Dear Mr. Ajit Naik,
I came to understand that you have shared and posting your in-consistant opinions about myself in social media.
You were aware that there were no associations, groups existed to guide RWAs, Buyers prior to myself become active in this area/domain in 2013. There were no Common Whatsapp group connecting various associations, RWAs and NGOs till I initiated the Whatsapp group, Google email group, etc.
Why was the necessity for me to create various Whatsapp, Google groups, Twitter, Facebook groups if my intentions are narrow and it is open book, that most of the activists in Bangalore are part of the social media, shows that what you have opined about me is wrong.
It is the fact which you cannot deny that most of the members you have in your social media groups, google groups are all added taking their contact details from the Whatsapp group, created by me “Fight for RERA” /FPCE.
I have lot of respect for your age, experience and the reason for taking advise / draft letter copies from you is that I did not wish to dominate with my own way of thinking and approach but I wish to have consensus and vary opinions. It does not mean that, I am not aware of the subject or in capable to submit representations. I never expected that you will stoop to this low, of my genuine intent of taking benefit of your guidelines for common benefit.
When I wanted to form association (under Kao Act 1972) for our apartment I approached most of the Bangalore activists through the contacts from Praja.in and Citizen Matters (Mr. Muralidhar Rao, Sanjay Vijayaraghavan, Mr. Nagesh Aras and Mr. Ajit Naik). Though you did not share any proper guidelines, but you advised me to buy a book on KAO ACT 1972, which I did and learned a lot on my own by repeated reading of the ACT and going through the various blogs of the subject in Praja.in and Citizen Matters. However, breakthrough for my association formation has happened only by Professor Rajagopal – President of South City Apartment Association, when he shared the contact of the Legal Expert, senior counsel Mr. Prathaban, through whom I accomplished the task of forming our Association under KAO ACT 1972.
Subsequent to accomplishment of my task of forming the Association, I decided to guide RWAs and have been sharing my experience and have been addressing and clarifying many association queries on KAO act 1972 and during this time, I came in contact with Lt-Gen Col. Sathish Bahri – Chairman and President of Federation of Apartment Owners Association, New Delhi and I have become an Associate Member of FAOA.
Lt-Gen. Col Sathish Bahri gave me an opportunity to interact with Select Committee for RERA during their visit to Bangalore, including taking a lead role and submission of names of the delegates for this meeting. I utilized this opportunity to interact with the activists of Bangalore and have had organized activists meeting twice or thrice to finalize our representation to the select committee of RERA.
With the intent to share the knowledge and guide the various RWAs and Buyers, I have organized with the help of fellow members and activists 3 seminars on KAOA which saw participation by over 100+ members/RWAs across Bangalore.
You too were aware that the earlier office bearers of BAF- Bangalore Apartment Federation approached us to take over their Registered name to continue with our objectives. But as we wanted establish our own identity, we consensually declined this proposal and due to various factors, we could not able to get succeed in Registering our own Association/Federation/Trust. (I am fortunate to get the opportunity to join the National Stream as One of the Founder Directors of Forum for People’s Collective Efforts – FPCE, a section-8 company Registered as Not for Profit Company)
Again, through the reference of Lt-Gen Col Sathish Bahri, FAOA, New Delhi, I came in contact with Shri Abhay Upadhyay who took the Fight for RERA to all important cities and States by visiting personally and meeting activists and groups. I got inspiration from Mr. Abhay and whole heartedly joined his movement by spending my own money and time to visit New Delhi to fight for RERA enactment. My association with Mr. Abhay and his movement Fight for RERA gave me opportunity to meet various likeminded activists across the country.
I have taken intrest to convene Fight for RERA – Karnataka Chapter and started submitting representations and attending the meetings with Karnataka Government and officials for implementation of RERA in Karnataka. You too were part of the meeting representing Fight for RERA – Karnataka Chapter, convened by GOK Urban Development Department on 10th November 2016. (Shri Roshan Baig – Hon’ble UDD Minister and Shri. George – Hon’ble Minister for Bangalore Development) You are the witness that we were (Fight for RERA- Karnataka Chapter) the lone Homebuyer representatives invited by GOK {myself, yourself, Abhay Upadhyay who came exclusively for this purpose to support us and Col. Rajkumar (Advocate)}
I have always tried to take along various groups, members, activists along in all my initiatives and never and ever I attended any single meeting with any Government offices, Officials, Ministers, etc. independently and but preferred to take along few members and in most of my meetings you were part as a delegate. (whereas you used to meet officials and visit Government offices alone on many instances – This shows that you do not believe in group/team working and you preferred to dominate with your own thought process. Your dominated approach has not fetched you any success in your attempts for past 10 years with your in-consistant interpretations and confusing lengthy representations to GOK on KAOA and KOFA).
When there are many differences of opinions arises within the same family members, it is quite nature to have conflicts of interests and opinions when various members join to-gather to work for a common cause. I have never interrupted in any other Forum’s work nor opined but, when all of a sudden you started involving LMNKV in RERA related work in the Whatsapp group created by Fight for RERA movement, it is quite natural I got unhappy with your attitude.(LMNKV never directly involved in this domain of RERA earlier on even now)
The reason for my staying back from the PIL group is your unwanted comments and posting about FPCE and its leadership.
We FPCE will continue our efforts as per the genuine suggestions and feedback with its due respect from each and every one.
With warm regards,
M.S. SHANKAR.
