Subject: How to Hustle Native Tribes out of their Land Rights and into Federal Slavery

About this "SUWA" group that Amanda is telling our members to mobilize for and support

I read a disturbing article about them from LNCnews.com, which can be read in full here:  https://lncnews.com/articles/lp-leaders-direct-libertarians-volunteer-federal-land-expansion

SUWA’s current chair, Tom Kenworthy, is a former senior fellow at the Center for American Progress, the Democratic policy organization founded by...  John Podesta.

Its stated purpose is advocacy for federal wilderness designation and other protective federal land-use designations pursued through litigation, administrative rulemaking, congressional advocacy, and public indoctrination. SUWA’s institutional goal is to lock up over 8.4 million acres of federal land into wilderness designation, the most restrictive and least-reversible classification the federal government applies, permanently foreclosing disposal, transfer, or privatization.

Section 2.2 of the Party’s Platform holds that competitive free markets and property rights are what protect the environment. The Statement of Principles opposes government interference with private property, specifically naming confiscation, nationalization, and eminent domain.

Other leadership figures associated with this group have been named in the administration’s public campaign against nonprofit funding of protest activity, which it has described as the “protest industrial complex” and “Riot Inc", and are purportedly involved with known foreign influence operations related to this group.

The worst slap is that this initiative from the LP-alliance doesn't evenl protect native sovereignty at all — it actually destroys native land rights and subjects them to federal government control. It's a bait-and-switch hustle aimed at abusing native communities and subjecting them to federal control. This seems evil and hateful toward natives while directly conflicting with the resolution we passed previously which calls for native sovereignty to be upheld and respected, not destroyed.

Why do some members of the LNC appear to be shamelessly lying about the true nature of their "activism" to the Party?

Did you write the article?

I noticed the author conveniently left their name off the publication. Not that it really matters, I was just curious more than anything.

Regardless, both you and the anonymous author elaborately miss the entire point... again. The email didn't say to support everything SUWA is doing. They just happen to be the only organization organizing protests in favor of what all 5 of the tribes comprising the commission have officially stated they want. The land was never judicially ceded, so there is no treaty. It was outright stolen.

Treaty with the Navajo of 1868 established the Navajo Reservation boundary, and the Bears Ears area sits just north of and adjacent to that reservation. It was traditional Navajo (Diné) territory that fell outside the reservation line as drawn, which is part of why the Navajo Nation and other tribes later pushed for monument protection rather than relying on treaty rights.

That's actually one of the arguments the intertribal coalition made, that treaty era boundary drawing had split 5 nations off from land they'd used for centuries, and the monument designation was a way to restore access and management input without reopening treaty negotiations.

Would I love to see the land given back to the 5 nations of the commission instead of being federally managed? Absolutely. Is that going to happen? Very likely not, as the pattern of history has repeatedly shown. So, I will advocate for what the tribes are asking for, which is for a written promise from the federal government to be honored. Voluntary contracts should be honored. That's the libertarian principle here people seem to intentionally try to miss.

In the time you've spent digging into this to find something else to outrage over, you could have educated yourself on the actual treaty status of the land in question, and why these 5 nations are asking for the commission to be restored in the first place. That's not what true advocacy looks like.

Sad to see you sell your own people out to the Feds and the DNC.

Your resolution supported sovereignty for native lands; but the SUWA supports total federalization of those same lands.

If you are mad at me for pointing out the truth about your "alliance", that's a you problem, not a me problem. I am SICK of people taking advantage of Native Hawaiians using this same bait-and-switch. If you oppose sovereignty for natives, then that is on you for being dishonest, not on me for pointing out the betrayal of our movement and our people.

Also, no, I had nothing to do with that article. I did not write it. It was sent to me by a friend.

But Alex, the "who" should matter less than the "what" to any real libertarian. Leftist trash demands to know who is speaking so they can punish the speaker; libertarians respond to what is actually being said.

The SUWA group supports federal control of native lands; they cannot also support native sovereignty.  If your tribal leaders actually support a federal takedown of the land, then they should be deposed and replaced before you consider helping them destroy what's left of your people by selling them out to the DNC and the Feds.

I'm with you on native sovereignty all the way — but not on Federal seizure of lands, because I am a Libertarian.

I hope you will join me in opposing the betrayal of our values. If not, then it is what it is.

This country was founded on anonymous speech, my dear communist NAP-hater.

...because tyrannical psychopaths like those on this LNC would punish speech they don't like.

That said, whoever the editor is deserves a medal, and if they are reading this, I offer my thanks for bringing the truth to our attention.

Per Mr. Flores: "They just happen to be the only organization organizing protests in favor of what all 5 of the tribes comprising the commission have officially stated they want."

Sounds like a pretty regular single issue coalition. It’s not at all unusual for Libertarians to work with other organizations in situations where they are aligned on something, even when those organizations hold other positions or policy ideas that we don’t support. Anyone who has done actual organizing or activism could tell you this, Mr. Martin.

And given that Mr. Flores is the one out there actually doing the work to fight back against a serious injustice by the federal government against his people while you once again spend your time using the public list to disparage other LNC members and push more “OMG foreign influence and paid protesters” conspiracy theories, I'm inclined to trust his judgement on this.

Mr. Martin,

While this country certainly supports anonymous speech, without the right to which there is no freedom of speech, it was not “founded on" it—the men who voted in support of our Declaration of Independence all put their names to the paper, if I am not mistaken, which was a somewhat critical factor in that independence being won.

It is also admittedly a bit rich to read your rather selective endorsement of anonymous speech when you have repeatedly broadcast the speech of members who write to this LNC requesting confidentiality so as to lampoon them.

Mr. Flores and Ms. Leatherman have both remarked eloquently on the purpose of single-issue coalitions and the necessity to add Libertarian voices to this critical issue. To this, I have little else to add that they have not already said better.

Moreover, it is hardly for any of us to decide that Mr. Flores is "selling out his own people", especially when he has been a leader in elevating Native voices and issues to the attention of this Party and, hopefully, the movement. I hope this is something you simply said in anger and do not in fact believe.

Personally, I believe we owe Mr. Flores a debt of gratitude for encouraging our action on these matters. I am proud to work with him and appreciate his guidance when it comes to fighting in support of his community.

Amanda

"Selling them out" by advocating for what they are asking for?

I'm not mad at you at all. I'm not the one here advocating for the voice of those 5 nations to be silenced by Trump's pen. That's what happened here.

Also, I said it didn't matter who the websites author was. To understand why the 5 nations that formed the commission want the commission restored, and why they're not pushing for treaty negotiations, it helps to understand the history, and the culture of those 5 nations. The establishment of the commission was the first time those 5 nations had any say at all in what happens to the land after the US seized it under the treaty of Hidalgo and pushed the tribes out through military force in the 1860s. There was never an option to not have it under federal control. The culture of endurance practiced by many southwestern tribes means that negotiation and dialogue to make progress are preferred over fights that lead nowhere.

Also, article VI is being shredded by the Trump administration. The thought that the same administration that ignored their own promise to the commission before any changes were made to the land is somehow going to magically decide they're going to open treaty negotiations over the same land is absurd.

I am not advocating for federal land control. I'm advocating for voices of the 5 nations that comprised the commission to be heard and recognized as they were promised by the same administration 6 weeks ago.

Yes, Alex, you are selling them out. If it was my tribe, I would be organizing a way to exile any leaders willing to trade liberty and sovereignty for security from big government — because I am a libertarian.

...And ftr, I am allowed to use my floor time to tell you all that you are being horrible human beings, and that your toxicity and bias is bleeding this organization dry, and that the losses are YOUR faults.

That is my right. Its appropriate and on point for today's business. A vote doesn't make evil into good. Voting doesn't turn abuse into acceptable behavior. Voting didn't remove my rights. This is exactly why I call you folks literally Nazis. Because its what you truly are at the core, proven through your abusive treatment of dissenters like me, and your compromises with state Power.

It is telling that you thin-skinned tyrannical redcoats threw me out for doing my job, which is, in fact, to tell you all what horrible people you are and that the damage done to the LP is your fault.

I'm glad you all reacted like the petulant children exactly as I described in my comments. Yes, this is precisely why we lost money, donor confidence, and willing delegates at convention — and its 100% your fault.

You folks are the problem, not the solution.
Get out of our way.

In your speaking time, you mentioned infighting as a problem that keeps members and donors away.

You then subsequently disparaged the board, spoke over the Chair, and told someone to fuck off, before being removed.

Also, several hours ago you sent an email calling several colleagues subhuman terrorists who should be in Guantanamo Bay.

I do not know what you hope to accomplish with your constant soap box antics to the public list, but if you continue, I will be introducing a motion to limit the list to actual business.

My job is sometimes to inform you when you are behaving closer to actual Nazis than libertarians. I was specifically elected for this purpose. It is the basis for my other remarks about your disreputable behavior, which I delivered in my official capacity as a region representative discharging my duties of office while I had the floor.

Steven, respectfully, shut TF up. Nobody likes or cares about what you have to say if they actually know anything about you. There is good reason for that, and for why you needed an install to this board even with a rigged convention. Your opinion carries no weight.

Mr. Chair, it isn't "hard to fundraise" because I rightly called you folks "nazis" — rather, it is hard to fundraise because you folks literally behave like actual, real-life, honest-to-God nazis, which turns off ALL LEGIT LIBERTARIANS.

Facts. Don't be literal nazis, and you won't get called out for your bad behavior.

I hope I am not missing any nuances regarding this proposal. If so, I trust someone will point this out.

Federal land agencies have a well-documented history of bureaucratic inefficiency and poor stewardship outcomes. Preferring tribal management and resisting further federal expansion Is a practical, principle-based stance.

Is there any chance we can find a way to address the intent of this resolution without increasing federal involvement?

Yes, Ms. Engelhardt. There was no resolution.

The language of Mr. Flores’ and my statement included a recommendation to follow updates from SUWA for demonstrations and any legal action we might want to research, since SUWA is the group organizing demonstrations against the federal land-grab.

I appreciate the request for clarification.

That is correct, Amanda.

You didn't even bother with a vote before officially changing our public policy stances and our internal identity.

You just took ultra-vires action to kill liberty and replace it with socialism.

You didn't even bother talking to the board about it.

That isn't Barbara's fault for not understanding how you skipped the whole resolution part of a public policy resolution and went straight to recruiting LP members to mo ilize for Podesta-connected, DNC-aligned Orgs that want to grow the Fed and give them more land.

It was a reasonable presumption that such a radical policy shift should get a vote.

Subject: Re: How to Hustle Native Tribes out of their Land Rights and into Federal Slavery

Mr. Chair,

Mr. Martin is once again using the public list as his personal soapbox, attacking colleagues, relitigating every personal grievance, and treating an official LNC communications channel like his private blog for undermining the very organization he was elected to serve.

This is not normal board conduct. It is not productive dissent. It is organized dysfunction dressed up as moral courage.

The constant accusations, public denunciations, personal attacks, insinuations of treason, and attempts to provoke endless internal conflict read like they were taken directly from the CIA black book on how to destroy an organization from within: exhaust its leadership, poison trust, turn every disagreement into a loyalty test, and ensure that no productive work can occur without first passing through a gauntlet of manufactured outrage.

To be clear, I am not accusing Mr. Martin of being a federal agent.

I am merely observing that when someone repeatedly behaves exactly as a hostile infiltrator would behave, advances the same destructive outcomes a hostile infiltrator would seek, and attacks anyone who attempts to restore order as a tyrant trying to silence him, reasonable people are entitled to ask reasonable questions.

When it looks like a duck, quacks like a duck, and spends every waking hour sabotaging the duck pond, perhaps we should stop pretending that asking whether it is a duck is somehow beyond the pale.

Who benefits from this?

Does the Libertarian Party benefit when donors watch its board members call one another Nazis, terrorists, communists, psychopaths, traitors, and subhuman criminals on a public list?

Do our candidates benefit?

Do our state affiliates benefit?

Do our members benefit?

Or do the only beneficiaries happen to be the political institutions, intelligence agencies, major parties, and hostile actors who would love nothing more than to see the Libertarian Party consumed by internal paranoia, personal vendettas, and endless public humiliation?

Again, I hope Mr. Martin is not knowingly doing the CIA’s dirty work for them.

But intent is not magic. A man can serve an enemy’s interests without ever receiving a paycheck from that enemy. He can become a useful instrument simply by allowing his ego, rage, and obsession with internal enemies to override every obligation he has to the organization.

The result is the same.

And frankly, the reflexive claim that any attempt to impose standards of conduct amounts to “silencing dissent” is itself part of the pattern. Accountability is not censorship. Decorum is not tyranny. An official list is not a constitutional entitlement to abuse colleagues without consequence.

If Mr. Martin believes his conduct is helping the Party, he should be prepared to explain exactly how.

Who has joined because of it?

Who has donated because of it?

What candidate has been elected because of it?

What organizational objective has been advanced by it?

If the only measurable products are resentment, distraction, reputational damage, and donor disgust, then perhaps we should judge the behavior by its results rather than by the heroic mythology Mr. Martin has constructed around himself.

I am just asking questions.

For the sake of transparency, accountability, and the survival of this organization, those questions deserve answers.

My statement stands.

Sincerely,

Steven Nekhaila
At-Large, LNC

The problem I have raised here is that you folks are betraying the native peoples whose causes you have been shamelessly grifting.

We said we support native sovereignty — but then the Antifa alliance decides that means supporting federal power and land grabs while brazenly using the Native Americans as a tool to consolidate more government power.

Censorship is a nap violation, Dänkē. Discussion is not. Even though steven's remarks are offensive, evil, and targeted to silence the opinions of my state, I don't ask the chair to abuse him for me. You cannot censor opinions you do not like by being a fraud, falsely claiming opinions violate decorum; that is simply an act of fraud and bullying.

I ask you to stop, and to control your anti-libertarian impulses while on this board.

Subject: Re: How to Hustle Native Tribes out of their Land Rights and into Federal Slavery

Mr. Chair,

Mr. Martin has responded by immediately demonstrating the exact pattern I described.

He did not explain how his conduct benefits the Libertarian Party.

He did not identify a single member recruited, donor gained, candidate elected, affiliate strengthened, or organizational objective advanced by publicly calling his colleagues Nazis, terrorists, communists, psychopaths, traitors, and subhuman criminals.

Instead, he manufactured another accusation and insinuated that I am an unregistered foreign agent.

Facts, Austin.

If you possess evidence that I am acting on behalf of a foreign principal, produce it.

Name the foreign principal.

Identify the alleged relationship.

Show the direction, control, coordination, compensation, or communication.

Do not hide behind a smirking one-line insinuation after spending two days accusing everyone around you of treason, foreign influence, federal collaboration, socialism, Nazism, and conspiracy.

Put up or shut TF up, pal.

This is precisely the dysfunction I described. When confronted with his own conduct, Mr. Martin does not answer the merits. He simply invents another enemy, launches another smear, and uses the public list to perform another episode of his personal counterintelligence fantasy.

Everyone who disagrees with him is a socialist.

Everyone who enforces decorum is a tyrant.

Everyone who questions him is a Nazi.

Everyone who works with an outside organization is compromised.

And now, apparently, everyone who identifies the pattern must be a foreign agent.

Mr. Martin claims that his official duty is to tell the rest of the board what horrible human beings we are. He claims his right to insult colleagues is unlimited, that removing him for disorder proves we are Nazis, and that every consequence imposed upon him validates the accusation that produced the consequence.

It is a perfect self-sealing loop.

Attack the organization.

Provoke a response.

Call the response tyranny.

Use the alleged tyranny to justify another attack.

Then declare yourself the persecuted hero.

No, Austin.

You are not being persecuted.

You are being asked to behave like an adult serving on a national board.

Accountability is not censorship.

Decorum is not federal slavery.

Being called to order is not Nazism.

And an official LNC email list is not your personal constitutional entitlement to accuse colleagues of federal crimes whenever you need attention.

If you have evidence supporting your FARA insinuation, present it to this body.

If you do not, retract it.

Otherwise, the record will reflect that when asked to justify the organizational value of your behavior, you could not answer and instead produced another reckless accusation that proved the point better than I ever could.

Good news: it is never too late to abandon the performance, address the merits, and do better.

My statement stands.

Sincerely,

Steven Nekhaila

The merits of this discussion are about the resolution we passed upholding native sovereignty, and my point that the Alliance members on this board did a full 180º flip, mobilizing the LP for a Democrat Org who demands the federal government take possession and control of millions of acres.

Stay on point, please.

Mr. Chair,

Mr. Martin is once again publicly claiming, as fact, that other LNC members are guilty of something that is a capital offense (secretly working for hostile foreign governments) on the official party email list, while acting as a representative of the party. Please call him to order.

P.S. A private organization practicing freedom of association is not a NAP violation, and one cannot go from legitimately advocating for the state to disappear their colleagues and have them renditioned in an offshore torture camp over imaginary crimes, to claiming they “aren’t calling for” the people they’re attacking to be silenced. That’s not how things work.

Dear Fellow LNC Members,

How can we best support native sovereignty in the most consummately libertarian manner? Could we simply advocate for an end to the federal trust system altogether and champion full individual property rights in a manner that supports genuine voluntary self-determination for tribes as private/collective owners free of federal paternalism?

Perhaps that was exactly Mr. Flores’ original intent and I have simply lost the narrative along the way.

Subject: Re: How to Hustle Native Tribes out of their Land Rights and into Federal Slavery

Austin,

That is a remarkable deflection.

You were asked to explain how your conduct benefits the Libertarian Party.

You did not answer.

Instead, you insinuated that I am an unregistered foreign agent.

When asked to substantiate the allegation you introduced, you did not answer that either. You abruptly declared that the discussion was about something else and told everyone to “stay on point.”

No, pal.

You do not get to change the subject, make an accusation of federal criminal conduct, and then change the subject again the moment someone asks for evidence.

You introduced FARA into this thread.

Either it was relevant, in which case you should substantiate it, or it was an irrelevant personal smear, in which case you should retract it.

Name the foreign principal.

Identify the alleged relationship.

Produce evidence of direction, control, coordination, compensation, or representation.

If you cannot do that, then your FARA comment had nothing to do with the merits of this discussion, rather it was a diversion intended to avoid answering the questions put to you.

This is precisely the pattern under discussion:

You are confronted about your conduct.

You refuse to answer.

You manufacture a new accusation.

You are asked to support it.

You refuse again.

Then you accuse everyone else of being off topic.

That is serial deflection poised as righteous indignation.

The original questions remain unanswered:

How has your conduct benefited the Party?

What member joined because of it?

What donor contributed because of it?

What candidate was elected because of it?

What affiliate was strengthened because of it?

What organizational objective was advanced by calling your colleagues Nazis, terrorists, communists, psychopaths, traitors, and foreign agents?

You have now had two opportunities to answer.

You used the first to make another accusation and the second to run away from it.

Facts, Austin.

Stay on point, please.

My statement stands.

Sincerely,

Steven Nekhaila
At-Large, LNC
