Dear Linbro Park,

 

                                 Kindly note the report from the Attorney handling the Putco Bus matter.

For those of you who are not familiar with the time limits in the Rules of the Superior Court Act, the following is applicable:-

 

  1. Service of Application by the Sheriff on the 23rd February 2018;

 

  1. Notice of Intention to Oppose served on the 28th February 2018;

 

  1. The Respondent must deliver its Answering Affidavit no later than the 22nd March 2018;

 

  1. Thereafter, the Applicant is, if deemed necessary, entitled to deliver a Replying Affidavit to deal with those issues raised by the Respondent in its Answering Affidavit;

 

  1. The Applicant will then apply for a date on the Opposed Roll at Court and Set the Matter Down for hearing subject to Heads of Argument and Counsel’s Practice notes being served and filed by both the Applicant and the Respondent.

 

Three people have responded to my invitation to draft Supporting Affidavits to the above Replying Affidavit, if deemed necessary. I have requested those residents and also invite any others to:-

 

  • Set out the facts and circumstances why the owner of Plot 46 Oak Avenue should be interdicted from continuing to allow Putco Bus access to Linbro Park and to park is vehicles on Plot 46;
  • Your individual experiences regarding the above and your reasons for wishing them gone !
  • Set out the above in your own words and send them to me at sjt...@iafrica.com.
  • I will put them into Affidavit format for your approval and signature before a Commissioner of Oaths.
  • They can then be provided to the Applicant’s Attorneys for inclusion in the Replying Affidavit.

If you want to get rid of Putco from our suburb, you must be prepared to support this initiative which the LPCA has forced the COJ to implement under threat of a Mandamus. (Applications to force public authorities to do their job).

  1. The respondent has served us with their notice of intention to oppose on 28 February 2018, we anticipate receipt of their answering affidavit which is due on the 22 March 2018.

 

  1. Please be advised that should we fail to obtain their answering affidavit by 22 March 2018, we will have to obtain a new date for hearing of the matter on the unopposed roll.

Viva Spencer. Now can we do a similar thing with Pikitup and its appalling arrogance re the landfill site. 
 
As one of the long serving Linbro members of the Enviro Monitoring Committee I believe I am a member of the LPCA via sweat equity. 

Pikitup is in breach of its permit conditions by having no proper fencing on the Linbro site and leaving the site unrehabilitated in spite of having received a promised from Zero to do such rehabilitation in exchange for dumping the Discovery headquarters millions of tonnes of sand on OUR site for FREE.
