School districts are facing significant challenges in ensuring that edtech vendors delete student data after contracts end, as federal and state laws require. As districts increasingly scrutinize their edtech portfolios because of budget constraints and privacy concerns, they are discovering that ending relationships with vendors can be more complicated than expected.

SmartTake: Vendor behavior has been in the news this month, with the notable story about Illuminate Education agreeing to a settlement to pay a $5.1 million fine and use better security practices after a 2021 data breach across 49 states that exposed millions of students' sensitive information.

Expect to see a slow but steady effort to tighten FERPA rules, perhaps making edtech companies instead of education institutions directly liable, as corporate attorney Lavanya Sathyamurthy suggests.
Maria Nava of Frankfurt Kurnit Klein & Selz notes that this is the first time California's K-12 Pupil Online Personal Information Protection Act and Connecticut's Student Data Privacy Law have been enforced: "The settlement serves as a reminder that data protection failures in regulated educational contexts can trigger overlapping enforcement under consumer protection, privacy, and cybersecurity statutes. It also highlights the increasing expectations for transparency, accurate representations, and proactive oversight in vendor contracts involving student data."
