gives the details of U.S. District Judge Thomas Hogan's ruling to
dismiss Bode's lawsuit which kept the NSF from spending the approx $62
million in the Infrastructure fund. This money came from the $30 per
registration collected by NSI.

Judge Hogan ruled that the law passed by Congress this year which
authorized this fee meant that the fee would no longer be considered an
illegal tax - and mooted Bode's suit.
