Sub: Medical Pass - Provision for two attendants.

The CLW Staff Council, in their meeting held in June, 2003, has demanded that two attendants should be provided to a physically handicapped or unconscious or paralyzed or mentally retarded patient on the same lines as provided under Schedule VII item 2B(III) of Railway Servants Pass Rules 1986 (2nd Edition 1993) to patients in big plaster, where one attendant cannot lift the patient.

2. The matter has been carefully considered by Board, and it has been decided by Board that when no family member is accompanying a physically handicapped or unconscious or paralyzed or mentally retarded patient, two attendants in the same class may be provided on the express recommendations of the medical officers.

3. In view of the above position, Railway Servants (Pass) Rules,1986 (2nd Edition 1993) may be amended as per Advance Correction Slip no.43 enclosed.

4. In all other respects provision of Railway Servant (Pass) Rules, 1986 (2nd Edition 1993) shall apply.

5. This issues with the concurrence of Finance Directorate of Ministry of Railways.

Item 2(B)(III), under Schedule VII (Special Passes) may be replaced as under:

Sub: Implementation of improved pay scales to Accounts staff –

revision of option

Consequent to implementation of Ministry of Railways’ letter of even number dated 7.3.03 and letter No.PC-V/97/1/11/14 dated 25.6.03 granting improved pay scales to Railway Accounts staff and Stock Verifiers respectively, references have been received from Zonal Railways for grant of option to Railway servants on implementation of the improved pay scales to Accounts staff and stock verifiers.

The matter has been examined in the light of Railway Board’s letter No.PC-V/98/I/6/3 dated 29.5.98 and it has been decided that Railway Accounts staff and Stock Verifiers can exercise a fresh option to get their pay fixed in the improved pay scale from the date of their increment, falling after 1.1.96.

Option shall be exercised within a period of three months from the date of issue of these orders. Option once exercised shall be final.

Sub: Model Roster for recruitment on local/regional basis.

Attention is invited to Board’s letter referred to above vide which separate percentages of reservation for SCs/STs/OBCs were fixed for each Zonal Railway/Production unit etc. Subsequently, vide Board’s letter No.95-E(SCT)I/49/5(1) dated 21.8.97, all the Zonal Railways/Production Units were advised to prepare their own post based rosters for direct recruitment to Group ‘C’ and Group ‘D’ posts normally attracting candidates from a locality/region. In the recent past some of the Railways have pointed out that they are facing difficulties in filling up the posts reserved for STs in Group ‘D’ and Group ‘C’ upto Grade Rs.4500-7000 in promotion category since the percentage of reservation in direct recruitment for STs is less than the percentage of reservation in promotion i.e. 7.5.%.

The matter has been examined in consultation with DOP&T who have clarified that as per existing instructions the percentages of reservation for SCs, STs and OBCs in case of direct recruitment made on all-India basis by open competition is 15%, 7.5% and 27% respectively.

Board, after careful consideration and in supersession of their letter dated 27.5.94 referred to above have decided that henceforth percentages of reservation for SCs, STs and OBCs for each Railway/Production unit in direct recruitment of all the Group ‘D’ and Group ‘C’ posts will be 15%, 7.5% and 27% respectively. As such, post based rosters issued vide Board’s letter No.95-E(SCT)I/49/5(1) dated 21.8.97 will uniformly be applicable in all the cases of direct recruitment in Group ‘D’ and Group ‘C’ posts filled by open competition. This will have prospective effect.

Sub: Promotion of Railway servants against whom disciplinary/court proceedings are pending - applicability of extant instructions to review DPC/supplementary selection regarding.

Attention is invited to Board’s letters No.E(D&A)92/RG 6-149(A) and No.E(D&A)92/RG 6-149(B) both dated 21.1.1993 wherein the procedure and guidelines to be followed respectively in case of promotion of gazetted and non-gazetted railway servants against whom disciplinary/court proceedings are pending, were laid down.

The applicability of the procedure in the above instructions to the cases where a review DPC etc. are held, has been considered by the Board in light of the guidelines issued by the Department of Personnel & Training and it has been decided that the procedure brought out in Board’s letters of 21.1.1993 referred to above will not be followed by the review DPC in the case of gazetted railway servants or supplementary selection in the case of non-gazetted railway servants if no disciplinary proceeding or criminal prosecution was pending against the railway servant or he/she was not under suspension at the time of meeting of the original DPC/Selection or before promotion of his junior on the basis of the recommendation of the original DPC/selection.

Sub: Appointment of Persons with Disabilities against unreserved vacancies.

Department of Personnel & Training, Ministry of Personnel, Public Grievances & Pension had received some references seeking clarification whether persons with disabilities can be considered for appointment against a vacancy which is not reserved for them. It has been clarified by DOP&T that:

“Vacancies reserved for any category need to be filled by persons belonging to that category and such vacancies are not open to others. On the other hand unreserved vacancies are open to all and reserved category candidates cannot be denied the right to compete for appointment against such vacancies, provided they are otherwise eligible. In other words, while vacancies reserved for any specific category are meant for persons of that category only, unreserved vacancies are open to all, including the reserved category candidates. It means that a person with disability can be appointed against an unreserved vacancy, provided the post is identified suitable for the persons with disabilities of the relevant category”.

Sub: Selection of intermediate Apprentices from amongst Skilled Artisans for absorption as JE Gr.II in the pay scale of Rs.5000-8000 in various Departments.

Reference your D.O .letter No.PB/S3/EL/2/12/114/Vol.IV dt.28.5.03 addressed to Shri S.Dhasarathy, Member (Mech), Railway Board, on the above subject.

2. Your suggestions to specify the ITI/Act Apprenticeship trades which will make the employees eligible for appearing in the selection for induction as Intermediate Apprentices and prescribe the qualification of Diploma in the relevant branch of engineering in addition to ITI/Act Apprenticeship or 10+2 (science stream) as eligibility condition for appearing in the said selection, have been considered by the Board carefully. While the suggestion to prescribe the qualification of Diploma in the relevant branch of engineering has not been accepted, a separate communication regarding the suggestion for specifying the trades will follow.

3. As regards the eligibility of employees having the qualification of Diploma or Degree in the relevant branch of engineering for appearing in the selection for induction as Intermediate Apprentices, it appears that your appreciation that with the qualification of ITI/Act Apprenticeship being prescribed, they stand debarred from appearing in the said selection, is based on the instructions contained in this Ministry’s letter No.E(NG)II/2001/RR-1/6 dt. 20.8.2001 in which it was inter alia clarified to one of the RRBs that Degrees and Diplomas are not acceptable in lieu of ITI unless specifically stated as acceptable. It is clarified that this condition will not apply to selections held for induction as Intermediate Apprentices for absorption as JE Grade II in different Departments. Accordingly, if the employees otherwise eligible have the qualifications of Degree or Diploma in the relevant branch of engineering, they will be eligible to appear in the selection for induction as Intermediate Apprentices along with those with qualification of ITI/Act Apprenticeship or 10+2 (science stream).

Sub: Validity period of OBC certificate and verification of community and

‘non-creamy layer’ status of OBC candidates.

Please find enclosed a copy of DOP&T’s O.M.36033/4/97-Estt.(Res) dated 25.7.2003 on the subject quoted above for information and strict compliance.

Sub: Validity period of OBC certificate and verification of community

and ‘non-creamy layer’ status of OBC candidates.

The undersigned is directed to say that a question has arisen about the validity period of certificates issued to the candidates belonging to other backward classes for the purpose of reservation in services. The OBC certificate consists of two parts - first part indicates that the concerned person belongs to a community listed as OBC and the second part indicates that the candidate does not fall in the creamy layer. While the OBC status of a candidate may change only when the community of the concerned candidate is removed from the OBC list, his/her creamy layer status may change any time. In view of it is not possible to determine fixed validity period for the OBC certificate.

2. Every candidate seeking reservation as OBC is required to submit a certificate regarding his/her ‘OBC status and non-creamy layer status’ issued by an authority mentioned in DOPT Office Memorandum No.36012/22/93-Estt.(SCT) dated 15.11.1993. The OBC status and/or ‘non-creamy layer status’ of the candidate, as pointed out in para above, may change after issue of the certificate making him/her ineligible for reservation. In order to ensure that candidates not eligible to get reservation do not seek reservation, a declaration, in addition to certificate issued by the competent authority, may be obtained from the candidates seeking reservation as OBCs in the following format:

“I,___________________ son/daughter of Shri_________________ resident of village/town/city_______________________ district__________________________state

___________________ hereby declare that I belong to the ________________ community

which is recognized as a backward class by the Government of India for the purpose of reservation in services as per orders contained in Department of Personnel and Training Office Memorandum No.36012/22/93-Estt(SCT) dated 8.9.1993. It is also declared that I do not belong to persons/section (Creamy Layer) mentioned in column 3 of the Schedule to the above referred Office Memorandum dated 8.9.1993”.

3. The appointing authority, before appointing a person seeking appointment on the basis of reservation to OBCs should verify the veracity of the community certificate submitted by the candidate and also the fact that he/she does not fall in creamy layer on the crucial date. The crucial date for this purpose may be treated as the closing date for receipt of applications for the post except in cases where crucial date is fixed otherwise.

4. It was decided vide this Department’s Office Memorandum No.36033/9/95-Estt(SCT) dated 10.5.1995 that in case of appointments against vacancies reserved for OBCs a clause in the offer of appointment would be inserted to the effect that appointment will be provisional and subject to verification of the community certificate. Since reservation is available only to such OBC candidates who do not fall in the creamy layer, it is necessary that the clause inserted in the offer of appointment should be modified so as to take care of creamy layer status of the candidate also. It is therefore, decided that the following modified clause may be included in the offer of appointment in place of clause prescribed vide Office Memorandum dated 10.5.1995.

“The appointment is provisional and is subject to the community certificate being verified through the proper channels. If the verification reveals that the claim of the candidate to belong to Other Backward Classes or not to belong to creamy layer is false, his/her services will be terminated forthwith without assigning any further reasons and without prejudice to such further action as may be taken under the provisions of Indian Penal Code for production of false certificate”.

5. All Ministries/Departments are requested to bring the contents of this Office Memorandum to the notice of all authorities under them for information and compliance.

Sub: Scheme of Voluntary Retirement for Railway employees.

Attention is invited to the provisions contained in para 3(xii) of Board’s letter No.E(P&A)I-77/RT-46 dated 9.11.1977 and Para 2 of Board’s letter No.E(P&A)I-77/RT-46 dated 22.8.1985 according to which a Railway servant giving notice of voluntary retirement may also apply, before the expiry of the notice, for the leave standing to his credit which may be granted to him to run concurrently with the notice period except in the case of Extra-ordinary leave as such leave whether on medical ground or on private affairs cannot be termed as leave standing to the credit of a Railway servant.

2. The instructions contained in para 3(xii) of the Board’s letter No.E(P&A)I-77/RT-46 dated 9.11.1977 and 22.8.85 after review stands modified as under:-

A Railway servant giving notice of voluntary retirement may also apply, before the expiry of the notice, for the leave standing to his credit which may be granted to him to run concurrently with the period of notice. Extra ordinary leave is not termed, as leave standing to his credit and therefore, it cannot run concurrently with the period of notice given by him for seeking voluntary retirement. In case, a Railway servant applies for voluntary retirement while already on extra ordinary leave other than on medical ground, the notice period need not be insisted upon and his request may be accepted with immediate effect provided he is clear from vigilance angle. However, if a Railway servant while already on extra ordinary leave on medical ground, applies for voluntary retirement, the notice period, if any, given may be accepted and he may be allowed to retire after the expiry of the notice period subject to vigilance clearance.

Sub: Revision of pension – average emoluments of Government

servants who have opted to come over to revised pay scales

and retired within the period of 10 months from the date of

coming over to the revised scales of pay.

In terms of Para 3(A) of Board’s letter of even no.dated 29.10.99, the formula for calculating the emoluments for the period during which pay was drawn in the pre-revised scales in respect of Railway servants, who retired within 10 months from the date of coming over to the revised scales of pay, as contained in Para 9(I) of Board’s letter of even no. dated 5.11.97, has been substituted so as to include along with the existing basic pay the dearness allowance upto CPI 1510 i.e. @ 148%, 111% and 96% of the basic pay, as the case may be and notional increase of basic pay by applying the fitment benefit of 40% of the basic pay in the pre-revised pay scales in addition to the first and second instalments of interim relief appropriate to the basic pay. For the period during which pay is drawn in the revised scale, basic pay in the revised scale shall be taken into account. The average emoluments shall thus be worked out for the purpose of determining pension.

In terms of para 7(a)(ii)(b) of Board’s letter No.PC-V/97/I/RSRP/1 dt.8.10.1997, if the amount arrived at by adding together 405 of the basic pay and the “existing emoluments” is more than the maximum of the revised scale, the pay shall be fixed at the maximum of that scale. Since no such ceiling has been laid down in Board’s letter dt.29.10.99, one of the Railway administrations has sought confirmation as to whether the emoluments calculated in terms of para 3 (A) thereof, which exceed the maximum of the revised scale of pay, should be restricted to the said maximum pay.

The matter has been examined in consultation with the nodal departments on pensionary matters viz. The Department of Pension & Pensioners’ Welfare and the Department of Expenditure. It is confirmed that whenever the emoluments calculated in terms of para 3(A) of Board’s letter of even no. dated 29.10.99 exceed the maximum of the revised scale of pay, they should be restricted to the maximum of the revised scale of pay.

Sub: Collision of 1448 Up Express in the rear of 7330 Goods at Danea yard of Dhanbad Division of Eastern Railway on 16.3.2003.

The recommendation made by CRS, Eastern Circle vide para 9.10 in his final report on the above subject is reproduced below:-

Recommendation No.9.10.

“Passing marks required for qualifying the post training examination in subjects connected with safety be enhanced to at least 80% for safety category trainees (para 7.6.7)”

The above matter has been considered by Board and it has been decided

(a) that the written examination and practical examination for safety categories including the Running staff should be 60% i.e. staff must acquire 60% in written and 60% in practical and viva to qualify the exam and with no relaxation for SC/ST. For non-safety categories the pass marks be 50%. The repeat course available to trainees as advised vide Board’s letter No.E(MPP)2000/3/10 dated 10.8.2000 issued under RBE No.96/2000 will be maintained;

(b) in the written test objective portion to constitute at least 70% of the total marks;

(c) Training centres should nominate atleast 3 of the senior instructors/officers specialized in each trade who would also as part of their duty go to remote/far flung areas and organize one day/two day crash training at these locations. In case the need for taking a test arises, similar procedure be followed except that the venue shall be station complexes or suitable rest houses, etc.

5.5.4 Pass marks

5.5.4.1 The written examination and practical examination for safety categories including the Running staff should be 60% i.e. staff must acquire 60% in written and 60% in practical & viva to qualify the exam and with no relaxation for SC/ST. For non-safety categories the pass marks be 50%. The repeat course available to trainees as advised vided Board’s letter No.E(MPP)2000/3/10 dated 10.8.2000 issued under RBE No.96/2000 will be maintained.

5.5.4.2:In the written test, objective portion to constitute at least 70% of the total marks;

5.5.5 Responsibility of Training Centres.

5.5.5.1 Training centres should nominate atleast 3 of the senior instructors/officers specialized in each trade who would also as part of their duty go to remote/far flung areas and organize one day/two day crash training at these locations. In case the need for taking a test arises, similar procedure be followed except that the venue shall be station complexes or suitable rest houses, etc.

The matter related to classification of sub-standard Railway quarters at various stations on the Railways, and recovery of license fee for such quarters has been raised by the Staff side in the forum of Departmental Council (JCM)/Railways. The Staff side have demanded that quarters where essential basic amenities such as Kitchen/Store/Lavatory/Water supply have not been provided separately, should be classified as sub-standard quarters and rent applicable thereto, only should be realized in respect of such of the quarters.

The matter has been examined and it is reiterated that the quarters on the Railways conforming to the definition of sub-standard quarters, as contained in Board’s letter No.F(X)II/63-RN/1/7 dated 8.7.1963, are to be treated as sub-standard and the license fee at the rate(s) applicable to sub-standard quarters, should be recovered in respect of thereof.

Sub: Issue of higher class pass to the children studying in Oak Grove School.

In terms of item No.(i) under column 3 of Schedule III - School pass - of Railway Servants (Pass) Rules,1986 (2nd Edition 1993), first class pass can be issued to students studying in Oak Grove School, Jharipani. A doubt has arisen whether 1st class pass to the students who are entitled to second class pass can be issued on all the occasions or whether for their travel from the nearest station of their homes to Dehradun at school session and from Dehradun to their homes at the conclusion of the school session only. The case has been examined and it has been decided that 1st Class school pass may be issued to the students for their up and down journeys during the authorised vacations also.

2. In view of the above position Railway Servants (Pass)Rules,1986 (2nd Edition 1993) may be amended as per Advance Correction Slip No.42 enclosed.

3. In all other respects, the provisions of Railway Servants (Pass )Rules,1986 (2nd Edition 1993) shall apply.

The matter has been examined in consultation with M/o Finance and it has been decided that the rate of interest of HBA prevalent on the date of release of advance/first instalment of advance should be taken for the purpose of calculation of interest on the HBA sanctioned to the Government servant.

The question of grant of House Rent Allowance and Compensatory (City) Allowance at rates admissible in the classified city of Chandigarh (B-2 class) to the Railway employees posted at Panchkula on the basis of the contiguity of the classified city area of Chandigarh with limits of the Notified area of Panchkula, in terms of the principle of contiguity contained in Rule 1705(a)(i)-R.II/1987 Edition has been under consideration for some time past.

2. The president is now pleased to decide that the Railway employees, whose place of duty falls within the limits of the notified area of Panchkula shall be entitled to draw House Rent Allowance and Compensatory (City) Allowance at the rates admissible within the classified city of Chandigarh. The grant of House Rent Allowance and Compensatory (City) Allowance under these orders shall be regulated in accordance with the conditions laid down in the extant Rules/orders on the subject. These orders take effect from 16.6.2003.

However, recoveries for the past period in these cases should not be effected. It has also been decided, as a special case, that in case of retired teachers, revision of pension may not be made

On receipt of a communication regarding upgradation of their travel facilities in Rajdhani/Shatabadi Express Trains, Board have decided that duty card passes issued to Vice-Chairman and Members of RCT may be validated for travel in Rajdhani/Shatabadi Express trains as under:

a) One berth in 1st AC for self, and one extra berth for spouse on payment of one-third difference of fare between 1st AC and 2nd AC of Rajdhani Express; or

Arising out of recommendations of Railway Safety Review Committee in their Report vide S.No.59[c] Part-II of 1988, regarding supply of proper attire to Gangmen, it has been decided by Board that the Gangmen should be supplied good quality luminescent vests (Safety Jackets), one vest for 2 years, in addition to the existing uniforms. In this connection, proper market survey should be made by the Railway to get good quality supply at reasonable cost. Procurement may be arranged according to prescribed procedure. Board’s Office may be apprised in six months time regarding quantity procured indicating unit price, total value etc.

2. It has also been decided that maroon colour Jersey instead of the present Khaki colour may be supplied to the Gangmen. The charge of Jersey may, however, be effected after the present stock of Khaki colour Jersey is exhausted.

Sub: Supply of Uniform to Canteen staff.

Instructions issued by DOP&T vide their letter dated 21.1.02, consequent upon judgement by the Principal Bench of CAT (New Delhi), regarding supply of uniform have been adopted in toto in Railway sector vide this Ministry’s letter dt.31.7.02. DOP&T has now advised that a section of canteen employees had petitioned before the Principal Bench and demanded winter uniform comprising of woolen coat and pant as being provided to Group ‘D’ employees working in Central Government Offices. On the direction of the Hon’ble CAT, DOP&T has now prescribed woolen pant (White/Grey) for male/woolen salwar or appropriate woolens for female employees once in two years, in addition to the existing uniform.

2. After careful consideration, it has now been decided that henceforth, in addition to the existing pattern of summer/winter uniforms prescribed in Board’s letter of even number dt.31.7.02, a woolen pant (white/Grey) for male/woolen salwar or appropriate woolens for female employees, once in two years, should be supplied to the Canteen Staff. Other conditions stipulated in Board’s letter ibid shall remain the same.

3. Cost of various pattern of uniform being supplied to Canteen Staff/category-wise may be advised to Board’s Office early.

4. This issues with the concurrence of the Finance Directorate of Ministry of Railways.

In terms of extent procedure as laid down in the Ministry of Railways letters quoted in the margin as clarified/amplified from time to time for meeting the manpower requirement of construction and other projects including RE work-charged posts in regular scale are to be created as necessary against the General Charges Establishment and Labour provisions in the sanctioned estimates with the concurrence of associate Finance. The procedure inter alia provides that:-

(i) Work-charged posts in the construction and other projects should be reckoned as an extension of the cadre of posts in the Railway/Division in the jurisdiction of which such construction or other projects are headquartered and no recruitment through RRBs or otherwise and no promotions against these work-charged posts will be made by the officers in-charge of the construction or other projects themselves. Instead all vacancies must be reported to the concerned Railway/Division who will take necessary action to fill up such vacancies taking the same as vacancies in the Railway/Divisional Cadre.

(ii) Continuation, as necessary, of casual staff in Group ‘C’ scales in the construction who were regularized against Group ‘D’ posts on the Divisions, would be treated as continuation on promotion on adhoc against Group ‘C’ work-charged posts in the construction.

(iii) Lien of construction staff working/posted in the construction and other projects would continue to be in the open line in the relevant cadre of Headquarter/Division/extra-divisional unit wherein they would continue to be considered for selection/promotion in their turn.

Earlier the instructions (vide the Ministry of Railways’ letters quoted in the margin) provided that in the exigencies of the work staff posted in the construction and other projects including RE could be allowed promotion on adhoc basis to one grade higher than the grade held by them on regular basis in the open line. Such adhoc promotions are not to be taken into account for any other purpose in the cadre in the open line. However, the procedure provided that on reversion to the cadre in the open line, staff who had already qualified in the suitability/trade test for promotion on adhoc basis to non-selection posts while in construction/RE projects, should not be subjected to such tests again in the open line for their promotion on regular basis as and when due in their turn. The procedure provides for this concession being available only in comparable trades and only in respect of one grade higher than the grade held on regular basis.


The Hon’ble Supreme Court have had the occasion to consider some of the above issues in Writ Petition (Civil) No.548/2000, Inderpal Yadav & Ors Vs. UOI & Ors taken up with Writ Petitions (Civil) Nos.658,659 and SLP© Nos.4159-60/2001 and 14048/2001 vide their judgement dt.13.1.03 a copy of which is sent herewith for information and guidance. The Hon’ble Supreme Court have inter alia made the following observations.

(i)“……their provisional local promotion in the projects cannot be taken as having vested in them a right either to continue in the project or to resist reversion back to the cadre; or to enjoy a higher promotion merely on the basis of locally provisional promotion granted to them in the Project. No rules have been pointed out to us to justify this claim on the part of the petitioners. Besides, if this stand of the petitioner were to be accepted it would operate inequitably as far as the regular employees in the open line department are concerned.

(ii) …..while it is open to the Railway administration to utilize the services of the petitioners in the open line, they must, for the purpose of determining efficiency and fitment take into account the trade tests which may have been passed by the petitioners as well as the length of service rendered by the petitioners in the several projects subsequent to their regular appointment.

(iii)…. It is open to the respondent authorities to proceed in the matter of further promotion in accordance with the rules”.

The judgement of the Hon’ble Supreme Court inter alia with the above observation should be the guiding factor while dealing with matters relating to manning of posts in the construction and other projects including RE and reversion of staff back to the cadre. The litigation, if any, pending in various courts and that may arise in future should also be contested on the basis of this judgement.

O R D E R

The writ petitioners before us have been appointed as casual employees in different projects of the Northern Railway in the year 1979 to 1981. Because of uncertainty of their tenure, they filed writ petitions before this Court, during the pendency of which, a scheme was framed by the Railway authorities for granting the petitioners temporary status with a view to permanent absorption. This scheme was approved with certain modifications, which are not relevant for the purpose of this petition, by the decision of this Court reported in 1985 (2) SCC 863. The scheme was implemented and the petitioners were categorised as skilled, semi-skilled and un-skilled. The implementation of the scheme was upheld again by this Court when the petitioners filed a complaint in this regard before this court on 11th August, 1986. The third petition filed by the petitioners or some of them was disposed of by this Court on 30th October, 1986 in which this Court said that the petitioners before being “absorbed as Khalasis on temporary status have to submit themselves to medical examination which is usually taken before a person is conferred temporary status”. It was also made clear that the Railway Administration would give full benefit of actual service of the petitioner for the purpose of counting their seniority and it would be open to the Railway administration to absorb the petitioners on temporary status either as work khalasis or as gang khalasis in the appropriate scale.

The fourth order in the field is an order dated 2nd December, 1987 on a separate writ petition, in which the petitioners alleged that although the petitioners had served continuously for a long period of time, the Railway administration had neither permitted them seniority nor granted them the same rate of wages as regular employees. This court by its decision Ram Kumar & Others (reported in 1988 (1) SCC 306) noted that the petitioners had admittedly been in service for more than 360 days and according to the Railway authorities, they were entitled to temporary status. In the judgment this Court said:

“In the Signal and Telecom Construction Organisation under which the petitioners are working, according to the Railway Administration further privileges of being regularised in permanent service is afforded by giving them access to their regularisation against permanent vacancies which mostly occur in open line. For such purpose, casual labour in open line as well as willing project casual labour are combined for the purpose of screening and forming of panel on the basis of seniority depending upon the days of work put in. In view of the submissions, learned counsel for the respondents has pleaded that the allegation of discrimination does not exist”.

This Court also noted the provisions of the Railway Establishment Manual, which, inter alia deals with the grant of regular status to a temporary appointee after selection through regular Selection Board for class IV staff. The court accordingly directed that since many of petitioners had been empanelled, the Railway authority was expected to take prompt steps to screen such of the petitioners who were still waiting for the purpose of regularisation of their service.

It is not in dispute that subsequent to the orders of this court, the petitioners were regularised as khalasis in Group ‘D’ in the open line. However, they have been permitted to continue to serve in various projects of the Railway administration. While they were serving in such projects, they have been granted provisional promotion in a particular corresponding scale of pay on the basis of supplementary trade test held in the project itself. However, the order by which such petitioners were granted local provisional or adhoc promotion made it clear that they would not claim over their seniors in other units. The reason for the filling of these petitions before us by the petitioners is the preparation of lists of surplus staff in the projects. It is the petitioners’ case that these surplus lists have been prepared with a view to bring the petitioners back to the open line cadre at the scale of pay applicable to group D employees over looking that the petitioners had in the meanwhile been promoted to group C and were enjoying much higher scale of pay.

From the documents on record, it is clear that the petitioners have been regularised and continue to hold the substantive posts of Khalasi in group D category in the open line division of the respondents. Their provisional local promotion in the projects cannot be taken as having vested in them a right either to continue in the project or to resist reversion back to the cadre, or to enjoy a higher promotion merely on the basis of locally provisional promotion granted to them in the project in which they had been employed at a particular point of time. No rules have been pointed out to us to justify this claim on the part of the petitioners. Besides if this stand of the petitioner were to be accepted it would operate inequitably as far as the regular employees in the open line department are concerned. Furthermore the order of provisional promotion expressly made it clear that the petitioners were in fact provisionally appointed. Therefore, the writ petitioners cannot seek to make such provisional appointment permanent by filing a writ petition to restrain the respondents from reverting them back to their appointed cadre.

However, while the petitioners cannot be granted the reliefs as prayed for in the writ petition, namely, that they should not be reverted to a lower post or that they should be treated as having been promoted by reason of their promotion in the projects, nevertheless, we wish to protect the petitioners against some of the anomalies which may arise, if the petitioners are directed to join their parent cadre or other project, in future. It cannot be lost sight of that the petitioners have passed trade tests to achieve the promotional level in a particular project. Therefore, if the petitioners are posted back to the same project they shall be entitled to the same pay as their contemporaries unless the posts held by such contemporary employees at the time of such re-posting of the petitioners is based on selection.

Additionally, while it is open to the Railway administration to utilise the services of the petitioners in the open line, they must, for the purpose of determining efficiency and fitment take into account the trade tests which may have been passed by the petitioners as well as the length of service rendered by the petitioners in the several projects subsequent to their regular appointment.

Where a trade test is provided under the relevant rules for the purpose of promotion to group C, we make it clear that it will not be necessary for the petitioners to take the trade tests over again, if they had already taken any comparable test while they were on duty in the projects. It is stated by the learned counsel appearing on behalf of the Railway authorities that during the pendency of the writ petitions that several of the petitioners had applied for promotion in the open line from Group D to Group C but only some were successful. It is not necessary to go into this question since we proceed on the basis that there was a requirement of passing a qualifying trade test held for the purpose of promotion from Group D to Group C post held in the projects.

However, we make it clear that so far as further promotions are concerned that is from Group D to Group C the observations of this Court will not serve to grant any benefit to the petitioners. It is open to the respondent authorities to proceed in the matter of further promotion in accordance with the rules,. We accordingly dispose of these writ petitions and special leave petitions with the aforesaid observations.

Interim orders are vacated.

There will be no order as to costs.

Sub: Psychological Test in Departmental selections.

In terms of this Ministry’s letter No.E(NG)I/92/PM1/22 dt.26.9.94, the serving staff are required to be subjected to psycho-test at the stage of promotion to the post of Switchman, ASM, Diesel/Elec.Asstts., Goods Driver, Motorman and at the stage of deployment of Drivers on Rajdhani/Shatabhdi Express trains. In this Ministry’s letter No.E(NG)I/98/PM1/4 dt.13.7.99 it was clarified that psycho test wherever prescribed will be of qualifying nature and part of the selection meaning thereby that a person who fails in the psycho test is not eligible to be included in the panel.

2. The scope of Psycho Test and its effect on the eligibility of staff for empanelment have been considered by a high level Committee. The recommendations of the Committee have been considered by the Board and following decisions have been taken:-

i) The Psycho Test should henceforth be called as ‘Aptitude Test”.

ii) So far as in-service employees are concerned, the Aptitude test will now be applicable at the stage of promotion as ASM, Diesel/Elec. Asstts. And Motorman (EMU/MEMU/DMU) and at the stage of deployment of Drivers on high speed trains running above 110 kmph. While the Aptitude test need not be given to Drivers of Rajdhani/Shatabhdi Express trains running at lower speeds, the Drivers for deployment on non-Shatabhdi/Rajdhani trains also running over 110 kmph should be subjected to the Aptitude Test.

iii) The Aptitude test should be given a weightage of 20% in the selection for promotion as ASM, Diesel/Elec.Asstt. and Motorman and should be integrated in the selection proceedings. In other words, the Aptitude test will no more be of qualifying nature.

2.1 It has been decided further that weightage of 20 marks, that is required to be given to Aptitude test in the selection for promotion to the above categories should be given in lieu or by bifurcating the heading/marks under the heading Personality, address, leadership and academic/technical qualifications. Accordingly in the case of selection for promotion as ASM and Diesel/Elec.Asstts. covered by procedure laid down for general (selection) posts, the existing heading “Personality, address, leadership and academic/technical qualifications should be bifurcated as under:-

Sub: Issue of Settlement/Kit passes to staff retiring from Railway service before Completion of 20 years.

Rail Coach Factory, Kapurthala has sought a clarification whether Settlement/Kit Passes can be issued to the staff retiring from railway service before completion of 20 years Railway service. In this connection they have referred to the following provisions in the Railway Servant Pass Rules:-

Item (16)(i) of Schedule-VII (Special Passes) at page 51 of the Pass Rules reads as follows:

(16) On retirement/decease - grant of settlement pass:

(i) Railway servant in the event of his retirement or widow in the event of his death may be issued passes for himself or family members/dependent relatives and for the transportation or personal effect as admissible on transfer to the place where he/his family intends to settle after retirement/death of the Railway employees.

However, item (vii) mentions as follows:

(vii) Settlement Pass/Kit pass is allowed on the same conditions as are applicable to the issue of post-retirement passes i.e. in all cases of quitting service except dismissal.

The case has been examined in detail. It has been decided that Settlement/Kit passes may be issued to the Railway employees in all cases of quitting railway service excepting dismissal cases irrespective of their entitlement for Post Retirement Complimentary Passes.

This issues with the concurrence of finance Directorate of Ministry of Railways.

2. The proposal received from new Zonal Railways for extending the ate of closure of cadres in their Headquarter Offices beyond 30.09.2003 has been considered by the Ministry of Railways. In view of the fact that a number of staff have yet to join the headquarter offices of new Zones, it has been decided to further extend the date of closure of cadres in the headquarter offices of all the 7 new Zonal Railways by another one month upto 31.10.2003. Accordingly, any transfer to the Headquarter Offices of these Railways on or after 1.11.2003 will be treated as transfer on request on bottom seniority in recruitment grades subject to usual conditions governing such transfers being fulfilled.”

Sub: Procedure for holding selections for promotion from Group

‘D’ to Group ‘C’ posts.

Reference instructions contained in this Ministry’s letter No.E(NG)I-2000/PM1/41 dated 7.8.2003 and 27.8.2003 regarding elimination of viva-voce in the departmental selections for promotion to posts classified as ‘selection’ in Group ‘C’ categories.

2. In terms of instructions contained in para 189 of IREM, Vol.I,1989, 33-1/3% quota of posts in the lowest grade of Commercial Clerks, Ticket Collectors, Trains Clerks, office Clerks and other categories of Clerks like Stores Clerks, etc. are to be earmarked for promotion of Railway servants in Group ‘D’ categories for whom no regular avenue of promotion exists; the Group ‘C’ categories being suitably linked with specified Group ‘D’ categories on the basis of broad affinity of work. Further, in terms of Board’s letter No.E(NG)I/96/CFP/27 dated 10.10.2000, 16-2/3% of the posts in these categories are also filled by promotion of Matriculate Group ‘D’ employees with a minimum of two years service in the concerned seniority unit entirely on merit on the basis of a competitive examination. However, in the case of Accounts Department the quota for promotion of Group ‘D’ staff to Group ‘C’ post of Accounts Clerks continues to be 25% of the posts.

3. It has been decided that like in the case of Group C Departmental selections, there will be no viva-voce in the selections held for promotion from Group ‘D’ to Group ‘C’ referred to in para 2 above. Accordingly, the selections will henceforth consist of Written Test and Record of Service of 85 and 15 marks respectively.

4. It has also been decided that the procedure as revised above will be applicable to selections notified on or after the date of issue of this letter.

4.1 All the remaining procedure prescribed for holding selections including constitution of Selection Boards in vogue as per procedure prescribed by the General Managers, will remain unaltered.

Accordingly, the Indian Railway Establishment Manual, Vol-I, 1989 is amended as per ACS Nos.154 and 155 enclosed.

Chapter I, Section’B’ Sub-Section IV - Recruitment of Group ‘D’ Railway servants and their promotion to higher grades in Group ‘D’ and Group ‘C’ posts.

For the existing para 189, substitute the following:-

“189. Promotion to higher grades in Group ‘C’: Railway Servants in Group ‘D’ categories for whom no regular avenue of promotion exists 33-1/3% of the posts in the lowest grade of Commercial Clerks, Ticket Collectors, Trains Clerks, Office Clerks, Stores Clerks, etc. should be earmarked for promotion. The quota for promotion of Group ‘D’ staff in the Accounts Deptts. to Group ‘C’ post of Accounts Clerks will be 25%. Promotion to Group ‘C’ will be subject to the following conditions:-

i. All promotions should be made on the basis of selection. There should be written tests to assess the educational attainments of candidates. Group ‘C’ categories referred to above should be suitably linked with specified categories in the lower grades on broad affinity of work to form groups for promotion but it should be ensured that the prospects are made equal in the different groups. The test should be correlated to the standards of proficiency that can reasonably be expected from railway servants who are generally non-matriculates. The aim of the examiners should be to assess the general suitability of the Group ‘D’ railway servants offering themselves for promotion to Group ‘C’ posts from the point of view of their knowledge of English and their general standard of intelligence. The factors of selection and their relative weight will be as indicated below:-

Note: (1) Written test should consist of one paper of 3 hours duration divided into two parts - Part ‘A’ to test the working knowledge of the Railway servant of the English language and Part ‘B’ his general standard of intelligence and proficiency through questions in Arithmetic, General Knowledge mainly pertaining to Railway matters and matters immediately pertaining to the work he has been acquainted with during his Railway service. In drawing up the questions it must be ensured that they are not set as such a standard as to make it impracticable for a Group ‘D’ railway servant of average intelligence and normal standards of efficiency to qualify in the test.

(2) Assessment under the heading Record of Service will be based on entries in the Service Book/personal file regarding academic/technical qualifications, awards/punishments, etc.

(3) Selections should not be restricted to three times the number of posts to be filled but kept open to all eligible candidates who would like to be considered for such selections.

(4) All those who qualify on the basis of written test and Record of Service, the qualifying percentage of marks being prescribed by the General Manager, should be included in the panel in the order of their seniority for promotion against the yearly vacancies available for them in Group ‘C’ categories.

(ii) Group ‘D’ railway servants to be eligible for promotion to Group ‘C’ posts should have put in a minimum 3 years of continuous service. This does not apply to Schedule Castes and Scheduled Tribes candidates.

(iii) For promotions to Group ‘C’ posts in the Ministerial cadre Group ‘D’ staff will be required to possess a typing speed of 3 w.p.m. in English or 25 w.p.m. in Hindi. Promotions may, however, be allowed on provisional basis and the concerned staff given two year’s time from the date of promotion, to qualify the prescribed typewriting test; and if they fail to qualify the typewriting test within the said period, they will be liable to be reverted.

(iv) Training

(a) The standard of training imparted to the Group ‘D Railway servants selected for Group ‘C’ posts should be the same as for direct recruits for the same Group ‘C’ categories and in the case of failures in the first attempt such employees may be given second chance to qualify.

(b) Group ‘D’ railway servants when promoted to Group ‘C’ posts in the Accounts Deptt. shall go through the same training and test and shall be subject to the same conditions of service as are in force for the new recruits. During the period of their training they would get as stipend the pay that they would have normally drawn on promotion to Group ‘C’. All allowances like Dearness Compensatory and House Rent Allowances will be allowed to them at the scales applicable, had the stipend been treated as pay.

Note: Employees in lower Group ‘C’ scale of Rs.825-1200 (RPS)/2750-4400 (RSRP) and Rs.950-1400(RPS)/3050-4590 (RSRP) for whom no regular avenue of promotion exists will also be eligible to appear in the selection held for promotion of Group ‘D’ employees to Group ‘C’ against the prescribed quota.

Consequent to sanction of an additional instalment of Dearness Allowance vide this Ministry’s letter No.PC-V/97/I/7/14 dated 9.9.2003, the President is pleased to decide that the rates of Night Duty Allowance, as notified vide Annexures ‘A’ and ‘B’ of Board’s letter No.E(P&A)II-2003/HW-2 dated 29.4.2003 stand revised with effect from 1.7.2003 as indicated at Annexure ‘A’ in respect of ‘Continuous’, ‘Intensive’, ‘Excluded’ categories and workshop employees, and as indicated at Annexure ‘B’ in respect of ‘Essentially Intermittent’ categories respectively.

This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Sub: Procedure for filling up the posts of Skilled Artisan against 25% quota.

Reference this Ministry’s letter of even number dated 2.2.1998 as amplified vide letter dated 9.12.1999 laying down the detailed procedure for filling up the 25% quota of posts in the category of Technician (trade) in scale Rs.3050-4590 from amongst serving Helpers Gr.I and Helpers Gr.II with educational qualifications as laid down in Apprentices Act. The procedure inter-alia envisages that the selection will consist of written test for 85 marks and viva-voce for 15 marks.

2. As the Railways are aware, instructions for elimination of viva-voce in selections for promotion to posts classified as ‘selection’ in Group ‘C’ categories except the categories of Law Asst., Physiotherapist, Telephone Operators and Teachers have been issued vide this Ministry’s letter No.E(NG)I-2000/PM1/41 dated 7.8.2003. It has been decided that the procedure for filling up 25% quota for promotion as Technician (Trade) Gr.III as mentioned in para 1 above should also be modified to the extent that 15 marks hitherto allotted to viva-voce should be allotted to Records of Service, assessment under which should be based on entries in the Service Book/Personal File regarding academic/technical qualifications, awards/punishment etc.

3. All other conditions remain unchanged.

4. The revised procedure will apply to selections notified on or after issue of this letter.

Sub: Grant of increment of Substitutes - Counting of service regarding.

The issue, as to which date shall be taken into account for allowing annual increment to a Substitute i.e. whether it should be the date of his/her engagement as a Substitute or the date of his/her attaining the temporary status, was under examination in this office. It has now been decided that in supersession of all previous instructions on the subject, the services of a Substitute for allowing annual increment shall be counted from the date of his/her attaining temporary status .

These instructions will come into effect from the date of issue of this letter. Past cases decided otherwise need not be re-opened.

1. In terms of Railway Board’s letter No. E[G]97 QR1-28 dated 2-9-02, in order to facilitate smooth operationalisation of New Zones, Officers/Staff, on posting to New Zones/Divisions, were permitted retention of Railway quarters at the previous place of posting for a period of one year from the date of relief.

2. New Zones had represented to Railway Board about acute shortage of accommodation and requested for extending the period of retention, permitted vide instructions dated 2-9-02. The matter has been reviewed by Railway Board in their meeting held on 22-8-2003 wherein in exercise of the powers vested in Board as per letter No. E[G]99 QR1-16 dated 18-7-2000, the Ministry of Railways , [Railway Board] have decided , in public interest to relax the existing provisions and allow further retention of Railway accommodation in favour of officers/staff already posted to New Zones and retaining Railway quarters at their previous places of posting for a further period of one year in continuation of Board’s letter dated 2-9-2002. This relaxation would also apply in cases where the officers/staff are provided with transit accommodation at new Zones. The grant of permission would however be subject to the conditions as laid down in instructions dated 2-9-2002.

3. This issues with the approval of the Finance Directorate of the Ministry of Railways.

Sub: Restructuring of certain Group ‘C’ & ‘D’ cadres.

The Ministry of Railways have had under review cadres of certain Group ‘C’ & ‘D’ staff in consultation with the staff side with a view to strengthening and rationalising the staffing pattern on Railways. As a result of the review undertaken on the basis of functional, operational and administrative requirements, it has been decided with the approval of the President that the Group ‘C’ & ‘D’ categories of staff as indicated in the Annexures to this letter should be restructured in accordance with the revised percentages indicated therein. While implementing these orders the following detailed instructions should be strictly and carefully adhered to:

Date of effect (hereinafter referred to as cut-off date)
1. This restructuring of cadres will be with reference to the sanctioned cadre strength as on the date following the date on which the cadres in the headquarter offices of new Zonal Railways/new Divisions are closed. The benefit of restructuring will be restricted to the persons who are working in a particular cadre on the cut-off date.

Applicability to various cadres
2.These orders will be applicable on the regular cadres (excluding surplus & supernumerary posts) of the Open Line establishments including Workshops and Production Units. These orders will, however, not be applicable to staff of RDSO for which separate orders will be issued.


2.1 These orders will not be applicable to ex-cadre & work-charged posts which will continue to be based on worth of charge.


2.2 These instructions will also not be applicable to construction Units and Projects, where posts are generally created on worth of charge basis, though those should broadly be conforming to these percentage distributions.

Pay fixation (Rule 1313 (FR 22)-RII)
3.Staff selected and posted against the additional higher grade posts as a result of restructuring will have their pay fixed under Rule 1313 (FR-22)(I)(a)(I)-RII on proforma basis w..e.f. cut-off date with the usual option for pay fixation as per extant rules. Actual payment based on the pay so fixed should be made from the date of taking over the charge of the higher grade post arising out of these restructuring orders. The benefit under this rule will, however, no longer be available in the case of movement from lower grade to higher grade in the non-functional situations where there is no change in duties as in the case of movement from Goods Guards to Sr.Goods Guards and Goods Drivers to Sr. Goods Drivers etc. In the case of such movement, the pay will be fixed under Rule 1313(FR 22)(I)(a)(2)-RII. However, the benefit of fixation of pay under rule 1313 (FR-22)(I)(a)(I)R-II will now be admissible in the cases of functional promotions such as promotion from Sr. Goods Guards to Passenger Guards and Sr. Goods Drivers to Passenger Drivers etc. though in identical scale of pay.

Existing classification and filling up of the vacancies
4.The existing classification of the posts covered by these orders as ‘selection’ and ‘non-selection’ as the case may be, remains unchanged. Action should be taken to position the employees on the basis of selection/non-selection/suitability/Trade Test, as the case may be. However, the instructions contained in Para 13.2 should be followed in case of placement of Supervisors (erstwhile Mistries) to grade Rs.5000-8000.


5.Extant instructions for D&A/Vigilance clearance will be applicable for effecting promotions under these orders with reference to the cut-off date.

Minimum years of service in each grade
6.While implementing the restructuring orders, instructions regarding minimum period of service for promotion issued from time to time should be followed. In other words, residency period prescribed for promotions to various categories should not be relaxed.

Basic functions, duties and responsibilities
7.Since the cadres as detailed in the annexures to this letter are being restructured on functional, operational and administrative considerations, the posts being placed in higher scales of pay as a result of restructuring should include the duties and responsibilities of greater importance.

Adjustment of excess number of posts
8.If prior to issue of these instructions the number of posts existing in any grade in any particular cadre exceeds the number admissible on the revised percentages, the excess may be allowed to continue to be phased out progressively with the vacation of the posts by the existing incumbents.


9.While implementing these orders, specific instructions given in the foot-notes for the relevant categories in the enclosed annexures should be strictly and carefully adhered to.

Introduction of Multi skilling-merger of I)SM/ASM + YM + TI (ii)Personnel/Welfare/HOER Inspectors(iii)ESM & MSM
10.The concept of Multi-skilling is to be introduced by merging the different categories as mentioned hereunder. While the revised percentage distribution of posts as indicated in the annexures to this letter should be implemented in the unified cadres based on the integrated seniority list, the duties, responsibilities and functions being performed by the employees of the respective cadres will be combined in a phased manner. Each member of the cadre will have to be equipped with necessary skills and functions through proper training and development. The categories indicated herein will be merged by integrating the seniority of the employees working in respective grades with reference to length of non-fortutious service in the relevant grade keeping the inter-se-seniority in the respective group intact.


10.1 The category of Station Masters/Assistant Station masters, Yard Masters and Traffic Inspectors should be merged into one unified cadre of SM/ASM. The recruitment and promotion pattern as prescribed for the category of SMs/ASMs should be followed in the merged cadre. In the initial stage of the merger, efforts should be made to post the employees in the categories in which they have been working. Accordingly, while the staff belonging to the erstwhile three categories will be working and enjoying the benefit of the unified cadre of SMs/ASMs, on their posting in the Yard, they will perform the duties of yard Master retaining their designation as applicable to the category of Yard Master. Similarly, while performing the inspectorial job they will retain their designation as applicable to Traffic Inspectors. But at a later stage, when they are made fully equipped to discharge all the functions hitherto being discharged by SMs/ASMs, YMs & TIs, administration will have the flexibility to post a person as per the administrative requirement. While rendering the duties and functions, Railways may also review and rationalise the cadre keeping in view the administrative requirements.


10.2 The Personnel, Welfare and HOER Inspectors should be merged and a unified cadre of Personnel Inspectors introduced. After merger, 50% of the posts in the entry grade of the combined cadre viz Rs.5000-8000 should be filled from amongst the optee Sr. Clerks of Personnel Department in grade Rs.4500-7000 with three years of service in the grade and the remaining 50% of the posts should be filled as per the instructions contained in Board’s letter No.E(NG)-I/2002/PM4/I dated 12.07-02.


10.3 The categories of Electric Signal Maintainers (ESM) and Mechanical Signal Maintainers(MSM) should be merged and a unified cadre of Signal Maintainers introduced. The recruitment and promotion pattern as applicable to the Electric Signal Maintainers will be followed in the unified cadre of Signal Maintainers.

Introduction of Direct recruitment (i) Ministerial staff(excluding Accounts staff) (ii)Personnel Inspectors

(iii)Depot Material Superintendents
11.The implementation of restructuring scheme in the categories of Ministerial staff, Personnel Inspectors and Depot Material Superintendents in subject to the introduction of direct recruitment in the categories. After implementation of the restructuring in accordance with the revised percentage distribution of posts indicated in the annexures enclosed, the vacancies arising in these categories on or after the cut-off date should be filled through direct recruitment in the manner indicated hereunder:-


11. An element of direct recruitment of graduates with not less than 50% marks shall now be introduced at the level of Office Superintendent Gr.II in the pay scale Rs.5500-9000 in the Ministerial categories (Establishment & other than Establishment but excluding Accounts) to the extent of 20% of the posts. The remaining 80% of the posts in grade Rs.5500-9000 shall continue to be filled by promotion of staff from the lower grade Rs.5000-8000 as per the procedure in force.


11.2.20% of the posts in grade Rs.6500-10500 in the category of Personnel Inspectors shall be filled by direct recruitment from amongst the candidates possessing Bachelor degree with Postgraduate Diploma in Personnel Management, labour laws, etc. as mentioned in Board’s letter No.E(NG)I-2002/PM4/1 dated 12.07.2002. The remaining 80% of the posts shall continue to be filled by promotion of staff from the lower grade of Rs.5500-9000 as per the procedure in force.


11.3.20% of the posts in grade Rs.6500-10500 in the category of Depot Material Superintendents should be filled by direct recruitment from amongst the candidates possessing qualification of degree in Engineering in any discipline. The remaining 80% of the posts shall continue to be filled by promotion of staff from the lower grade of Rs.5500-9000 as per procedure in force.

Gatemen(Engg.)
12.As a result of implementation of this restructuring, more number of additional posts will be available in the highest grade of this category. Henceforth, therefore, the posts of Gatemen(Engg.) should be operated in grade Rs.2750-4400. In order to ensure the full availability of Gatemen (Engg.) and rotation of the existing staff specially those who are working, as such, for a long period, the Trackmen etc. at the time of their promotion to grade Rs.2750-4400 should be posted as Gatemen(Engg.) subject to their fulfilling the requirement of prescribed medical standard and literacy level etc. as per extant instructions.

Upgradation of the posts of Supervisor(erstwhile Mistries)
13(a)Subject to provisions of Para-13.2 below, all the posts of Supervisors (erstwhile Mistries) in grade Rs.4500-7000+Rs.100 Special Allowance(excluding Supervisors(P.Way) should enbloc be upgraded to the posts of Junior Engineer Gr.II in the pay scale of Rs.5000-8000 and merged with the respective cadre of Technical Supervisors with its spread effect in higher grades Rs.5500-9000, 6500-10500 & 7450-11500 as per the revised percentage distribution of posts prescribed for Technical Supervisors in these orders.


13(b)In case of Supervisor(P.Way), the posts being held by the erstwhile PWMs supervising more than one gang upto a maximum of 17.26% for the sanctioned cadre of PWMs shall be upgraded to and merged with the posts of Junior Engineer(P.Way) Gr.II in the pay scale of Rs.5000-8000 with its spread effect in higher grades of JE-I, SE & SSE in grades Rs.5500-9000, 6500-10500 & 7450-11500 respectively, as per the revised percentages prescribed for Technical Supervisors in these orders.


13.1. The financial implications involved in the upgradation covered by (a)&(b) above should be off set by surrender of posts of Supervisors of equivalent money value.

Procedure for fitment
13.2The placement of the existing incumbents will be regulated as per the procedure given below:-


(a)The existing regular incumbents of the posts of Supervisors (including Supervisors/P.Way to the extent of upgradation of posts) will be placed in grade Rs.5000-8000 without subjecting them to normal selection procedure. Their suitability shall be adjudged by following modified selection procedure according to which the selection will be based on scrutiny of service records and confidential reports only.


(b)The Supervisors (other than P.Way) who do not get promoted to grade Rs.5000-8000 shall continue to hold the post in the existing grade Rs.4500-700+s.100 SA as personal to them. To this extent the posts upgraded to grade Rs.5000-8000 will be operated in the lower grade Rs.4500-7000+Rs.100 SA till the existing incumbents vacate the same by way of promotion, retirement etc. On vacation of the posts, the same shall automatically be operated in grade Rs.5000-8000.

Specific provisions for Supervisor(P.Way)
13.3.The remaining posts of Superisors(P.Way), erstwhile PWMs which are not to be upgraded and shall continue to be operated in the existing scale of pay, should be redesignated as “Track Supervisor”.


13.4.While the existing incumbents of the posts of Supervisors (P.Way) redesignated as “Track Supervisor” shall continue to draw the scale of pay Rs.4500-7000+Rs.100 SA as personal to them, the future incumbents to the post of ‘Track Supervisor’ will be in the pay scale of Rs.4500-7000 without the Special Allowance of Rs.100/-.


13.5.The upgradation of posts of Supervisor(P.Way) as indicated hereinabove should not result in creation of posts of Trolleymen. In other words under no circumstances, additional posts of Trolleyman would be created.

Provision of reservation
14.The existing instructions with regard to reservation of SC/ST wherever applicable will continue to apply.


15. Direct recruitment percentages will not be applicable to the additional posts arising out of these restructuring orders as on the cut-off date. The direct recruitment percentage will apply for normal vacancies arising on or after the date following the cut-off date. Also the direct recruitment quota as on the date preceding the cut-off date will be maintained.

Pin pointing of posts
16. The administration should take steps to pin-point the additional posts arising out of this restructuring as per administrative requirements.

Refusal of promotion
17.Such of the Staff as had refused promotion before issue of these orders and stand debarred for promotion may be considered for promotion, in relaxation of the extant provisions as a one time exception, if they indicate in writing that they are willing to be considered for such promotion against the vacancies existing on the cut-off date and arising due to restructuring on that date. This relaxation will not be applicable to vacancies arising after the cut-off date.

Matching Savidngs
18.Entire scheme of restructuring is to be a self-financing and expenditure neutral proposition. Financial implications should be worked out taking into account the mid points of the scales of pay of the respective posts(mean of the minima & maxima of the scale), existing number of posts and revised number of posts in the grade on the basis of the revised percentage distribution of posts. After working out the financial implications, the matching savings should be effected from the category itself. Wherever it is not possible to do so from the category itself, the matching savings should be arranged from the department at the divisional/zonal level. But before restructuring the cadre as per the revised percentage distribution of posts, matching savings will have to be ensured and if the Department/Railways are not able to provide the matching savings, the particular category/department will not be restructured. While effecting surrender of posts of equivalent financial value, the existing vacant posts available in the categories on the cut-off date should be considered for the purpose of off-setting the cost of restructuring/financial effects of restructuring. Board desire that the General Managers should ensure that the restructuring is implemented expeditiously with matching savings without any exception and difficulty. There would be no restructuring without matching savings by surrender of posts.

Re-organisation of Zonal Railwas/Divisions:
19. Due to re-organisation of Zonal Railways/Divisions cadres are in a fluid situation. It may, therefore, take some time for the cadres in the headquarter offices of New Zones and New Divisions to stabilise. In the circumstances, new Zonal Railways are required to ensure that the staff transferred to headquarter offices of new Zonal Railways/new Divisions are not extended the double benefit of restructuring. In case an employee has been given the benefit of restructuring on the old(parent) railway in terms of these orders, he will not be allowed the benefit of restructuring again on the headquarter offices of new Zonal Railways/new Divisions. In other words no railway servant will be considered for double promotion as a result of this restructuring.

Annual review
20.As per instructions contained in Board’s letter No.PC-III/91/FP-2 dt.08.10.2002, the Annual Reviews for gradewise percentage distribution of posts in force were to be conducted from 01.04.03 taking into account the cadre strength as on 01.04.03. It has now been decided that the next Annual Review will be undertaken from 01.04.2005 taking into account the cadre strength as on 01.04.2005. The Annual reviews, wherever conducted already as per instructions dt. 08.10.02 will not be undone.

Sub: Grant of another opportunity for revision of option by the Accounts staff and Stock Verifiers due to retrospective revision of scales of pay.

Attention is invited to the instructions contained in Board’s letter No.PC-V/98/1/11/23 dated 7.3.2003 in terms of which the scales of pay allotted to Jr. Accounts Assistants, Accounts Assistants, Section Officers/Inspectors of Accounts/Cost Accountants, Sr. Section Officers/Sr. Inspectors of Accounts/Sr. Cost Accountants were revised with retrospective effect from 1.1.1996 on notional basis. The scales of pay allotted to Stock Verifiers and Sr. Stock Verifiers were also revised with retrospective effect from 1.1.1996 on notional basis vide Board’s letter No.PC-V/97/1/11/14 dated 25.6.2003. As the decision to revise the scales of pay of the above categories of staff was effective retrospectively from 1.1.1996, references are being received from the Zonal Railways etc. seeking permission for allowing revision of option for fixation of pay in the higher grade to those staff who had been promoted to higher grades after 1.1.1996.

2. The matter has been examined and it has been decided by the Board to allow another opportunity to exercise option for fixation of pay on promotion to the above adversely affected Accounts staff and Stock Verifiers who were promoted to the next higher grade(s) on or after 1.1.1996 till (a) 7.3.2003 in the case of the above Accounts staff covered by the orders contained in Board’s letter dated 7.3.2003 ibid and (b) 25.6.2003 in the case of Stock Verifiers covered by the orders contained in Board’s letter dated 25.6.2003 ibid. The option will have to be exercised by the employees within three months from the date of issue of these instructions and once exercised, shall be final.

This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Sub: Payment of Productivity Linked Bonus to non-gazetted Group ‘B’,’C’

& ‘D’ Railway employees for the financial year 2002-2003.

The President is pleased to announce Productivity Linked Bonus (PLB) equivalent to 60 days wages for the performance during the financial year 2002-2003. For the financial year 2000-2001, excess PLB payment equivalent to one day’s wages was made due to erroneous data furnished by one of the Zonal Railway, which came to notice only after the final data became available. The aspect of effecting recovery of the above excess payment has been considered and it has been decided to adjust the same from the payment for the financial year 2002-2003. Accordingly, the President is pleased to sanction PLB equivalent to (60-1)=59 (fifty nine) days wages without any ceiling on wages for eligibility for the financial year 2002-2003 to all non-gazetted Group ‘B’,’C’ & ‘D ’Railway employees (excluding all RPF/RPSF personnel). Where wages exceed Rs.2500/- (Rupees Two thousand five hundred only) per month, PLB will be calculated as if ‘wages’ are Rs.2500/-p.m.

2. In the revised (Fifth Central Pay Commission)Scales of pay, ‘wages’ for the purpose of PLB actually drawn during the financial year, shall include ‘pay’ as defined in Rule 103(35)R-1(1985 Edition) and dearness allowance sanctioned in the revised scales during the financial year 2002-2003. In the case of Running Staff, the term ‘pay’ shall include 30% of pay constituting the pay element in Running Allowance payable on leave salary. Other conditions such as method of calculation of wages, etc., as prescribed in this Ministry’s instructions and clarifications from time to time, shall remain unchanged.

3. It has been decided that in the case of eligible employees mentioned in Para 1 above who were not placed under suspension, or had not quit service/retired/expired during the middle of the financial year 2002-2003 or were on leave where leave salary admissible is not less than that admissible on leave on average pay, may be paid an amount of Rs.4849/- towards Productivity Linked Bonus for the financial year 2002-2003. In the case of employees other than those mentioned above, the amount of Productivity Linked Bonus may be calculated in accordance with the extant instructions on the subject, with particular reference to the instructions contained in Board’s letter No.E(P&A)II-2001/PLB-14 dated 20.9.2002.

4. The Ministry of Railways have also decided that in relaxation of the provisions in Rules 905(2), 908 and 909 of State Railway Provident Fund Rules, as contained in Chapter 9 of R.1/1985 edition, such of the subscribers to the SRPF as are entitled to Productivity Linked Bonus may, if they so desire, deposit the whole or part of the amount admissible under the Scheme in their respective State Railway Provident Fund Accounts.

5. Payment of Productivity Linked Bonus to all non-gazetted Group ‘B’,’C’ & ‘D’ Railway employees may be made immediately.

6. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Sub: Promotion of Group ‘B’ officers to Senior Scale.

One of the Zonal Railways has sought a clarification whether there is any relaxation for SC/ST Group ‘B’ officers who have not completed 06 years of service for promotion to Senior Scale against a reserved roster point.

In this connection it is clarified that in terms of para (iii) of Board’s letter No.E(GP)85/1/48 dated 31.12.85 read with para-2 of Board’s letter dated 17.4.90 quoted above, the Group ‘B’ officers who have rendered not less than three years of service in Group ‘B’ and have been adjudged suitable by a committee of HODs for appointment against Senior Scale vacancies should be considered for ad-hoc appointment.

In view of the above standing instructions on the subject, it is clarified that if suitable Group ‘B’ SC/ST officers who have rendered not less than 06 years of service in Gr. ‘B’ are not available, the suitable SC/ST officers with minimum three years of service in Group ‘B’ can be considered for ad-hoc promotion to Senior Scale against the vacancies reserved for them. The SC/ST candidates will also be considered for promotion to unreserved posts in Senior Scale along with general candidates if they are found suitable on the basis of their general seniority.

One of the Railways have recently expressed doubts regarding their competence to re-employ as fresh entrant the dismissed/removed railway employees in terms of provisions of Rule 402 IREC Vol.I. This issue has also been taken up by the NFIR in the PNM meeting at the Board’s level to be held on 2/3.5.2000.

It is clarified that Rule 402 IREC Vol.I does not forbid the competent authority on the Railways to order re-employment of a dismissed/removed railway employee subject to the provisions contained in the said rule.

Sub: Duration of promotional Training Courses.

Some of the Railways have been approaching Board for seeking clarification whether all eligible candidates should be trained before the selection process in terms of Board’s letter No.E(MPP)99/19/1/5.3 dated 25.2.02.

The above matter has been considered and it is clarified that instruction contained in Board’s letter referred above is that successful completion of the training is mandatory for safety category staff before being promoted to a higher post. The instruction does not imply that all eligible candidates in the zone of consideration have to be necessarily imparted training before the selection process.

Duration of the Training courses shall not be altered.

Sub: Curtailment of pre-promotional training for Goods Driver

without curtailing the course content.

Vijayawada Division of this Railway is having 147 vacancies of Passenger Drivers in scale Rs.5500-9000 (RPS). 458 eligible Goods Drivers have to be subjected to selection for promotion to the post of Passenger Driver.

In terms of instructions contained in Board’s letter No.E(MPP)95/19/6 dt.31.8.99 (RBE No.220/99), the promotional course for Goods Driver is 8 weeks. In terms of Board’s letter No.E(MPP)99/19/1/5.3 dated 25.2.2002 (RBE No.25/2002), successful completion of training is mandatory for promotion of Goods Driver to Passenger Driver and the staff should be directed to attend the mandatory course well in advance of the initiation of the process of selection to the next higher grade.

For completing the mandatory course of 8 weeks for all the eligible Goods Drivers, it will take about 36 months in view of constraints of training capacity, inadequate relief and other safety constraints. It is not possible to spare more staff for training each time.

In the circumstances explained above, it is proposed to reduce the duration of the pre-promotional course duly retaining the course content intact. The proposed schedule reducing the duration from 48 working days to 24 working days for the pre-promotional course from Electric Goods Drivers to Passenger Drivers is enclosed. Board’s approval may kindly be accorded for reducing the duration so as to enable Vijayawada Division to complete the course early and finalise the selection to fill the vacancies of Passenger Drivers early. Board’s orders may kindly be communicated early.

Sub: Option for fixation of pay on promotion - regarding.

Attention is invited to the provision relating to exercise of option by a Railway employee for fixation of pay on promotion/appointment to the higher grade/post under Rule 1313 (FR 22(I)(a)(1)R-II/1987 edition.

2. The staff side raised a demand in the National Council (JCM) that a Central Government servant may be allowed to revise the option exercised by him on promotion/appointment to the higher post/grade under FR 22(1)(a)(i) in the event of unanticipated developments or change of rules etc. The Staff side also demanded that a specific provision to this effect be incorporated in the existing rules/orders. The matter has been examined by the Government and the President is pleased to decide that pursuant to any unforeseen developments or change of rules, a Railway employee may given a revised option for pay fixation under Rule 1313 (FR 22(I)(a)(1)R-II/1987 edition within a period of one month from the date of issue of orders of such unforeseen developments or change of rules. Proposal for acceptance of such revised option may thereafter be referred to this office along with detailed justification therefor and verbatim remarks of FA&CAO, which will be examined and decided on merits in consultation with Department of Personnel & Training. In case it is decided to allow fresh option to the Railway employee concerned, the option once exercised shall be treated as final. Past cases of similar nature can also be referred to the Board, which will be decided on merits. The Zonal Railways etc. are requested to bring the above decision to the notice of all concerned.

Sub: Transfer of staff to Headquarters Offices of new Zonal Railways-

Sparing of staff.

Ref: This Ministry’s Letter of even No. dated 29.9.2003.

As the Railways are aware, the cadres in the Headquarters Offices of the new Zones are due to close on 31.10.2003. The issue of release of staff to Headquarter Offices of new Zones are discussed in the GM’s Conference held in Board’s office on 28/29.10.2003 wherein the following decisions were taken:-

i) All the staff whose options for transfer to Headquarter Offices of new zonal Railways have been accepted by the Zonal Railways and are required as per the sanctioned strength in the new zonal railway headquarters should be spared positively by 31.10.2003 except the train passing staff viz. ASMs/SMs/Dy.SSs/SSs and running staff viz. Diesel/Electrical Assistants, Drivers and Guards/Asst. Guards, who are not to be spared.

ii) Options exercised by staff holding headquarter controlled posts in the affected Divisions as per instructions vide Note below para 2(ii) (b) of Board’s letter No.E(NG)I-96/36 dated 6.1296 should be honoured and the staff concerned spared by 31.10.2003 positively.

iii) Since the GMs of the new Zonal Railways expressed inability to accommodate the staff if they are spared in one go by 31.10.2003, the paper lien of staff as on 31.10.2003 may be transferred for the time being and the GMs of the respective new Zonal Railways and the old (parent) Railways should mutually come to an understanding to this effect and fix a target date ( Not later than 30.4.2004) for physical transfer of these staff as per seniority. The staff whose paper lien is so transferred will be considered for selection/promotion etc. in the Headquarters Offices of new zonal Railways though they will not be physically available there. Such staff should NOT be considered for selections/promotions including for cadre restructuring in the old(parent) railways. The Two GMs should sign a Memorandum of Understanding (MOU) relating to transfer of paper lien latest by 5.11.2003.

iv) The posts which are yet to be transferred to headquarter offices of new zonal railways and are required to be declared as supernumerary should not be taken into account for the purpose of cadre restructuring.

2. Similar action may be taken in respect of transfer of staff to the Divisional Headquarter Offices of newly created Divisions.

Fifth Central Pay Commission.

The Fifth Central Pay Commission in para 133.94 of its report have recommended that the distinction between temporary and permanent Govt. servant having rendered a qualifying service of less than ten years may be done away with regard to payment of terminal benefits. The above recommendation of the Pay Commission has been considered and it has been decided that a temporary Govt. servant who retires on superannuation or discharged from service or declared invalid for further service or absorbed in an autonomous body before completing ten years of continuous service shall be eligible to gratuity on the same scale and rates as are applicable to permanent Civil Govt. servants under the provisions of Central Civil Services (Pension) Rules, 1972.

2. These instructions shall come into force w.e.f. 1.1.96. The cases of temporary Govt. servants decided otherwise, may be reopened and decided as above.

3. So far as persons serving in the Indian Audit & Account Departments are concerned, these instructions issue in consultation with the Comptroller & Auditor General of India.

Sub: Classification of cities for the purpose of Transport Allowance -

clarification regarding.

Please refer to Board’s letter of even number dated 16.10.97 regarding grant of Transport Allowance to Railway servants. In terms of para 2(i) of the letter ibid the cities referred to as “A” and “A-1” in the said orders shall be the same as those classified as such for the purpose of Compensatory (City) Allowance (CCA) in terms of the orders issued separately regulating grant of CCA to the Central Government employees. Ins this connection, in elaboration it is clarified that grant of Transport Allowance would be governed by the new classification of cities for the purpose of CCA as given in Annexure ‘1’ to Board’s letter No.PC-V/97/I/7/13 dated 16.10.97. The special dispensation extended to CCA is not applicable to Transport Allowance. Necessary action may be taken for making recoveries wherever over payment has been made.

Sub: Out of turn promotion from Group ‘D’ to Group ‘C’ in Artisan

Categories – minimum educational qualification.

In terms of instructions contained in Board’s letter of even number dated 14.2.2003, powers were delegated to the General Managers to consider out of turn promotion of outstanding sports- persons from Group ‘D’ to Group ‘C’ in Skilled Artisan categories on provisional basis provided the sports-person so promoted acquire the qualification of Act Apprenticeship pass in the relevant trade within a period of 2/3 years from the date of their promotion.

2. It has been reported by certain zonal railways/PUs that the above instructions of the Board have not been found viable for implementation mainly because of requirement of acquiring the minimum educational qualification as pass in Act Apprenticeship in the test conducted by the National Council for Vocational Training. The matter has been carefully re-considered in the Ministry of Railways. In supersession of the instructions contained in letter of even number dated 14.2.2003 it has been decided that the sportspersons meeting the norms for out of turn promotion from Group ‘D’ to artisan categories in Group ‘C’ by virtue of sports achievements may be promoted on provisional basis and allotted a trade and given on the job practical training for a period of two years on the expiry of which they should be subjected to trade test. Subject to their passing the trade test the provisional promotion of such sportsperson may be regularised.]

Sub: Medical Certification.

An introductory item has been raised by the staff side for discussion in the next PNM-AIRF meeting, wherein it has been mentioned that DRMs of the Zonal railways are refusing acceptance of medical certificates from private doctors. These powers as per note (ii) of para 538(4) of IRMM 2000 (reproduced below) are to be exercised for special periods only.

(ii) To prevent misuse of private medical certificates the Divisional Railway Manager may withdraw the privilege as given in the concluding portion of the above sub-paragraph by special notification in the staff for special periods. In respect of workshop employees, the power to withdraw the privilege of acceptance of certificates from registered private practitioner shall be exercised by the administrative officer in J.A.G. and S.A.Grade.

It is requested that the DRMs of your railways be advised to strictly adhere to the provision made in the above cited para of IRMM.

Sub: Grant of Post Retirement Complimentary Pass to the canteen employees.

During the course of implementation of Supreme Court’s judgement dated 27.2.1990 in the case of canteen employees (M.M.R.Khan and others Vs. UOI), Board, vide letter No.E(W)90CN1-8 dated 19.11.1990, had communicated decision to count the service rendered by the employees of statutory and non-statutory recognised (subsidized) canteens prior to 22.10.1980 and 1.4.1990 respectively, to the extent it qualifies for pensionary benefits, as per rules. The question of extending the similar benefit for the purpose of grant of Post Retirement Complimentary Passes to the canteen employees has been engaging the attention of Board.

Board, after considering various representations and certain decisions of the Courts, have decided that the service rendered by the employees of statutory and non-statutory recognised (subsidized) canteens prior to 22.10.1980 and 1.4.1990 respectively, shall be counted for the purpose of eligibility for Post Retirement Complimentary Passes, to the extent their service after these cut off dates fall short of 20 years, which is the minimum service prescribed for this purpose. The other conditions in the matter shall be as per extant rules.

This issues with concurrence of Finance Directorate of the Ministry of Railways.

Sub: Restructuring of certain Group ‘C’ & “D” cadres RPF/RPSF.

The Ministry of Railways have had under review cadres of Group ‘C’ & ‘D’ staff of Railway Protection Force and Railway Protection Special Force with a view to strengthening and rationalising the staffing pattern in these forces. As a result of the review undertaken on the basis of functional, operational and administrative requirements, it has been decided with the approval of the President that the Group ‘C’ & ‘D’ cadres of staff as indicated in the Annexures to this letter should be restructured on each Railway/Battalion of RPSF in accordance with the percentages indicated therein. While implementing these orders the following detailed instructions should be strictly and carefully adhered to:

Date of effect
1. This restructuring of cadres will be with reference to the sanctioned strength as on 01.11.03.

Pay fixation (Rule 1313 (FR 22)-RII)
2. Staff selected and posted against the additional higher grade posts as a result of restructuring will have their pay fixed under Rule 1313 (FR-22)(I)(a)(1)R-II on proforma basis w.e.f. 1.11.03 with the usual option for pay fixation as per extant rules. Actual payment based on the pay so fixed should be made from the date of taking over the charge of the higher grade post arising as a result of these restructuring orders.

Existing classification and filling up of the vacancies.
3. The existing classification of the posts covered by these orders as ‘selection’ and ‘non-selection’, as the case may be, remains unchanged. Action should be taken to position the employees on the basis of selection/non-selection/suitability/Trade Test, as the case may be.

4. Extant instructions for D&A/Vigilance clearance will be applicable for effecting promotions under these orders with reference to the crucial date viz. 01.11.03.

Minimum years of service in each grade.
5. While implementing the restructuring orders, instructions regarding minimum period of service for promotion issued from time to time should be followed. In other words, residency period prescribed for promotions to various categories should not be relaxed.

Basic functions, duties and responsibilities.
6. Since the cadres as detailed in the annexures to this letter are being restructured on functional, operational and administrative considerations, the posts being placed in higher scales of pay as a result of restructuring should include the duties and responsibilities of greater importance.

Adjustment of excess number of posts.
7. If prior to issue of these instructions the number of posts existing in any grade in any particular cadre exceeds the number admissible on the revised percentages, the excess may be allowed to continue to be phased out progressively with the vacation of the posts by the existing incumbents.

Inspection -I &

Inspector-II
8. While the restructuring in the rank of Inspector-I & Inspector-II should be effected taking into account the total sanctioned strength of inspector-I & Inspector-II, the special pay of Rs.200/- attached to the posts of Inspector-I shall remain attached only to the posts of Inspector Gr.I.

Provision of reservation.
9. The existing instructions with regard to reservation of South Central Railway/ST wherever applicable will continue to apply.

Direct Recruitment percentages.
10. Direct recruitment percentages will not be applicable to the additional posts arising out of these restructuring orders as on 1.11.03. The direct recruitment percentage will apply for normal vacancies arising on or after 2.11.03. Also the direct recruitment quota as on 31.10.03 will be maintained.

Pin pointing of posts.
11. Action should be taken to pinpoint the additional higher grade posts arising out of this restructuring as per the administrative requirements. This should be done in consultation with the Chief Security Commissioners of the Zonal Railways.

Matching Savings.
12. Entire scheme of restructuring is to be a self-financing and expenditure neutral proposition. Finance implications should be worked out taking into account the mid points of the scales of pay of the respective posts (mean of the minima & maxima of the scale), existing number of posts and revised number of posts in the grade on the basis of the revised percentage distribution of posts. After working out the financial implications, the matching savings should be effected from the category of Head Constable, scale Rs.3200-4900. It is to be noted that before restructuring the cadre as per the revised percentage distribution of posts, matching savings will have to be ensured. While effecting surrender of posts of equivalent financial value, the existing vacant posts available in the category of Head Constable, on the date on which the restructuring is effected (01.11.03) should be considered for the purpose of off-setting the cost of restructuring/financial effects of restructuring. Board desire that the General Managers should ensure that the restructuring is implemented expeditious with matching savings without any exception and difficulty. There would be no restructuring without matching savings by surrender of posts.

Re-organisation of Zonal Railways/Divisions.
13. In the context of re-organisation of Zonal Railways/Divisions it should be ensured that the staff transferred to headquarter offices of new Zonal Railways/new Divisions are not extended the double benefit of restructuring. In case an employee has been given the benefit of restructuring on the old (parent) railway in terms of these orders, he will not be allowed the benefit of restructuring again on the headquarter offices of new Zonal Railways/new Divisions. In other words, no railway servant will be considered for double promotion as a result of this restructuring.

14. After implementation of restructuring in accordance with the percentages prescribed in the annexures attached to this letter, combatised cadres of RPF/RPSF will be maintained on functional considerations as per the extant procedure.

Attention is invited to Board’s letter of even number dated 6.7.2000 vide which instructions were issued interalia that the staff working on Track machines may be rostered to work for a period of 3 weeks at a stretch followed by continuous rest for a period of one week at the headquarters.

The instructions issued under Board’s letter of even number dated 6.7.2000 could not be implemented on Railways as the basic pre-requisite and the related issue of additional rest giver staff was under consideration in Board’s office. The necessary instructions have now been issued vide Board’s letter No.E(G)98/LR 1-3 dated 6.3.2003.

The issue has been re-examined in consultation with Ministry of Labour and temporary exemption has been granted for further period of three years w.e.f. 9.9.2003 with the stipulation that three weeks work at a stretch will include the journey period utilised by the workman in respect of journey conducted by him from the duty point to his headquarters.

This issues with the concurrence of the Finance Directorate of Ministry of Railways.

Sub: Grant of Post Graduate Allowance - clarification regarding.

A doubt has been raised in respect of grant of Post Graduate Allowance to Doctors on the Railways. In this regard your attention is drawn to the instructions contained in Rule 1426 of Indian Railway Establishment Code Volume II, 1987 Edition which clarifies that Post Graduate Allowance would not be admissible to Doctors who have been recruited against a post where possession of Post Graduate degree has been prescribed. The post Graduate Allowance would be admissible where the Doctor has been appointed against a post where Post Graduate qualification has not been laid down for recruitment but he/she possessed the prescribed Post Graduate Diploma/Degree at the time of appointment.

Further Post Graduate Allowance would be admissible where the Doctor acquires the Post Graduate qualification after appointment as a General Duty Doctor on the Railways.

Sub: Grant of ex-gratia payment to disabled children of SRPF[C] retirees.

The rates of ex-gratia payment in respect of SRPF[C] retirees and their families were revised vide Board’s letter No.F(E)III/97/PN1/Ex-Gratia/3 dated 31.12.1997. A doubt has been expressed in some quarters whether the disabled children of SRPF[C] retirees would be entitled to ex-gratia payment for life on the same lines as in the case of the disabled children of Railway servants under the Railway Services (Pension) Rules, 1993.

Attention is drawn to the orders contained in sub-para (4) of para 3 of Department of Pension & Pensioners’ Welfare’s O.M.No.4/1/87-P&PW(PIC) dated 13.6.1988 circulated vide Board’s letter No.PC-IV/87/Imp/1 dated 30.6.1988 according to which other provisions of eligibility prescribed for family pension under the CCS (Pension)Rules, 1972 (Railway Services (Pension) Rules, 1993 on the Railways), though not specifically mentioned in the preceding sub-paras, shall also apply for the purpose of regulating grant of ex-gratia payment under the said orders. The orders contained in the Board’s letter dated 31.12.1997 have been issued in continuation and in modification wherever required of the orders contained in the Board’s letter dt. 30.6.88 and do not supersede them. It is clarified that the physically or mentally disabled children of SRPF [C] retirees shall be entitled to the benefit of ex-gratia payment for life on the same conditions as prescribed for such children of Railway servants under Rule 75 of the Railway Services (Pension) Rules,1993.

With the seven newly created Zonal Railways becoming fully functional, two Zones w.e.f. 1/10/2002 and five w.e.f. 1/4/2003, question has arisen as to who should handle the cases pending in the CATs/Courts on personnel matters i.e., whether it should be handled by the parent Railway from which the new Zones have been carved out or by the new zones.

The matter has been examined in consultation with the Legal Directorate, and it has been decided that the new cases and cases pertaining to the new Zones, in which judgments have been delivered and pending implementation, will have to be dealt with by the new Zones. The other cases will continue to be handled by the parent Railways.

In terms of instructions contained in this Ministry’s letter No.E(NG)I-87/PM1/4, dt.18.08.1987 and letter No.E(NG)I-87/PM1/14, dt.22.07.1988 Zonal railways are required to draw up a calendar for conducting selections for various grades to help them plan various activities connected with selections and to ensure better compliance of Board’s orders regarding holding of selections at regular intervals. These instructions were reiterated vide this Ministry’s letter No.E(NG)I/96/CR/8, dt.9.01.1997.

2. In para 9.7 of Chief Commissioner of Railway Safety’s Note on final report of CRS/South Central Circle on the Rear end collision between 7064 Up Express and Parli Box N Goods train at Ghatnandur station of Secunderabad Division of South Central Railway on 3.01.2003 it has been recommended that Railways may be asked to maintain a time table for filling up of the vacancies in the posts of Pointsman, Cabinman, Leverman, Yard Porter etc., and also to adhere to it so that safety category posts are filled up in time.

3. The Board accordingly reiterate that the extant instructions regarding drawing up of a calendar for holding selections/suitability/trade tests should be followed scrupulously and strictly adhered to so that the vacancies in the promotional grades are timely filled up in regular manner. In case of vacancies to be filled by direct recruitment through RRBs, the instructions contained in the Board’s letter No.E(NG)II-2003/RR 5/3 dated 22.09.2003 are reiterated for compliance.

Sub: Recommendations of Fifth Central Pay Commission regarding

Library staff.

The recommendations of the Fifth CPC in respect of the library staff as contained in paras 55.155 to 55.180 of their Report have been considered by the Government. Since the Fifth CPC had based most of its recommendations on library staff on various provisions as adopted vide Board’s letter No.PC-IV/90/IMP/3 dated `12.10.92 (RBE No.170/92), it has been decided that the Railways/Institute concerned should ensure uniform implementation of the provisions of above letter.

2. It has also been decided that the entry pay scales for departmental librarians possessing minimum qualifications of B.Lib along with a graduate degree may, w.e.f. 1.1.1996, be raised to Rs.5500-9000 by merging the existing posts of Library and Information Assistants and Sr. Library and Information Assistants which are presently in the respective pay scales of Rs.5000-8000 and Rs.5500-9000.

3. Accordingly, it is clarified that:-

(i) the benefit of the revised pay scale would be available w.e.f. 1.1.96 to those Library and Information Assistants in grade Rs.1400-2600 who possess the recruitment qualification of graduation and B.Lib on above date. Their pay in the revised/merged scale of Rs.5500-9000 would be fixed directly with reference to their pay in the pre-revised scale Rs.1400-2600 under the provisions of rule 7 of Railway Services (Revised Pay) Rules,1997 read with the clarification contained in Board’s letter No.PC-V/98/I/6/3 dated 29.5.98. Such staff may exercise a fresh option under Rule 6 of Railway Services (Revised Pay) Rules, 1997 within a period of 3 months from the date of issue of these orders. The option once exercised shall be final.

(ii) The Library and Information Assistants working in grade Rs.1400-2600/5000-8000 as on 1.1.96, who acquire the above recruitment qualification subsequent to above date, may also be allowed the benefit of higher grade prospectively from the date of acquiring such qualification. However, their pay in the revised/merged scale of Rs.5500-9000 would be fixed under Railway fundamental rules with reference to their pay in the existing scale Rs.5000-8000.

(iii) The Library and Information Assistants, who do not possess/acquire the above recruitment qualification, will continue in the existing scale on personal basis and in the event of vacancy, the post will be filled only in the merged grade in accordance with the rules of recruitment.

4. Action to make necessary amendments in the recruitment rules notified vide Board’s letter No.E(NG)II/2001/RR-1/70 dated 3.7.2003 is being taken and further instructions on the issue would follow.

Sub: Recommendations of the Fifth Pay Commission -

Decisions of Government relating to grant of Transport

Allowance to Railway servants - Clarifications regarding.

Please refer to Railway Board’s letter of even number dated 16.12.97 regarding grant of Transport Allowance to Railway employees. The matter regarding improvement in the conditions regulating Transport Allowance has been under consideration and the President is now pleased to decide that condition for grant of Transport Allowance as contained in para 2 (vii) to Railway Board’s letter dated 16.12.97 ibid may be substituted by the following.

“2(vii) This allowance will not be admissible if a Railway servant is absent from

duty for full calendar month(s) due to leave, training, tour etc.”

These orders will take effect from the date of issue.

The cases arising before the date of issue of these orders may be regularised in terms of the orders then in force and the cases arising on or after the date of issue of these orders may be regularised in terms of this order. Accordingly, the clarification on various points in respect of cases arising before the issue of this O.M. are contained in Annexure I and in respect of cases arising on or after the date of issue of these orders are contained in Annexure II.

ANNEXURE I
CLARIFICATION FOR CASES ARISING BEFORE 24.11.2003
Points/Doubts Raised Clarification

1. As the rates of Transport Allowance are prescribed on monthly basis, can it be presumed that the term absence from duty exceeding 30 days due to leave, training, tour etc, be interpreted as calendar month.

2. In case where the leave/spell tour exceeding 30 days envelops partly 2 calendar months, whether Transport Allowance will be admissible for both such months when in none of the month the absence, due to leave/tour exceeds 30 days.

3. In case of absence from Headquarters for less than 30 days either by leave/tour or training, whether Transport Allowance is payable in full or proportionately.

4. Can it be presumed that even if an employee is on leave during the entire month of say Feb, (28 days) or Sept.(30 days), he will be entitled to draw Transport Allowance of the whole month.
1-4. The term ‘absence from duty exceeding 30 days’ means absence from Headquarters/place of posting for a period exceeding 30 days due to any of the reason such as leave, training, tour etc. As per the existing instructions, Transport Allowance is not admissible for the entire period of such absence when it exceeds 30 days. In case, such absence fall in more than one calendar month. Transport Allowance is to be reduced pro-rata after taking into account the number of days of absence in each calendar month. In case such absence does not exceed 30 days, Transport Allowance is admissible in full irrespective of the fact that 30 days constitute a full calendar month or not.

5. Whether Transport Allowance will be admissible to those official who are on training, which is treated as duty.
5. For training period treated as duty, Transport Allowance may be granted, if place of training is at a distance of more than 1 Km. From the residence allotted by the Government and no transport facility/TA/DA is provided for attending the training institute. During official tour in the training course the allowance will not be admissible if the period of the tour exceeds 30 days.

6.Whether it will be admissible to members of inspection parties who are on inspection duty within the city but exceeding 8 Kms from Headquarters.

7. Whether officials who are continuously on field duty either in or outside Headquarters will be entitled to Transport Allowance.
6-7: Transport Allowance is given to compensate for the expenditure incurred for commuting for both to and fro, between place of duty and residence. In case one gets road mileage, Daily Allowance or free transportation for commuting from and to residence for field duty, inspection duty, for a period exceeding 30 days he may not be entitled to Transport Allowance.

8. Whether Transport Allowance is admissible during tour.
8. Transport Allowance will not be admissible during tour exceeding 30 days.

9. Whether Transport Allowance is admissible to vacation staff, i.e. School Teachers.

10. Whether Transport Allowance will be admissible to vacation staff i.e. teachers deputed for training during vacation in Headquarters or outside Headquarters.


9-10 (I) Vacation staff is entitled to Transport Allowance during their non-vacation period, provided they are not provided free transportation and all other conditions governing the allowance prescribed in the general orders dated 16.12.97, are satisfied.

(ii) Since Vacation staff are also entitled to other kinds of leave in addition to the vacation periods, the allowance shall not be admissible during spells to all kinds of leave exceeding 30 days as in the case of other Railway employees.

(iii) Vacation staff deputed for training or other academic or administrative duties during periods of vacation may also be paid the Transport Allowance, subject to the conditions that the staff concerned are not in receipt of any Daily Allowance or are not provided free transportation facilities or are not paid any Conveyance Allowance separately on such occasions.

11. Whether the Transport Allowance is admissible during the period of suspension in excess of 30 days.

12. Whether the Transport Allowance is admissible in case whether the period of suspension has been treated as period spent on duty.
11-12. Transport Allowance has been granted to suitably compensate the cost incurred on account of commuting between the place of residence and the place of duty. As the suspended employees do not attend office during suspension, no Transport Allowance may be paid during such period, irrespective of its duration, even if the period is later treated as duty.

ANNEXURE II
CLARIFICATION FOR CASES ARISING ON OR AFTER 24.11.2003

Admissibility of Transport Allowance during absence from duty due to leave, training, tour etc.

Absence from duty means absence from Headquarters/place of posting due to any of the reasons such as leave, training, tour etc. if a Government servant is absent from Headquarters/place of posting for a full calendar month, he will not be entitled to any Transport Allowance during the calendar month. If the absence covers more than one calendar month, it will not be admissible for calendar month(s) wholly covered by the absence. If the absence does not cover any calendar month(s) in full, Transport Allowance will be admissible for full month.

Transport Allowance during training treated as duty:-

Transport Allowance may be granted during such training period, if no transport facility/TA/DA is provided for attending the training institute. During official tour in the training course, the allowance will not be admissible when the period of the tour covers the whole calendar month. Also, during training abroad, no Transport Allowance will be admissible when the period of such training covers the whole calendar month.

Transport Allowance to Members of Special Parties who are on inspection duty within the city but exceeding 8 Kms. From Headquarters or where the officials are continuously on field duty either in or outside the Headquarters:-

Transport Allowance is given to compensate for the expenditure incurred for commuting for both to and fro between the place of duty and residence. In case when one gets road mileage daily allowance or free transportation for field duty/inspection duty or tour for a period covering the whole calendar month, he will not be entitled to Transport Allowance during that calendar month.

Transport Allowance to vacation staff i.e. school teachers:-

Vacation staff is entitled to Transport Allowance provided they are not granted free transportation and all other conditions governing the allowance prescribed in the general orders dated 16.12.97 are satisfied. During vacation, the allowance shall not be admissible when such vacation spell, including all kinds of leave, envelops the entire calendar month(s).

Transport Allowance during suspension:-

As a Government servant under suspension is not required to attend office, he is not entitled to Transport Allowance during suspension where suspension covers full calendar month(s). This position will hold good even if the suspension period is finally treated as duty. Where suspension period covers a calendar month partially, Transport Allowance payable for that month shall be reduced proportionately.

Admissibility of Transport Allowance during tour:-

No Transport Allowance will be admissible where tour covers a full calendar month(s). Where tour covers any calendar month in part, Transport Allowance will be admissible for full calendar month.
