Pursuant to the passage of Item 4D, which states:

"Move to appoint a Special Investigatory Committee (SIC) to review written complaints on the behavior and actions of Region 1 Representative, Austin Martin, in alleged violation of the LNC Policy Manual. The LNC shall appoint to the Special Investigatory Committee three (3) LNC members and two (2) non-LNC members with the two non-LNC members having not served on the LNC in the last 4 years. The Special Investigatory Committee shall review the submitted complaints and make any findings and recommendations in writing to the LNC by October 15th, 2026."

at the LNC Monthly Special Meeting held on September 13, 2026, the LNC has authorized the creation of a Special Investigatory Committee concerning Mr. Austin Martin. To that end, the committee must be populated with 3 LNC members and 2 non-LNC members subject the requirements stated in the item.

My understanding is that nominations can be as few or numerous as the individual making the nomination desires (e.g., Mr. Hertzsch would not be required to nominate a certain number of people, but could nominate more than one at a time).

All qualifying nominations will end up as two separate Opavote ballots, one for LNC members and one for qualifying non-LNC members. 

As such, there isn't a restriction on how many people you can nominate at one time.

This SIC routine is a playbook used to hustle the LP and stop effective activists, punishing and criminalizing their activities, opinions, and work. SICs can serve a legit purpose, but controlling or criminalizing minority speech is not one of them. We know what this is. You folks have tried everything to weaponize the LNC — frame & shame the opposition.

Does it hurt your tender feelings to hear the truth?

It is amazing how experienced operators like the corrupt Bill Redpath know that if you abuse someone's rights, their only chance to deal with it is to object, but you can make them look bad for doing so by anticipating it, punishing their objection, reversing victim and offender. Horrible peer-pressure based hacks of human psychology help a lot with getting others to go along, rather than rock the boat. Coordination amplifies the effects. The victim becomes the scapegoat and the villain. 

The target is then discredited by attacking them through smear and whisper campaigns, even as their attempts to speak and say their own side of things is increasingly anticipated and spun to support the establishment narrative. Only then can they use overt violence or other distasteful means. 

I now genuinely believe I can prove that the LNC is an establishment-controlled opposition racket — in fact, I have proved it already, and you all are confirming how right I have been all along.

I have been swamped with work and personal matters this week and am now just getting caught up on LNC e-mails. 

After discussing with the region's chairs, Region 9 abstains from nominations and wants nothing to do with this investigation. I also respectfully decline the nomination from Mr. Longstreth, though I appreciate the committee considering me.

Condolences to anyone selected for this investigation, as what I'm reading on it in RONR suggests something out of procedural nightmares.

Region 9 has over 50 candidates running for election in the next 48 days. Our focus is on fundraising and promoting those candidates.

Mr. Chair,

Since Ms. Feintech's nominations were put in after the 48-hour window, is it proper to include them on the ballot?

We have previously had questions as to when nominating windows and balloting closes, based on time zones. Traditionally, I think we've used CA time, which would mean that this was not only after the 48 hours, but also the following day. 

However, if we use Hawai'i time, as the most westerly affiliate, then I can see a good argument that they should have been included.

I'm not trying to lobby that they be removed or retained, but I would like to make the point known and to get your input so we know the rule going forward.

Again, I don't object to their inclusion, but I don't want to be in a position where someone later claims the SIC is invalid because of their inclusion.

Since it's via approval voting, then it doesn't exactly shift the outcome. But it could lead to a situation where one of the late nominations wins, but is later argued to be invalid. I would like to avoid such a situation. 

IMO, we should issue yet another round of balloting just to be safe. Unless you rule the "48-hour" limit to have been non-literal.

Actually, upon further reflection, I do ask that the Chair call the late nominations out of order.

The policy manual sets a firm "48 hours" for the nominating period, and does not mention time zones or "two days" - it's a clear, set duration.

For reference, this is in the policy manual under 1.02 - 6 - 6 

"Before transacting business by electronic mail ballot to fill a committee or LNC vacancy, the LNC shall allow voting members to submit nominations for a period of 48 hours."

My concern here is that improperly including late nominations could create an ongoing defect with the SIC, such that one could later claim the results invalid. A member could argue that, had the late submissions not been included, that they would have voted differently - even considering that we have approval voting. There could be an instance where members may have bullet voted for invalid nominees, or they may have strategically voted for a different member had those options not been in the list.

Further, if one of the late submissions gets a seat, one could argue they should be removed.

I'd rather not get into that mess.

Mr. Thompson,

I am ruling the Feintech nominations in order for the following reasons:

1. There was no clear time zone stated on the nomination thread - which was an error.
2. The intent of the 48 hour nomination rule on appointments via email ballot was to give members time to seek nominees. With the Region 1 Rep passing to the Region 1 Alt, I believe a little grace is in order.
3. Unlike a late vote on a ballot, I do not believe there is a sustained harm with the inclusion of a late nomination.
4. My ruling is specific to this situation.

While it is my opinion that the 48-hour rule is a literal 48 hours, regardless of time zones, my only concern is the creation of an ongoing fault.

If the body is fine with their inclusion, then I won't press the issue.

Had he not specified 12:30 pm I would have assumed end of second full day, as that’s when votes normally end, and 48 hours is two days. It is helpful not having votes/nominations coming in at 3am eastern, though.
