL CONTINUE TO GET WHATEVER WE WERE GETTING "   

is absolutely  true .
