独立行走还是买根拐杖？

大家好，原谅我选择用中文，脑子累了，不想用第二语言。

周一老罗和我参加了JAY的朋友推荐的AABANY主办的WORKSHOP，主题是Changing the World One Charity
at a Time- Setting Up a New Nonprofit: Considerations and
Alternatives，受益匪浅。

三个人发言，第一个说如何在州申请成立NFP组织，第二个说如何获得联邦免税，第三个说如何获得州及地方免税及成立NFP组织的其他选择，历时两小时。

一直以来我认为只要我多花时间，一定能够做到，一次不行两次好了，但听完讲座，我投降了：专业的律师团队来做也要花半年到一年的时间，还不一定成功。而纽约州对NFP组织成立尤其严格，迫使很多组织转向其他州。但其他州的组织也要在纽约REGISTER，这里面的机关太多。如果网络筹款，几乎每个州都要REGISTER。

会后和老罗交流，我们都对是否还要成立自己的NFP产生疑问，如果不成立，我们可以选择挂靠在其他已成立的NFP上作项目。我很灰心，我不知道要等到什么时候组织才能成立运营。不成立自己的组织我们也能帮助那些孩子，不是吗？

刚刚看到MITBBS上的OCEF俱乐部，这个成立于1992年的组织2002年通过了IRS的免税申请http://www.ocef.org/。

我现在的想法是，先挂靠个组织吧。

听说会议提供了很多资料，有没有办法让我们这些没有办法参加会的人也学习一下。

也许了解美国这个国家的分工与工作的专业性是我们能够在这个国家更好生活的一个起点吧。

谢谢charmine的会议总结。

美国似乎不存在挂靠一个组织的说法，我们如果挂靠一个组织，那是不是我们开展任何项目都一定要经过他们的审批，没法独立筹款，很多不便之处。

我一开始没有料到注册这一块会遇到这么多困难。下周我回纽约了会去sba或者华策会再咨询一下。我的意思是大家不要轻言放弃，再多试一次。专业团队需要半年时间注册，很有可能指的是这个注册的过成本来就是最少需要半年时间。

帮助那些小孩子当然可以直接私人捐助，但是那样就没有持续性，而我们的初衷是有系统的去做一些别的ngo没有怎么cover到的项目。这个就需要我们自己的组织。万事开头难，大家再多bear一下。

其实成立组织可以慢慢做，可以从自愿者活动做起，然后活动做多了再成立组织。这样既有一定的活动经验，又会有一点的社会影响力。对于将来申请的时候，无论对于定位，还是材料上面都会更丰富

我们再试试看看能不能注册先，不行的话也只好这样，主要是我们服务的对象都在中国，而大家都在美国，只能靠捐钱，如果没有注册的话是没法筹款的。

大家好：  其实在美国最厉害的政府部门是IRS， 最敏感的也是tax的问题。 所以要成立一个tax-deductible foundation 是会难一点。 他们会斟酌你的目的， 用意和社会意义在哪里。  严格来说， 如果我们基金会的title和mission完全只是focus on 中国issue的话，他们也会hesitate to support。  因为毕竟是美国国民tax payer‘s money。 那些美国的很多基金会他们成立时的宗旨多半是one or more causes geard for worldwide coverage。 然后在具体做的时候你focus on 比如讲哪个国家或地区那就没事。

 

如果没有fund 来hire lawyer的话， Jie 说的先把事情做一点再说， 是ok的方法， 做的process 中会又more ideas， inspiration and focus 会become clearer。 这样also helpful to filing the Org。。。

我有一个想法，不知道能不能行得通。原来我在学校的时候，我们学校有个社工社团，我也是成员。包括本科生和研究生，社团基本上是筹款服务社区的。我想，如果我们只是单纯的“合法筹款”的问题，我们是不是可以和学校社团合作，就是让他们建立一个专门的项目活动，然后我们作为自愿者参与，我们就可以利用这个社团合法筹款。所有事务我们自己管理和规划。而且，我们还能得到这个社团指导教授的帮助。就是可以让社团的学生参与，他们可以增长经验。

大家商量一下，如果有意向，我们可以和教授约个时间，一起去问问有没有办法这样做。对了，我是Long Island University, C.W post campus 社会工作硕士毕业的。

而且，这个指导教授对非盈利组织方面的政策非常了解，曾经更改过Nassau区的法律。我觉得可以试一试。

我也赞成双管齐下。

注册我会慢慢摸索着做，但是大家不能太指望着我。这个过程比我原先预计的还要复杂繁琐冗长，如果大家要等我这边注册完了再做项目，就不知道猴年马月了。

眼下已知的注册最大问题是purpose怎么写。按纽约州的规矩，purpose一旦定了，就不能变，除非成立新组织。这个purpose不能太宽，不能太窄，还要像Maggie说的，最好不要指定一个人群。从purpose上引申，我觉得这个组织名字也要改改，从foundation开始比较好，一来比较容易获批，二来也算是一个实验品。有经验了以后再成立其他的。
