Subject: Public Update on New Mexico Lawsuit

- ‎Non-Confidential Public Update -

I have attached the filings and order from the judge granting our request today for an additional extension on submitting the $20,000 bond. We are having a difficult time with the bank and the bond company, as this in normal practice takes 3 to 6 weeks. But we believe it should be resolved this week. LPNM filed a motion opposing the bond extension after the judge issued the extension order.

The court mediation conference was today, only attended by the attorneys. This was just a meeting of the attorneys and the judge overseeing the mediation (not the same judge that is presiding over our lawsuit) to set the dates for filings before the actual mediation meeting(s). Judge Robbenhaar wants both parties to prepare and submit a Joint Status Report (JSR) early next week. After that a Rule 16 conference will be set (another meeting) where a specific date for the mediation will be set. LPNM asked for discovery.

Any questions about the above or other questions about this litigation will likely need to be answered in a Confidential email thread.
