Re: Complaints about the Unauthorized Use of the Public/Common Areas at Mezzanine Floor (M/F) of Lee Tai Building at 101-107 Prince Edward Road, Kowloon, Hong Kong and/or Other Public/Common Areas of Lee Tai Building by the Owner/Tenant of G/F and M/F of Lee Tai Building and/or Other Relevant Owners/Tenants of Lee Tai Building and Complaints about the Noises and Vibrations caused by the Owner/Tenant of G/F and M/F of Lee Tai Building and/or Other Relevant Owners/Tenants of Lee Tai Building [檔案編號:2-4933763902 (assigned by 1823)] [檔案編號:EP3/K03/RE/00034760-18 (assigned by EPD)] The case number assigned by The Ombudsman is OMB2019/1791. 投訴太子道西101-107號利泰大廈地下食肆抽風系統 (檔案編號:2-4933763902 assigned by FEHD)

To: THE GOVERNMENT OF THE HONG KONG SPECIAL ADMINISTRATIVE REGION including, but noy limited to, the Developmen Bureau (https://www.devb.gov.hk/en/home/index.html), the Fire Services Department (FSD), the Food and Environmental Hygiene Department (FEHD), the Buildings Department (BD), National Security Department and Hong Kong Police Force etc.

With respect to all the matters relating to the captioned and/or mentioned in my previous e-mails sent to you from December, 2018 onwards, I hereby confirm again that I would only pursue those complaints which do not violate any law. In other words, I would not pursue any complaints/matters which may/would violate any law.

With reference to my previous relevant e-mails and the attachments attached to them sent to you from 2018 onwards, my subsequent e-mails and the attachments attached to them to be sent to you and the attachments attached to this e-mail including, but not limited to, the photos sent to you previously or attached to this e-mail and those photos to be sent to you via my subsequent e-mails and copies of the relevant e-mails and/or letters from the government dapartments, and the relevant laws and code of practices etc. and with respect to the captioned and the related matters, I have been requesting you to note the following and respond to the following properly:

1. As you should know, as per the relevant laws and Codes of Practice etc., parts of which are quoted near the end of this e-mail, there must be proper Means of Escape and Means of Access/Exit Routes/etc. for Lee Tai Building and they must lead to the ultimate place of safety. As it is stated in the relevant parts/sections/subsections of the Code of Practice for Fire Safety in Buildings 2011 revised in October 2015 (hereinafter referred to as the Code of Practice) including, but not limited to, Subsection A8 of Section 2 (Performance Requirement) and Section 3 (Definitions) of Part A (Introduction) and Part B (Means of Escape) etc., "Ultimate place of safety"  means a place of safety for final exit discharge where a protected exit terminates that provides access to an area clear of the effects of fire, where people may safely disperse and such ultimate place of safety is a street or an open area outside the subject building and connects directly with a street, with a width not less than 1.5m wide or the total required width of exit routes discharging into the area, whichever is greater, from which occupants can safely disperse away from the subject building. As per Table B2 of the Code of Practice, the total required width of exit routes for Lee Tai Building is 2100mm (2.1M).

The service lane/scavenging lane at G/F between Lee Tai Building and Tong Mei Road Children's Playground (塘尾道兒童遊樂場) (hereinafter referred to as the/such scavenging lane) as shown in photos listed in subsection 1.e. below in this e-mail is not an ultimate place of safety as per the Code of Practice mentioned above, as such scavenging lane does not meet the requirements for being an ultimate place of safety as per the Code of Practice for reasons as follows:

1.a. As I have been sending photos showing the conditions of such scavenging lane to you via e-mails from 2019 onwards, you must know that, since very long time ago, such scavenging lane has been being obstructed by obstructions including, but not limited to, goods such as timber materials and door frames etc., unknown items with combustible materials, motorcycles, refuses, refuse bins and bamboos etc. as shown in the photos attached to my previous e-mails, this e-mail and/or the subsequent e-mails to be sent by me to you. It is clear that the Hong Kong SAR government is unable to prevent such scavenging lane from being obstructed in the way just mentioned and there is no good reason for us to believe that the Hong Kong SAR government is able to prevent such scavenging lane from being obstructed in the way just mentioned in future, as I have been reporting such obstructions to you for three years or so but such scavenging lane is still being obstructed. Many of such obstructing items are combustible and therefore risks of injuires or death of people escaping from any fire accident in Lee Tai Building arises from such obstructions. It would be crazy to presume that such scavenging lane is not obstructed for the approval of the relevant applications/submissions, because, actually, such scavenging lane has been being obstructed from time to time or continually and therefore such scavenging lane is not clear of the effects of fire as per the Code of Practice mentioned above.

1.b. As shown in the photos listed in subsection 1.e. below in this e-mail, there is no fire/smoke separating structure/wall between the air conditioning/ventilation system of 富臨集團的正冬火鍋料理 at Mezzanine Floor (M/F) of Lee Tai Building shown in the photos listed in subsection 1.e. below in this e-mail and the scavenging lane at G/F mentioned above and therefore, in case of fire accident arising from the air conditioning/ventilation system of 富臨集團的正冬火鍋料理 at Mezzanine Floor (M/F) of Lee Tai Building, the fire, smoke and/or heat arising from fire accidents of such air conditioning/ventilation system may spread to such scavenging lane at G/F and cause injuries and/or death of people escaping along such scavenging lane at G/F from the fire accident. Also, it is possible that the water tower of such air conditioning/ventilation system at Mezzanine Floor (M/F) of Lee Tai Building shown in such photos (particularly, the photo named 'Air Conditioning and Ventilation System of 富臨集團的正冬火鍋料理 at MF of Lee Tai Building (6)' would collapse onto such scavenging lane, as the steel frame supporting such water tower may melt due to high temperature arising from fire accident.

1.c. As shown in the photos listed in subsection 1.e. below in this e-mail, the width of some relevant parts of the scavenging lane at G/F mentioned above are reduced by the lamposts, door leaves of doors at G/F opened to/along such scavenging lane, steel frames, pipes and air duct etc. protruding from Lee Tai Building or other buildings along the scavenging lane at G/F mentioned above and/or the obstructions mentioned above to such an extent that such width is less than the minimum width required as per the Code of Practice mentioned above.

In case of fire accidents, people would rush through such scavenging lane at G/F. If any of the doors shown in the photos listed in subsection 1.e. below in this e-mail (or as shown in the photos attached to my previous e-mail, this e-mail and/or my subsequent e-mails to be sent to you) adjacent to such scavenging lane are opened in such situation, the people near the inner faces of the door leaves of these doors may be injured by the people who rush through such scavenging lane and attempt to close such doors as quickly as possible, as the people rushing through such scavenging lane may not be able to see the people near/adjacent to the inner faces of the door leaves.

1.d. As I have mentioned before, as it is stated in the copies of the letters from the Incorporated Owners of Lee Tai Building and/or Homechant Limited, the property management company for Lee Tai Building, which were sent to you via my previous e-mails to you and attached to my subsequent e-mail to be sent to you, the Incorporated Owners of Lee Tai Building and Homechant Limited expressed that there was fire accident arising from the air conditioning/ventilation system of 富臨集團的正冬火鍋料理 at Mezzanine Floor (M/F) of Lee Tai Building and the Incorporated Owners of Lee Tai Building did demand 富臨集團的正冬火鍋料理 to remove the relevant parts of such air conditioning/ventilation system at M/F of Lee Tai Building. Both the Incorporated Owners of Lee Tai Building and Homechant Limited, the property management company of Lee Tai Building, confirmed that there is no record or minutes of meetings which shows that the Incorporated Owners of Lee Tai Building consented to 富臨集團的正冬火鍋料理 using the Mezzanine Floor (M/F) of Lee Tai Building for installing the air conditioning/ventilation system mentioned above or any other purposes. While there is no evidence which shows that 富臨集團的正冬火鍋料理 has obtained consent from the Incorporated Owners of Lee Tai Building for using the Mezzanine Floor (M/F) of Lee Tai Building for installing the air conditioning/ventilation system mentioned above, there are clear evidences that show that the Incorporated Owners of Lee Tai Building did not and does not consent to 富臨集團的正冬火鍋料理 using the Mezzanine Floor (M/F) of Lee Tai Building for installing the air conditioning/ventilation system mentioned above or any other purposes, the copies of the letters from the Incorporated Owners of Lee Tai Building and/or Homechant Limited mentioned above being referred to.

By the way, we have not yet received the report of the fire accident mentioned above from FSD. As such, we would like to request FSD to send us such report as soon as possible.

I would further elaborate on the fire risks and problems relating to the air conditioning/ventilation system mentioned above at the Mezzanine Floor (M/F) of Lee Tai Building below. Of course, they are related to the matters mentioned above.

2. The staircase leading to the scavenging lane at G/F mentioned above from 1/F of Lee Tai Building as per the Occupation Permit Drawings (OP drawings) of Lee Tai Building and as shown in the photos listed in subsection 2.d. below in this e-mail (hereinafter referred to as the staircase leading to G/F from 1/F) is not a proper Means of Escape and Means of Access/Exit Routes/etc. or part of them for reasons as follows:

2.a.  The service lane/scavenging lane at G/F between Lee Tai Building and Tong Mei Road Children's Playground (塘尾道兒童遊樂場) (hereinafter referred to as the/such scavenging lane) as shown in photos listed in subsection 1.e. in this e-mail is not an ultimate place of safety as per the Code of Practice mentioned above, as such scavenging lane does not meet the requirements for being an ultimate place of safety as per the Code of Practice for reasons mentioned above and below. As such, the staircase leading to G/F from 1/F does not lead directly to an ultimate place of safety as per the Code of Practice mentioned above.

2.b. There is no fire/smoke separation structure/wall between the staircase leading to G/F from 1/F and the air conditioning/ventilation system of 富臨集團的正冬火鍋料理 at Mezzanine Floor (M/F) of Lee Tai Building as shown in the attached photos listed in subsection 2.d. below in this e-mail. Therefore, in case of fire accident arising from the air conditioning/ventilation system of 富臨集團的正冬火鍋料理 at Mezzanine Floor (M/F) of Lee Tai Building, the fire, smoke and/or heat arising from fire accidents of such air conditioning/ventilation system may spread to the staircase leading to G/F from 1/F and cause injuries and/or death of people escaping along staircase leading to G/F from 1/F from the fire accident.        

Anyone who understand the relevant building design would know that, if the fire/smoke separation structures/walls mentioned in 1.b. and/or in this subsection 2.b. are to be erected, large parts of the air conditioning/ventilation system of 富臨集團的正冬火鍋料理 at Mezzanine Floor (M/F) of Lee Tai Building as shown in the photos mentioned above must be removed, as they obstruct the erection of such fire/smoke separation structures/walls at M/F, and there would not be sufficient space in Lee Tai Building for installing such large parts of the air conditioning/ventilation system.                            

Also, it is possible that the water tower of such air conditioning/ventilation system at M/F as shown in the photos mentioned above [particularly, photos named 'Air Conditioning and Ventilation System of 富臨集團的正冬火鍋料理 at MF of Lee Tai Building (6)', 'Staircase from 1F of Lee Tai Building to the Service Lane at GF (3) (No Fire Separation between the Air Conditioning and Ventilation System and the Staircase)' or 'Staircase from 1F of Lee Tai Building to the Service Lane at GF (4) (No Fire Separation between the Air Conditioning and Ventilation System and the Staircase)'] would collapse onto such staircase leading to G/F from 1/F, as the steel frame supporting such water tower may melt due to high temperature arising from fire accident.

2.b.1. Would you recommend any people to use the staircase leading to G/F from 1/F, when the fire, heat and/or smoke from the air conditioning/ventilation system of 富臨集團的正冬火鍋料理 at Mezzanine Floor (M/F) of Lee Tai Building arising from fire accident spread directly into such staircase?

2.b.2. Would you recommend any people to use the staircase leading to G/F from 1/F, when the water tower of the air conditioning/ventilation system at M/F as shown in the photos mentioned above is collapsing onto such staircase for reason mentionrd above?

2.c. Although the relevant fire dampers for the air conditioning/ventilation system at M/F as shown in the photos mentioned above may have been installed, it is possible that such fire dampers may fail during fire accident for reasons you should know well. As such, fire, heat and smoke arising from fire accident may spread from the parts of the air conditioning/ventilation system at M/F as shown in the photos mentioned above outside 富臨集團的正冬火鍋料理 at Mezzanine Floor (M/F) to the areas inside 富臨集團的正冬火鍋料理 and vise versa. Clearly, fire, heat and smoke from the parts of the air conditioning/ventilation system at M/F shown in the photos mentioned above arising from fire accident may spread directly to the fire escape staircase leading to G/F from Mezzanine Floor (M/F) of 富臨集團的正冬火鍋料理 in Lee Tai Building shown in the photos listed in subsection 2.e. below in this e-mail, because such staircase from M/F to G/F is not enclosed with fire/smoke separating structure/wall.

2.c.1. Would you recommend any people to use the staircase leading to G/F from M/F of 富臨集團的正冬火鍋料理 in Lee Tai Building mentioned above, when the fire, heat and/or smoke from the parts of the air conditioning/ventilation system at M/F as shown in the photos mentioned above arising from fire accident spread directly into such staircase?

2.d. Photos mentioned above are listed as follows:

3. The only way to eliminate the problems/fire risks mentioned above is to order 富臨集團的正冬火鍋料理 to remove the parts of the air conditioning/ventilation system at M/F as shown in the photos mentioned above by the relevant government departments/bureaus including, but not limited to BD, FSD and FEHD etc. according to laws, including, but not limited to, CAP. 123 Buildings Ordinance including, but not limited to, subsection 16(1)(d) of CAP. 123 Buildings Ordinance, Cap. 344 Building Management Ordinance and other relevant enactments for reasons I repeated many times.

It is stated in subsection 16(1)(d) of CAP. 123 Buildings Ordinance that:

16.Grounds on which approval or consent may be refused
(1)The Building Authority may refuse to give his approval of any plans of building works where—
...................
(d)the carrying out of the building works shown thereon would contravene the provisions of this Ordinance or of any other enactment, or would contravene any approved or draft plan prepared under the Town Planning Ordinance (Cap. 131);

4.  As I have explained to you many times, Protective Barriers as per APP-110 (attached to one of my subsequent e-mails to be sent to you) must be erected at Mezzanine Floor (M/F) of Lee Tai Building adjacent to the two staircases mentioned above and the scavenging lane mentioned above for reasons mentioned before. But BD insists that such Protective Barriers are not necessary on the ground that the area at M/F adjacent to the two staircases mentioned above and the scavenging lane mentioned above is deemed to be not accessible, as the access from the staircase from 1/F to G/F mentioned in subsection 2.b. in this e-mail to Mezzanine Floor (M/F) of Lee Tai Building does not comply with the relevant regulation/code. Such opinion of BD with respect to whether such Protective Barriers are necessary is not correct for reason as follows. Whether the access from the staircase mentioned in subsection 2.b. to Mezzanine Floor (M/F) of Lee Tai Building comply with the relevant regulation/code mentioned above is different from whether such area at M/F is accessible. Even if we assume that the access from the staircase mentioned in subsection 2.b. to Mezzanine Floor (M/F) of Lee Tai Building does not comply with the relevant regulations/code, such area at M/F can still be accessible. The photos listed in subsection 2.e. and the relevant video (sent to you previously and to be attached to one of my subsequent e-mails to be sent to you) showing such area at M/F are clear evidences with which we can prove that such area at M/F is actually accessible. because, if such area at M/F is not accessible, I would not be able to take those photos and that video and send them to you! I can easily enter such area at M/F via the staircase mentioned in subsection 2.b. above without any aid as shown in such photos/video. Bear in mind that most people would forget whether such access from the staircase mentioned in subsection 2.b. to Mezzanine Floor (M/F) of Lee Tai Building comply with the relevant law and some people like me may enter such area at M/F via the staircase mentioned in subsection 2.b. above anyway. There is nothing which can effectively prevent some people like me from entering such area at M/F via the staircase mentioned in subsection 2.b above. The relevant area is not accessible, only if there is some reasonable/effective means to prevent people without aid from entering such area! Be realistic!! Professional works must be based on actual situations and not on assumptions which turn out to be different from the actual situations.

Part A
Introduction

Clause A2.2
For every fire safety design, the following fire safety objectives should be met:
(a)
Life Safety
Fire safety provisions should be provided for:
1. protection of life of building occupants
2. minimization of fire spread between fire compartments
3. prevention of building collapse as a result of fire
4. facilitation of firefighting and rescue by fire services personnel

Section 2 – Performance Requirements

Subsection A8 – Means of Escape
Functional Statement for Means of Escape
Building (Planning) Regulation 41(1): Means of escape.
Every building shall be provided with such means of escape in case of emergency as may be required by the intended use of the building.

Performance Requirement B1
A building, fire compartment or storey should be provided with adequate means of escape for all occupants to evacuate safely without being overwhelmed by the effects of fire.

Performance Requirement B2
A building, fire compartment or storey should have adequate fire safety provisions to protect evacuating occupants from the impact of fire.

Performance Requirement B7
Means of escape for tall buildings should be appropriately designed to:
(a) allow occupants to take a short rest safely, whilst evacuating;
(b) minimise the threat of smoke within staircases; and
(c) provide an area for firefighting staging activities.

Subsection A9 – Fire Resisting Construction
Functional Statement for Fire Resisting Construction
Building (Construction) Regulation 90: Fire resisting construction.
Every building shall be designed and constructed so as to-
(a) inhibit the spread of fire within the building and to nearby buildings by dividing the building into compartments;
(b) provide adequate resistance to the spread of fire and smoke by the separation of different uses in a building by compartment walls and floors and by the separation of the building from any adjoining building or site;
(c) maintain the stability of the building in case of fire; and
(d) provide adequate resistance to the spread of fire over the roof of one building to another having regard to the position of the building.
Performance Requirement C1
A building should be provided with adequate fire safety provisions to inhibit the spread of fire:
(a) within a building;
(b) between buildings or other property;
(c) to allow occupants to evacuate safely; and
(d) to allow fire service intervention.

Performance Requirement C2
A building should be constructed to maintain its stability in case of fire to:
(a) allow sufficient time for occupants to evacuate safely;
(b) allow fire service intervention.

Building elements should have adequate provisions to minimise the spread of smoke.


Section 3 – Definitions

“Deadend travel distance” means the overall length of travel within an exit route before an alternative exit is available.

“Exit route” means the continuous path of travel from any part of a building to the ultimate place of safety, not including a revolving door, lift or escalator (see Diagram A2).

“Fire barrier” means the construction that has a fire resistance rating separating one space from another. It may form part of a fire compartment.

“Protected exit” means a required staircase, or ramp, or passageway, being enclosed by fire barriers, that leads to an ultimate place of safety.

“Required staircase” means an access staircase, whether in a firefighting and rescue stairway or not, or a staircase required for means of escape in case of fire.

“Special hazard” means a hazard that requires special consideration given the occupant awareness, knowledge of building, fire services systems installed, physical construction and location and width of exits, relative to the ignition risk, spread of fire, generation of smoke, heat or toxic gases that may endanger the life and safety of the occupants. Areas of special hazard have a relatively higher fire risk with regard to ignition. These areas include transformer rooms, central A/C plant rooms, lift machine rooms, main switch rooms, generator rooms, boiler rooms, dangerous goods store rooms, fuel tank rooms and the like.

“Ultimate place of safety” means a place of safety for final exit discharge where a protected exit terminates that provides access to an area clear of the effects of fire, where people may safely disperse. The ultimate place of safety is a street or an open area outside the subject building and connects directly with a street, with a width not less than 1.5m wide or the total required width of exit routes discharging into the area, whichever is greater, from which occupants can safely disperse away from the subject building.

Part B
Means of Escape

Section 1 – General

Performance Requirements on the provisions of means of escape are stipulated in Subsection A8 of Part A.

Clause B3.3
For situations not covered in this Part, the means of escape requirements will be determined by the Building Authority according to the circumstances of individual cases.

Clause B5.1
Every building to which this Part applies should be so constructed that there are available from each storey or fire compartment of the building such exits and exit routes as will comply with the requirements set out in this Part.
Clause B5.2
Every exit route should lead directly to an ultimate place of safety. Such exit route should not be closed with doors or gates unless such doors or gates are capable of being readily opened from inside and in the direction of the exit route without the use of key(s).
Clause B5.3
If an exit route leads to an open area at any upper floor levels of the building such as the podium level, instead of leading directly to an ultimate place of safety, the exit route at such floor level:
(a) should be adequately defined by permanent features e.g. handrail or railing;
(b) should lead to an ultimate place of safety; and
(c) should be designed and constructed as if it is part of the protected exit complying with the requirements in this Part and Clause C12.4.

Clause B5.4
In a building where there is an area of special hazard that is directly associated with an area of normal hazard, any opening from such area of special hazard into any exit route should be provided with a protected lobby. The exit route from the area of normal hazard should not pass through any area of special hazard.

Subsection B6 – Buildings with Only One Required Staircase
Clause B6.1
Pursuant to Clause B8.1, no building will be permitted to have only one required staircase unless such building complies
with the following requirements:

Every building, except those buildings permitted under Clause B6.1 to have only one required staircase, should be so constructed that there are available from each storey not less than 2 exit routes or such greater number as may be required by Table B2.
