BUT WHAT ABOUT EQUAL WAGES FOR US?

THE NOTIFICATION FOR ENGAGEMENT DID NOT HAVE THE ILLEGAL TERMINATION
CLAUSE. NEITHER WAS TARGETS MENTIONED NOR LINKING OF ANNUAL INCREMENT
WITH VARIABLE PAY EARNING.

ASK LICI TO FURNISH THE NOTIFICATION FOR ENGAGEMENT OF SMEs.

FURTHER THE EMPLOYER DECIDES UPON THE ROLE TO BE PERFORMED BY AN
EMPLOYEE AND THE POWERS TO BE GIVEN TO HIM/HER. SME's ARE PERFORMING
THE ROLES ASSIGNED TO THEM.

ASK LICI MANAGEMENT THAT ARE THE SME'S NOT CAPABLE OF FUNCTIONING AS
AO'S or BM's?

WE ARE MORE CAPABLE THAN MOST OF THESE AO'S AND BM'S.

THE FACT IS SME's ARE BM'S ON CONTRACT AS PER THE NOTE EXTRACTED FROM
RTI WHICH ALSO CLEARLY STATES THE OPTION TO ABSORB THEM MAY BE
CONSIDERED.

THE PRESENT PMO GRIEVANCE REDRESSAL SYSTEM IS SIMPLY FORWARDING THE
GRIEVANCE MADE BY THE COMPLAINANT TO THE PARTY WHO IS THE CAUSE OF THE
GRIEF, THE RESPONDENT AND THEN JUST FORWARDING BACK THE REPLY MADE BY
THE RESPONDENT TO THE COMPLAINANT. IT DOES NOT LOOK WHETHER THE
GRIEVANCES HAVE BEEN SORTED OUT OR NOT.

AND THEN YOU SIMPLY CLOSE THE GRIEVANCE ADDING SALT TO INJURY.

AND THIS ADDS UP TO YOUR STATISTICS THAT SO MANY GRIEVANCES HAVE BEEN
SOLVED DURING THIS YEAR.

A GREATER ROLE IS DESIRED.

WE ARE WRITING TO THE HIGHEST EXECUTIVE IN THE COUNTRY, THE PRIME
MINISTER. PLEASE DON’T DILUTE THE PMO’S POSITION.

Respected Sir / Madam,

I am thankful to you that the grievance has been forwarded to LICI
Central Office on 16.11.2015, exactly a month ago, and LIC is yet to
get back to your office with any sort of communication.

But, some developments in the interim period within our organisation
needs to be brought to your kind attention so that you can promptly
intervene.

LICI has brought out a circular for the continuation of SME's (Senior
Marketing Executive) employed in the Bancassurance & Alternate
Channel.

It clearly states that a certain business target has to be achieved
for continuation as SME. And the parameters for achieving variable pay
are also spelt out. I am attaching circular no. 56-2015-SMEs for your
ready reference.

Now, our objection is we are equivalent to Branch Managers, though on
contract, as evident by the NOTE PLACED BEFORE THE LICI BOARD, prior
to our recruitment. This was extracted through RTI.

We have to oversee business, which is to be procured by the Corporate
Agents, mainly Banks, allocated to us through a team of FSE's
(Financial Service Executives). Now, how can we be punished for the
failure of others. The Bankers are not reporting to us and they have
no such accountability. They may or they may not solicit & procure LIC
premium. IT IS NOT A QUESTION OF LIFE & DEATH FOR THEM.

Moreover, our permanent colleagues in our channel doing the same job
function have no such targets and they don't face any risk of losing
their jobs.

HOW MANY OF THE BRANCH MANAGERS IN CHARGE OF LIC BRANCHES SHALL LOSE
THEIR JOBS IF THEY FAIL TO ACHIEVE THEIR BRANCH TARGET THIS FINANCIAL
YEAR?

I can forecast there will be at least 10% branches who won't be able
to achieve their targets this fiscal year out of our 2050 odd
branches. THERE IS DEGROWTH IN BUSINESS.

THE CORPORATION ALSO WILL CERTAINLY NOT ACHIEVE ITS BUDGET OF Rs
31,000 crore and 3.00 crore Policies for FY 2015-16.

We have been living on the threshold for five years and have survived
because of having achieved the set targets. But one failure and you
are jobless with a family to support. Is this policy justified?

There is a cadre in LICI, the Development Officers, who work on cost
basis. But they can survive and continue to work on achieving 5 times
their annual salary and that too they are given three years before
termination.

WE DON'T KNOW WHAT IS THE BASIS OF SETTING OUR TARGETS EVEN AFTER 6 YEARS.

I seek your prompt intervention so that LIC stops seeing us as SUPER
HUMANS or ROBOTS who can bring in NEW FIRST YEAR PREMIUM INCOME (FYPI)
relentlessly.

IT'S LIKE SCORING A TON EACH TIME YOU COME OUT TO BAT ON THE CREASE.

Forgive me, but this is the situation we are in. We cannot live,
cannot smile, have no personal life. The only goal in our lives is to
collect premium and save our job. We have a fixed incentive (variable
pay) ceiling, to achieve that is also next to impossible. If we
achieve 75-100% of variable pay, then only we are eligible for
increments, otherwise not.

I AM 44 YEARS NOW. OTHERWISE I WOULD HAVE QUITTED THIS SYSTEM. THIS IS
A CHAKRAVYUH AND THE SME AN ABHIMANYU.

ABSOLUTELY INHUMAN PRESSURE AT THE WORKPLACE.

ONLY LORD KRISHNA CAN SAVE US. SO I WROTE TO SHRI NARENDRA MODIJI, OUR
MODERN DAY REINCARNATION OF THE LORD.

Further, LICI is recruiting AAO'S. THESE 700 ODD NEW RECRUITS shall
reach the AO/BM CADRE in LIC after 7-10 years. WHY NEGLECT 45 OF US
WHO ARE SUCCESSFULLY COMPLETING 6TH YEAR IN THE AO/BM CADRE?

I admit LIC took us on contract. But cannot it accommodate 45 of us,
who have proven their capabilities and loyalty to the STATE (LIC is a
State) over the last almost 6 years and who are revenue earners having
collectively brought in nothing less than Rs. 500 crores plus of FYPI,
iN A WORKFORCE OF 1.15 LACS.

Moreover, almost all of us are Management Post Graduates and are an
asset to any organisation. WHY ALLOW STATE'S HUMAN RESOURCES TO DRAIN?
MY CV IS ENCLOSED HEREWITH.

When SBI, CANARA BANK & GOVERNMENT OF NCR can confirm their
CONTRACTUAL EMPLOYEES, why do we remain deprived? THE FILES ARE
ATTACHED.

SEEKING YOUR PROMPT INTERVENTION. LICI IS A MASTER AT THE ART OF
DRAGGING THINGS. OUR SECOND TERM OF THREE YEARS ENDS IN MARCH / APRIL
2016. PLEASE TRY RESOLVING OUR ISSUES WITHIN THIS TIME FRAME.
I PREFER THIS ROUTE OVER LITIGATION.

Respected Madam,

I grab this opportunity of wishing you and your family, friends and
team members at the Union Government a very Happy Navratris.

I am really happy for my permanent colleagues in LIC of India, who
have got a Puja gift in the form of an acceptable wage revision, now
sent to the Union Government for approval.

But, I would like to request my organisation through the present
Government of India, that please do not ignore us and reject our plea
for equal wages and Right to work till age 60 as contractual employees
in LIC, if the management is so adamant to not absorb us.

Through an RTI Application, I had got hold of extracts of the board
meeting and the notes placed at the board meeting by ED (Personnel)
that led to our recruitment. Both these documents are attached
herewith.

The note clearly states that we are in the AO / Branch Manager cadre
as is clearly and ours is a purely Marketing Assignment and that too
in specialised channels of Direct Marketing, Bancassurance & Alternate
Channel, P & GS & CLIA channels, requiring a special skillset and it
is due to the organisation's lack of quality manpower and so the need
to recruit laterally people with previous work experience and there
may be the option to absorb them.

We all have successfully completed five years in LIC. Most of the SMEs
are currently working for a pittance, without any increment since
joining as is evident by the salary component letter attached
herewith.

We had been recruited at a fixed annual CTC of Rs. 4.20 Lacs, i.e.
35000/- per month, inclusive of Employee's PF contribution & Gratuity.
There also exists the opportunity to earn sales incentive with an
upper cap of Rs. 180000/- per annum.

The variable pay component is earned subject to achievement of certain
sales target, which are really stringent, may be termed as impractical
and harsh, seeing the variable pay earning figures of us, Sr.
Marketing Executives (SMEs), over the last 5 financial years. Linking
of annual increment to percentage of variable pay earned has also not
helped us. Very few people amongst us have got increments.

This variable pay earned by each surviving SME can readily be demanded
from the Management. You can also collect the circulars related to
variable pay earning. And also if you demand the sales achievement of
permanent marketing officials along these lines/parameters in the
corresponding period of F.Y. 2010-11 to F. Y. 2014-15, you will
yourself have a correct idea of how LIC has been cruel and prejudiced
to this set of 45 odd surviving species, called Sr. Marketing
Executives.

Thus, LIC has got hold of a low cost workforce using its highly
unequal bargaining power, who are being used to run and run for their
survival. I don't know whether this tantamounts to exploitation or
not.

It would not be out of context to share that we had approached the
Hon'ble State Finance Minister, Govt. of Maharashtra, Shri Sudhir
Mungantiar jee, in May, 2015. He recommended our issues to be
considered favourably to Hon'ble Union Finance Minister, Shri Arun
Kumar Jaitley jee. His recommendation is also attached herewith.

But, since we could not get relief from an adamant management, we
approached the public grievance portal. And the accompanying letter to
our Hon'ble PM, Shri Narendra D. Modi jee is also attached, wherein I
have raised certain basic issues about can a State shun its role of a
Model Employer and carry on such conduct.

OUR PLEA:

We are in our 6th year as BM on contract.

So, our fixed wages should be in the pay scale of:
Basic pay for AO
Existing: 23120-840(7)-29000-910(6)-34460
Proposed: 43900-1600(7)-55100-1735(6)-65510
Our revised basic should be: Rs. 51900/-, with five increments of
1600/- per annum.

Along with other allowances like DA, HRA, CCA, TRANSPORT ALLOWANCE,
CASH MEDICAL ETC. as spelt out on page 1 of the union offer, also
attached herewith.
That too with retrospective effect.

I believe it is your office that can make LIC management see reason
and change its attitude and mindset towards us. It is not our fault
that we have been recruited laterally and the Class I officers body
might not have liked this decision. And our suffering continues
unabatedly.

Ideally, you should call both of us, the SMEs and the LIC management
to your office and solve these issues for once and all. We are proud
citizens of the world's largest democracy and a Democracy's basic
principle is "Government of the people, by the people, for the
people".

And for this act of yours, I shall ever remain grateful.

Respected Sushree Mamta Banerjee ji, our Hon'ble Chief Minister of
West Bengal, I take this opportunity to wish you a very Merry
Christmas.

I have been trying to get relief from our State run institutions, but
have been increasingly disillusioned as the system has failed to get
us relief.

You have been a tigress all your life. I am looking up to you as our
last savior, in fact as our Santa Claus.

We are contractual employees working with the State owned Life
Insurance Corporation of India for the last six years.

We have approached everyone from our Hon'ble President of India, Shri
Pranab Mukherjee ji, our Hon'ble Prime Minister of India, Shri
Narendra Modi ji, but failed to get any relief.

BY DENYING US, LICI HAS BEEN VIOLATING THE FOLLOWING FUNDAMENTAL
RIGHTS GUARANTEED BY THE CONSTITUTION OF INDIA:
1. Right to equality: This includes equality before law, prohibition
of discrimination on grounds of religion, race, caste, gender or place
of birth, and equality of opportunity in matters of employment,
abolition of untouchability and abolition of titles;
2. Right against exploitation: Which prohibits all forms of forced
labour, child labour and traffic of human beings;
3. Right to constitutional remedies: Which is present for enforcement
of Fundamental Rights;
4. Right to life: This gives the right to live with human dignity.
This includes rights such as right to clean environment, water,
education, health, livelihood, shelter and basic amenities that the
state shall provide.

OUR DEMANDS ARE ONCE:
1. EQUAL PAY AND PERKS FOR EQUAL WORK AS BRANCH MANAGERS SINCE
OUR JOINING IN MARCH/APRIL 2010 AND RECEIVING OUR ARREARS;
2. RECOGNITION OF OUR EFFORTS AT THE WORK PLACE;
3. REMOVAL OF THE TERMINATION CLAUSE;
4. RIGHT TO LIVELIHOOD TILL AGE OF SUPERANNUATION EVEN AS CONTRACTUAL EMPLOYEES.

As a last resort, I am approaching you to help us.

I am sending you all the communications made with the PMO till date
along with supporting documents.

I SEEK YOUR PROMPT PERSONAL INTERVENTION IN GETTING JUSTICE FOR US BY
