Proposed Resolution for the Libertarian National Committee


Resolution Condemning Fourth Amendment Violations by Immigration and Customs Enforcement (ICE) and Other Law Enforcement Agencies

 

In the Libertarian National Committee, January 16, 2026  


WHEREAS, the Fourth Amendment to the United States Constitution guarantees the right of the people to be secure in their persons, houses, papers, and effects against unreasonable searches and seizures, and establishes that no warrants shall issue but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched and the persons or things to be seized; and  


WHEREAS, this protection is a cornerstone of individual liberty and a fundamental limit on government power, applicable to all law enforcement activities without exception; and  


WHEREAS, recent reports indicate repeated instances of excessive force and constitutional overreach by Immigration and Customs Enforcement (ICE) and other federal, state, and local law enforcement agencies, including warrantless searches, seizures without due process, and detentions based on suspicion rather than probable cause; and  


WHEREAS, such practices—whether in immigration enforcement, routine policing, or other operations—erode public trust, infringe upon natural rights, and contradict the principles of limited government that the Libertarian Party upholds; and  


WHEREAS, no government agency, regardless of its mission, is above the Constitution or the Bill of Rights;  


THEREFORE BE IT RESOLVED, that the Libertarian National Committee condemns all violations of the Fourth Amendment by ICE and other law enforcement agencies; and  


BE IT FURTHER RESOLVED, that the Libertarian National Committee urges ICE leadership, local police chiefs, and all law enforcement officials to immediately recommit to strict compliance with Fourth Amendment protections in the discharge of their duties, including:  


  1. Requiring judicial warrants for searches and seizures except in genuine exigent circumstances;   


  1. Ending the use of civil or administrative pretexts to justify warrantless intrusions;  


  1. Ensuring rigorous training on constitutional limits and accountability for officers who violate them; and  


BE IT FINALLY RESOLVED, that the Libertarian National Committee calls upon all Americans to defend these essential rights and hold government officials accountable when they fail to uphold the Constitution.

While I certainly have no objection to a quick read of the subject matter? I cannot support yet another resolution that is not backed by substantive action. A press conference?  A (gasp) protest? 

Based on history, people of good will will spend hours debating dangling participle. Only to have the finished product join all the others in the dustbin of Libertarian history.

Folks I attend several protests ... a month, both in my capacity of LPRI Chair, activist and political reporter. We can do better.

If this resolution passes, I would be happy to forward it along to Brian McWilliams and Drew Hreha for media consumption, which could lead to earned media (as this is a question that comes up often with the press) and our internal list/socials.

I believe the message of opposing 4th amendment violations and the minority report style pre-crime/Palantir surveillance system would resonate well with our audience despite diverse views on immigration reform.

If there is a plan of action of some kind around this resolution, then fine, but if there isn’t then it’s a waste of time. If somebody has a particular messaging angle or strategy, then they should present it to the chair to then pass it along to Brian. An additional committee is not going to do anything nor is it necessary. If a group of people have an idea then they can put it together themselves and give it to an LNC  representative to pass it on.

I respectfully raise the point of parliamentary inquiry of whether it is necessary for members to reaffirm their desire to cosponsor a resolution proposed by an alternate via a request for sponsors. 

The resolution has since found a seated introducer; and additionally, the word "Co-Sponsor" has introductory implications. Sufficient numbers of cosponsors would likely render the "relay" issue moot, anyway. The question is: should the secretary deem the previously offered co-sponsorships effective, or is reaffirmation required?

Let me address your concerns: 

  1. AI detection is flawed. If a piece of writing lacks obvious mistakes, it often flags as 100% AI. This is not a very reliable tool. A polished resolution SHOULD appear at least "partly AI generated", even if handwritten, or else we have likely failed to capture a formal and precise style.

This is even true with quotes from case law and other examples of formal voicing, as can be seen below. The Sandoval case is from 1970.

I personally wrote the first statement, and the second is a quote from 1970. This tool is basically useless in professional environments, except perhaps to catch grade-schoolers cheating on their assignments.
  1.  The use of AI tools to help write formal text for organizations is one of the appropriate and proper uses of LLM's. It is not a form a plagiarism or cheating any more than it is wrong for a physicist to use a calculator to assist him crunching formulae. I fail to see any problem here, except, perhaps, for a very bad attitude toward toxic internal politics. 
I am having a hard time understanding the nature of the issue you are bringing up here, other than that it seems like an attack against this resolution — not because of what it says or how it's written, but because of who introduced it. 

If it's good, then it's good. 

If not, then not.

Aloha! 

Speaking to a concern raised earlier by Mr. Ford and indirectly by Mr. Watkins, I want to encourage everyone that resolutions from the LNC can absolutely be very powerful and influential. 

A lot depends on delivery. If the resolution we pass can be read into public testimony in a related legislative hearing, for instance, it can have a profound impact on public policy and the broader public discussion. 

As an example of impact, Pierre Omidyar's newspaper, the Civil Beat, one of the most significant political publications in Hawaii, keeps a page dedicated to some of my activities in the State Legislature:
These legislative discussions and public testimonies are used by journalists, policy experts, courts, and downstream culture — and they help to shape the public discussion on the threshold of decision-making. Participation wins us incredible public exposure, effective activists on key issues, and real political leverage to use in elections and issue activism. 

Importantly, the legislative session ties directly into the election season — the two are directly related, each one feeding and shaping the other. Legislative session outcomes and the voting records of incumbents are often decisive issues in local, state, and federal races — this is our point of empowerment for our candidates and activists, setting the issues, narrative, and groundwork for election season. When we bring a statement which our party formally adopted and it's relevant to a bill and it will have an impact. Our resolution can be submitted as written testimony, or read verbatim, or submitted and referenced in a speech delivered by a candidate or LP representative. Each resolution is an excellent opportunity for our candidates to carry our party resolutions and philosophy directly into the legislature and attempt to directly impact the issues for which they advocate. 

While it is difficult to get floor time in the US Capital without elected representatives to invite us, this is not so in state legislatures, where we can add our weight to state party fights against bad policy. Every time we pass a useful resolution, we offer this opportunity to the whole LP. 

No special votes would be needed to do this, but I suggest in the future we consider adopting some kind of custom or protocol that ensures resolution delivery moves the needle.
