It has come to the body’s attention that, in the course of pursuing dismissal of the lawsuit LNC v. Vest, our Policy Manual requires the following:
"Once a lawsuit is filed or joined, including lawsuits filed against the Party or the LNC, the
Executive Committee shall manage the details of the lawsuit subject to the budgetary
instructions above. The Executive Committee may delegate this task to an empowered
Litigation Committee. The LNC shall be kept advised of the progress and goals of the suit.
Any settlement or dismissal of the entire lawsuit recommended by the Executive Committee
must be approved by the LNC."
As such, a procedural step must now be completed, in order for the LNC to properly consider dismissal of the lawsuit, the Executive Committee must first recommend that course of action.
As such, I am calling a meeting of the Executive Committee for Sunday, September 7th, immediately following the LNC’s Special Business Meeting.
I will move the following:
The Executive Committee recommends that the LNC ratify Chairwoman McArdle’s prior decision to direct counsel to seek dismissal of the lawsuit LNC v. Vest, and further direct Chairman Nekhaila to continue that course of action.
This will ensure that the procedural step required by our Policy Manual is completed, and that the LNC can act with full clarity going forward.
