Inquire of ECCN/LE of Debian 6.05

Dear the person in charge,

Could you please provide the ECCN and License Exception of "Debian 6.05"?
We need bothe information of export control in order to export technical information.

Does this mean you (Debian) doesn't have the ECCN certified by BIS?
Do we need to confirm the specification of your product by ourselves?

Correct, Debian has not requested an ECCN certification from the BIS.
Debian does export its software under the TSU exception as described in CFR
740.13(e), including the provisions for notification to the BIS of
publication URLs until recently (when the BIS informed Debian they had
sufficient information and asked us to stop proactively notifying of new
software versions).

If you are intending to export products from the US that include the Debian
OS, then it would appear you would need to confirm this yourselves, yes.
Since you appear to be based in Japan, I don't understand why you would need
an ECCN certification from the BIS. Does Japan not have its own process for
ECCN determinations under the Wassenaar Arrangement?

Japan has its own process for export control under theWassenaar Arrangement.
However, US regulations require the we (even though located outside US) need to confirm the ECCN under US regulations in the case of that we export US origin product (technical information) from our country (outside US) to other country.
This is the reason we request the ECCN information to you.

Not precisely correct. (不正確な表現と理解です)

Japanese regulation allows us to use ECCN etc. as the base for the legal
compliance verification for imported products to be re-exported when you
make decision. Having ECCN is an option but not the absolute
requirement as I understand.

Basically, Japan has the very similar law. (日本の法状況は米国に非常に似ています)

Basically, you have to make decision using anything available. We are
volunteer project.

つまり、お金を払った業者にはサービスとして必要資料への協力を要求できますが、我々は
売っているわけではないのでこれは受けられません。日本の法律は、必要な専門家を使い適
法性を調査しご判断下さいということです。ECCNは十分条件として使えるかもしれませんが、
必要条件でははありません。

ご連絡ありがとうございます。
先日御社に問い合わせさせて頂きました、行政書士長尾利恵子と申します。
I am afraidというのは、私の言葉ではなく、どのような意味でお使いか分かりかねますが、
念のため、確認のご連絡を致します。

今回のご質問の背景として、日本の法令上の輸出管理につきましてはこちらとしましては、問題なく判断できております。
しかし、米国再輸出規制の観点から、ECCNを確認した次第です。
こちらの理解としまして、日本の大手メーカー様もそうですが、
米国原産品については、米国外であっても、ECCNを確認し、輸出するという法制度として実務上行っております。
たぶん、BISかどこかの法令を見て頂ければ、その旨が記載されております。(そもそも米国の法令が原因です)
域外規制(Extraterritorial Control)というようです。

Dear Mr Aoki,

I send this e-mail in order to let you know the background of our request. I write this in English.
We know Japanese regulations and can solve the issues of Japanese laws.

We needed the information in order to be subject to the US Export Administration Regulation.
We are asked by a Japanese big company to confirm the ECCN of you product.
Please be informed the term of "Scope of the Export Administration, Part 734.2(b)".
This is the reason we requested your information.

US regulation has very unique term called as 域外規制(Extraterritorial Control).
I am pretty sure that many US local companies are not familiar with this control because they located in US are not within the scope of this control.

The US Export Control regulations mention as below,

"Scope of the Export Administration, Part 734.2(b)"

(4) Definition of reexport.
“Reexport”means an actual shipment or transmission of items subject to the EAR from one foreign
country to another foreign country; or release of technology or software subject to the EAR to a foreign national outside the United States, as described in paragraph (b)(5) of this section.

Your staff explained the current status therefore we could understand your product not have the certified ECCN.
