Subject: Records Request

Aloha!

This is a formal records request for the vote totals, dates, and deliberations for all the votes which this JC has conducted to deny or reject filings in the LPNH matter pursuant to rule 2.8.

This request is being made under D.C. Code § 29–413.05, under my rights as a director of the organization.

As this is a pending matter with an approaching deadline, I request these to be produced to the board and to me as quickly as possible to avert imminent harm and liability to the organization. Please provide them within 48 hours, or otherwise as soon as reasonably practicable.

Please confirm receipt of this request and confirm the expected timeline of delivery of the requested documents.

Mahalo for your kokua to this important matter.

Austin Martin

Instead of drama-farming, I invite those who would stand up for the LPNH to file briefs against the LNC on their own.
This can include a state Chair, officers, or anyone else who wrongly believes we should not have disaffiliated the LPNH.

If the concern here is that the JC won't process your briefs because they're not from dues-paying members (but, rather, are from organizations), then just have a dues-paying member submit it. Done - no fuss.

If the goal is really to provide some insight to the judicial committee, then file it as a member - as has been requested by the JC.

Using resolutions and affiliates as a conduit for briefs has the appearance of placing political pressure on the JC, which is obviously inappropriate.

Out of curiosity, was this interpretation a feature of the prior JC rules as well?

Greetings.

Mr. Thompson,
In theory any brief or document from anyone could be construed as "putting political pressure on the JC".

Characterization of statements of opinion as "inappropriate political pressure" seems dubious.

Ive got serious concerns about the legitimacy of this JC.

In its very first case, its rejected TEN documents all of which were items on one side of the case.

This was done by someone who is on record for hating LPNH's guts for years.
And is now rejecting practically every single filing in support of the appeal.
Citing rules that -He Wrote.-

Apparently without evidence that votes were held internally by the JC BEFORE the rejections were made. (In controvention of its own rules?)

I try very, very hard to be objective as you all know.
However, this all gives the impression that LPNH's appeal was decided before it was even filed.

P.S.
(There are rumors that an 11th document was rejected because a journalist using a pen name submitted it, and that was later corrected by someone else filing it in their own name?)

Greetings.

Just realized this is a public list thread.

I guess "It is what it is" applies.

Aloha,

The records request above is still outstanding, and confirmation of receipt has not been issued by any member of the JC. Please confirm receipt of this request and indicate the amount of time expected for fulfillment of requested documentation.

For reference, I am requesting all the JC votes and documentation related to rejected filings, pursuant to rule 2.8. This absurd and offensive rule basically allows the JC to be as unfair as it wants, silencing any person for basically any reason, so asking for the votes to show you folks followed your own procedures should not be a difficult thing to produce.

Mahalo!
