Dear LNC Members,

I hereby provide notice of a motion to initiate trademark litigation in New Mexico against the organization using the name "Libertarian Party of New Mexico" and operating via the website lpnm.us.

Prior to the meeting, I request assistance from the Treasurer or the FSC to determine the appropriate funding amount for the case and to incorporate corresponding allocations into the motion.

If adopted, the LNC shall promptly prepare and file a lawsuit in this matter, unless the offending parties immediately cease their infringement upon any and all trademarked or copyrighted LNC materials in any and all online or business-related publications or activities.

It is essential that the LNC pursue this action if the issue remains unresolved by the upcoming meeting, in light of the cease-and-desist letter authorized on September 7. This infringement is particularly concerning given that, after appearing on 2024 ballots as the "Liberal Party," the group has resumed use of our mark, despite awareness of the LNC's successful trademark defense in Michigan.

Our defense is further critical amid the ongoing ballot access dispute, where the LNC is considering joining as a co-plaintiff. This follows the LNC's investment of over $50,000 to support our recognized affiliate, the Free New Mexico Party, in securing ballot access last cycle.

The LNC has a duty to protect its trademarks, and the timing is urgent following the infringing group's joint statement with the Democratic Party earlier this week, which directly challenges our mark. If infringements persist, we must initiate litigation promptly to prevent dilution or potential forfeiture of our trademark rights.

I recently forwarded the request by Massachusetts Affiliate Chair Kennedy to include, in our special monthly meetings, a discussion of the work of each Board Member to advance the Party's Goals.  Accordingly, I would like to add the following to the Agenda for the upcoming Special Meeting: A statement by each Member of the Libertarian National Committee as to "what they have accomplished in the past month and outline their plans for the upcoming month". In the pursuit of the goals of the Libertarian Party, AKA Liberty in Our Lifetime.

From Chair Kennedy, by way of background.

Good evening gentlemen,

I am proposing the following item for inclusion on the agenda of a future LNC meeting. Given the ongoing strife on the public list, it would benefit the party and its membership to gain a clearer understanding of what our LNC members and regional representatives are actively doing to advance the party's goals. As an active chair and elected Libertarian, it would be reassuring to know that those in our elected roles are also "doing the work."

The goal of this item is not to spark debate between members, but rather to provide a structured opportunity for each member to share what they have accomplished in the past month and outline their plans for the upcoming month. This could take 2-3 minutes per member. I urge all present at the meeting to participate and provide input. Without a response, an abstention may be perceived as a lack of active engagement on the board, which could raise concerns for both the board and the broader membership.


For reference, here is a suggested format for the agenda item:


Agenda Item: LNC Member Activity Reports Proposed Discussion:

Allocate time during the meeting for a dedicated discussion period where each LNC member, including regional representatives, is expected to provide input by reporting on their activities in their capacity as LNC members over the past month and outlining their plans for the upcoming month.

This structured reporting aims to enhance accountability and transparency among the LNC, affiliates, and membership. Note that this is not intended as a debate or Q&A session, but rather an opportunity to demonstrate to the broader membership that the LNC is actively engaged and working on their behalf.

Objective: Foster open communication, track progress, and align efforts by sharing individual contributions and goals.
