As Mr McMahon has pointed out, this thread was not raised publicly, which was stated by the JC as a requirement in the hearing that occurred last year.

Given that there have been substantive questions raised for consideration, and that we have received professional guidance from our paid board consultant emphasizing the fact that email is a horrible medium to conduct business, I would echo the request that this motion be noticed and considered in the meeting that we have scheduled right around the corner.

Especially considering our difficult financial situation, and consideration of allocating $10,000, while having not heard details about budget availability/budget impact, consideration of other ballot access needs in future, more information about the situation in the state, etc, that it is most appropriate for this motion to be considered in a meeting with discussion.

Therefore I raise the PoO that this sponsorship is out of order in violation of the JC ruling regarding email business that was issued last year.  I would further hope that unless there is an urgency to this matter that we have yet to be made aware of, that board members would refrain from reinitiating the email ballot, and proceed with considering the motion in the Sept 7 meeting.

What has been the history of success in achieving the required 3% for retaining ballot access? Would having state-wide ballot access make it easier for local candidates? I don’t think rushing in without allowing more time for questions to be asked and answered is wise or good practice.

Mr. McMahon,

I believe it was a specific requirement of the JC that such matters were specifically necessary to be provided live, but nonetheless, I will leave such matters to the ruling of the chair.

However, the portion that this remedy cannot cure is the fact that (admittedly prior to your tenure on the LNC) we paid a board consultant for her advice on how to best conduct ourselves as a board, and it was her emphatic recommendation against conducting ANY business by email.  This I believe is also a general guideline in our parliamentary authority, though I don't recall specifically.

Given the questions that have been raised, and the benefit that can come from further discussion, it would still be most appropriate to consider this motion in a live meeting.

Mr. Chadderdon,

Currently reviewing the relevant JC ruling to confirm that they held a specific requirement that requests for co-sponsors to an email ballot be done through the public list. My understanding is that it is preferred but not required and has not always been done.

I am familiar with the recommendations from the board consultant, even though it was prior to my tenure on this board, and I do agree with many of her recommendations. In fact, I tend to reject the need for email ballots with narrow exception - a need for timely action. As is the case in most ongoing ballot access petition drives... the contractor needs assurances to be able to continue their work, or they will need to move onto the next project. As our bylaws do allow for email ballots, I do not believe this needs remedied.

That being said, since Treasurer Redpath is on the road until late this evening, I will be restarting the motion on the public list.

I can sympathize with timely action; however, more information is needed regardless of their need for assurances. Our finances are clearly not healthy, and without more time for discussion I strongly feel, as I’m sure several others do as well, that taking on an additional expense for something that is highly unlikely to be beneficial to anyone long-term and garner very little return, if any, warrants at least a discussion.

A compromise could be that we have an unofficial discussion after this Sunday's meeting and then have an email ballot. I'd rather not eat up more of an extra Sunday, but if we are going to hold a meeting that is meant to address and correct procedural mistakes we might as well have one that has potential to prevent a financial mistake.

Dear Colleagues,

I wholeheartedly agree with Mr. Chadderdons notion that substantive motions should be considered during live meetings due to their nature. 

However, the PM does not require us to abide by that best practice, it merely recommends it.

To another point that has not been raised, the Policy Manual §1.08.3 states: "Ballot access expenditures may only be authorized by the Executive Committee, and the total expended cannot exceed the budgeted amount."

As such, in order to move along business according to the bodies will, I will be calling a meeting of the Executive Committee for Sunday, August 24th, immediately proceeding the LNC Special Meeting for the purposes of considering the Redpath motion.

Prior to entering into business, I would like to hold an informal meeting of the entire LNC (post adjournment), for the purposes of discussion before calling the ExCom meeting.

As such, I will rule that the email ballot is currently out of order as only the ExCom is authorized to commit ballot access expenditures.

Mr. Secretary, please send out appropriate notice.
