The long and short of it:

In 2011 the local
probate court found my mother to be a
vulnerable adult and had her placed in a semi-assisted
care facility. At that time her estate
had a value of approx$500,000. She
passed away on 7/4/2013. Her estate at
the time of death was approx. $250,000

my sister and I receive a big surprise:
My brother's ex-wife told us that my mother had
written a will in 1988- leaving all her
estate to my brother. When I questioned
my brother about it, he said: "It was
written so long ago that it can't
possibly have any legal clout; I
can't even find it now and we all can
just forget about it!" Everything he
told my sister and I pointed to his
willingness to be fair with the estate.
A few days later, my
brother quietly went to an attorney and
sought to have the will upheld in court! That was during
the first week of July, 2013. My sister
and I hired an attorney to fight the
will. It took our lawyer A YEAR in mounting
legal fees, mostly in $250 per hour phone
calls and needless searches to finally
come up with evidence that my mother was
not mentally competent to write that will
in 1988. The evidence consisted of
statements from judges who knew my
mother, along with her mental health records during the
1980s.
My brother's lawyer finally realized during the first
week of last month (July 2014) that he had no case and my
brother agreed to settle the estate out of
court.


I contend that the evidence which destroyed the veracity or
the legality of that will was certainly available to both
lawyers in early July of 2013.

The continual postponement of the court dates to resolve
this matter, allowed both lawyers to drain
my mother's estate to the tune of
more than $50,000 with all their MAKE
WORK phone calls, dead end internet searches and other fees accumulated from 8/2013 to 8/2014
I am seeking re-imbursement of all the
unnecessary legal
