Thanks for the initiative !

Are we not demanding double penalty for late delivery from builder , I have raised that demand to Logix (marked group in CC) increasing per sq feet late penalty to 10 Rs from 5 Rs, as that cannot be sustained for prolonged delay of 7 years when original commitment was 18 months .

There are some court decisions supporting that in other projects , I have seen.

Hi,

You are right to the extent that there is high probability of receiving a relief from Judiciary (NCDRC / RERA).
However, since we have signed Builder Buyer Agreement, Logix will continue to provide penalty as per signed agreement unless a direction to the contrary is received from the Judicial system.

Hello Naval,

Certainly agreed Logix will stick with the open ended condition of 5 Rs per sq feet after stipuled time of delivery mentioned in BBA has passed , supported by buyer registering the claim of starting the penalty period , which I regitested with Logix and they agreed in OCT 13, after 18 months on my BBA date was passed.

But, this can be challenged and I have seen court decisions ( verdicts on other projects ) , where court ordered builder to cancel the unit and pay buyer 15% quarterly interest over given money or pay the buyer higher amount 7.5 Rs per sq feet for delays , and builder would in such suitiation never cancel the booking, as it’s more loss to him.

Let’s explore legal options, I am willing to be counted for it.

We have a group of buyers who are already in NCDRC for such matter. Please register on the link sent by me (in separate email on this group), and also send an email to ca.nav...@gmail.com with your whatsapp number.

I will connect you to those buyers who are fighting legal cases. But you will have to hurry up and impleadment date of existing cases is already over and unless if you want to a file a fresh case, you may like to decide asap.

Note that I have not filed a legal case yet, as I got my flat transferred to Phase 1 and already got my registry as well.
