For information of Group Members, so that someone takes the lead on filing the writ petitions in the Karnataka High Court to get real relief to nearly 12000-15000 Apartment Owners Associations illegally registered under Section 3 of KSRA, 1960 by the Authorities (some time by subordinates of IGRS and some other time by the ROCS). This Group should alls discuss on the burning issues of thousands of Apartment Association in Karnataka.

I request someone to forward me the Kannada Version and English version of the circular dated 30-11-2018 issued by the ROCS. I am unable to trace it in my records. Mr. Anil Kalgi can help me.

With respect to your Message on AGMs to be conducted by the existing Apartment Associations registered before 01-12-2018 under KSRA, I attach following documents available with me. 

The judgment of the Hon'ble Chief Justice of Karnataka dated 06-11-2019 and circular dated 01-01-2020 by the ROCS, it is a clear indication that existing Societies of Apartment Owners Association  under KSRA are not under the purview of ROCS. However, a proper circular by GOK Legal Department and ROCS is necessary on the fate of existing Societies. 

Neither GOK Legal Department nor ROCS have not issued any guidelines on the subject in the last 19 months. Hence, it is necessary that some NGOs or Individuals Activists or existing Associations or some Advocates who wish to help the thousands of Associations in doldrums shall file a writ petition in the High Court of Karnataka.

Dear Nirmal Raj,
Anyhow the occupants of apartments in your apartment building are managing the maintenance activities so far in the last 14 years, without forming an Association. Time being Continue with that procedure. As on today, there are no guidelines for GOK on forming and registration of legally correct Association. A group of activists are seriously following up with GOK on the matter. A suitable result should come in the near future of 6 months. Until that time, don't spend money on registration of Association. Many unprofessional consultants will misguide you on the subject.
