I think it is important to review the existing policies, procedures, and available recourse when making such an addition. If anyone can point out mistakes in what I have retrieved (such as, I had to avoid clauses that were specific to Judicial proceedings)
That would be great.
Bylaws Article 7.15 [1]
The National Committee and all of its committees shall conduct all votes and actions in open
session; executive session may only be used for discussion of personnel matters, contractual
negotiations, pending or potential litigation, or political strategy requiring confidentiality.
Policy Manual Article 1 Section 1.02 - Subsection 4 [2]
Any member who is unwilling to commit to maintaining confidentiality regarding any
particular Executive Session is obligated to excuse themselves from the entire Executive
Session and to request that the Secretary note their absence from the Executive Session in the
minutes of the meeting. A participant in an Executive Session may publicly disclose
information discussed in Executive Session, if the same information is publicly available from
other sources, not as the result of a participant’s misconduct, and the participant does not
reveal that it was discussed in Executive Session; or the LNC, and all the participants in the
Executive Session, first consent to its release.
Policy Manual Article 1 Section 1.07 - Subsection 4 list Item 2 [2]
Harassment, such as unwanted physical contact or prying into a person's private life,
derogatory slurs, off-color jokes and innuendos, unwelcome comments about a
person's body or appearance, leering, suggestive/derogatory behavior or objects, and
the like, is prohibited. LNC members and staff members must exercise their own good
judgment to avoid any conduct that may be perceived by others as harassment.
Policy Manual Article 1 Section 1.07 [2]
Any violation of this policy should be brought to the attention of the Chair or the Vice-Chair.
In response to every complaint, the LNC will take prompt and necessary steps to investigate
the matter and will protect the individual’s confidentiality, as much as possible, recognizing
the need to thoroughly investigate all complaints. The LNC will take corrective and
preventative actions where necessary. The LNC will not retaliate against any individual who
in good faith brings a complaint to the attention of the LNC or participates in an investigation
regarding a complaint. Any employee who violates this policy is subject to discipline, up to,
and including discharge. Violations of this policy, while discharging official duties, may result
in disciplinary action against an LNC member.
Roberts Rules Excerpt [3]
'Chair: Mr. J! The chair has repeatedly directed you to refrain from offensive personal
references when speaking in this meeting. Three times the chair ordered you to be seated, and
you have nevertheless attempted to continue speaking.'
Step 3 Serious Disciplinary Action
If the matter is not deemed sufficiently resolved, any member can move to order a penalty, or the
chair can first ask, “What penalty shall be imposed on the member?”
Penalties:
-
Apologize
-
Censured by motion – formal disapproval statement (debatable, majority vote)
-
Removed from hall for remainder of meeting or until apologizes
-
Fined (if authorized in the bylaws)
-
Member rights suspended for a time
-
Expulsion from the organization (requires a two-thirds vote)
During Consideration of Penalty
During consideration of a penalty, the offender must be allowed to briefly present his defense,
before his departure during the consideration which may be ordered by the assembly. Such
motion, which may be assumed by the chair if he thinks it appropriate, is undebatable, is
unamendable, and requires a majority vote.
If the member denies having said anything improper, the words recorded by the secretary can be
read to him and, if necessary, the assembly can decide by vote whether he was heard to say them.
On the demand of a single member—other than the named offender, who is not considered to be
a voting member while his case is pending—the vote on imposing a penalty must be taken by
ballot, unless the penalty proposed is only that the offender be required to leave the hall for all or
part of the remainder of the meeting.
