| My Dear Respected La Tropicana Association Members ,
Yesterday, I along with others have received an E-mail from an id LTRA Core Committee which was unnamed and not from authentic LTRA email id .... Let me appraise you all there is no such official LTRA email id but it is a mail id created by the group United to mislead by KK Modi & Manoj Mittal.
This mail talks about great work done by KK Modi as a President in his tenure of just 5 months. But this not true at all as KK Modi has never been functioning for the benefit of LTRA rather was using this Post and Office for his personal gains and for making contacts.
Few Disclosures & Explanations to their claims :
- KK Modi & Manoj Mittal has put LTRA at loss of Rs. 5,00,000/- by paying Advocate Gaggar an Advance cheque for Nothing & which still has not been used as he is not representing LTRA in any of the legal cases . Either they have conspired with Gaggar that the amount will be utilised for their personal cases or there is some Misappropriation done as paying Rs. 5 Lacs advance to an advocate without utilizing his services or just for drafting the 2 page complaint for EOW ( & the draft complaint was also rejected by the officers of EOW ) does not make sense.
When I raised this issue in the MC meeting in April and cross questioned them how did they pay such heavy amount and I demanded refund , they both denied that it cant be refunded back . Now just to save their faces they have come up with the idea of WRIT which is Self- destructive in nature and may attract Demolition and Sealing of the project even .
- Account Books and Minute Books not maintained so that no accounts could ever be tallied and Manipulations could be done as per their convenience and thats what they are doing. KK Modi was the president ( even after resigning was interfering in smooth functioning of the association ) , Manoj Mittal-General Secretary , Mukesh Gupta-Joint Secretary , Mr. Rajesh Gupta-Treasurer all are signatory and in majority in the Managing Committee of 7 members and are most responsible office bearers and even most accountable post holders in MC . Rather the MC was reduced to 6 elected Members after KK Modis Resignation because of which they still enjoy the Majority in MC .
Their Team members are in custody of all the Books and office of the association as the LTRAs office was the office of Mukesh Gupta, joint Secretary ( part & contesting elections from UNITED group )
They are doing all sorts of manipulations and still books are not even shown to the members at large and even to the remaining MC members . Last committee had done every thing very transparently and handed over the accounts each year unlike them.
- KK Modi and Manoj Mittal wasted 6 precious Months of our holding office by DEMANDING OBNOXIOUS / UNREASONABLE AMOUNT OF Rs.600 CRORES as PENALTY from PDL which we all know could never ever have been fulfilled . It is equal to demanding almost Rs.1.5 Crores for each Flat Bookings for which only Rs 85 Lacs (3 Bedroom) is paid, and fulfilling this demand was next to impossible.
This Demand is either from a Immature Mind or from a very Clever Mind who wanted to Black Mail PDL for personal gains and on association members Cost and expense.
- KK Modi and Manoj Mittal were always insisting and did few CLOSED DOOR MEETINGS with Top Bosses of PDL without our knowledge which was strongly opposed by ME & PANKAJ which actually became the point of Trigger of my agitation against these 2 . I objected that if there has to be any meeting then it shall bein-front of all elected MC members but they insisted in meeting in private where their Wrong Intention stood Exposed.
- KK Modi or Manoj Mittal never organised any open house at Shangrila Hotel just by them selves , it was the joint effort of the entire newly elected team of LTRA including Myself ie Mohit Aggarwal , Pankaj , Dr Vijay Shandilya and even Mr Chawla as for this we were persuading PDL top bosses for long , but because of Decorum and respect we let Modi and Manoj take the center stage and we remaining MC Members took other Important duties and responsibilities other than Stage, for which they are now seeking all the credit... but these people are not worth giving respect and due advantage ....
- KK Modi & Manoj never wanted any Court Cases and Dharnas against PDL, rather they were forced by me , Mr Rajesh Malhotra and selected few openly and even multiple times on Whatapp Group where Modi & Manoj had always opposed to this idea of going Legal and for Dharna - Now they are seeking credit again for the same .( Disclosure to all / Evidence is in the Trailing Mails given by me dt April 2014 if you Read )
Rather I must tell and remind to all the members who went for the dharna is that KK Modi was just part of it physically due to compulsions, but he was always running away to not to be spotted by his friend Pradeep Jain, Chairman PDL and from other staff of PDL so that he is not exposed/blamed बू PDL for organizing that Dharna due his some kind of connivance with PDL.
- We all know how Arrogant, Crude , Non- Transparent and Self Praising / obsessed Manoj Mittalis, I don't need to quote any incidents to this as there are many as one and all has experienced it at sometime or the other .
- Manoj Mittal from the very inception wanted to make LTRA a permanent revenue generating machine for himself. He had always proposed to recruit his Company, his CA , his Advocate , his CS , his Architects as he belonged to a family of Contractors as claimed for which he repeatedly said we should hire them on monthly basis be it around Rs. 1,00,000/- per month, to which he was vehemently opposed by us in the MC as it would have burdened the association and its members further.
- Manoj Mittal did not even leave small events to generate Petty Money for himself , he asked Rs 16,000/- for audio - visual presentation in our very first public meeting at Roshnara Club 2 years back for which usually Rs 3000-4000 is charged.
Now coming on to the allegations put on me regarding some petty commission from Mr Lahoty :
- They say I have even acknowledged this on Mail that I had demanded commission from Mr Lahoty,. No such mail acknowledging this fact was ever send by me & can they show any such Mail GENUINE MAIL ? ( if they manipulate/forge/fabricate any of my mails I will drag them in court under various Penal acts and provisions )
* looking into my financial capacity having 8,000 sq ft Approx.to myself in La Tropicana unlike KK Modi (who had to resign from President ship for selling his Flat , now is contesting after buying 10 shares of Rs 710/- only in Oct. 2015 in a company who owns a Flat in Tropicana ) and Manoj and other their team mates , i dont need to ask for petty amounts as commission from an Advocate with whom I have only Negotiated and fixed the Fee Amount of Rs 5,00,000/- for entire case for 141 members for which Mr Lahoty was asking Rs 8,00,000/-. ( it is worth mentioning here is that now Mr Lahoty is asking Rs. 5.5 Lacs + TDS for just 35 members to be included in existing court cases meaning there by for remaining 70 members to be added Rs 11 Lacs + TDS )
If I wanted any commission then rather getting the fee discounted and asked PETTY Commission afterwards, I would have increased his fee to Rs 8 Lacs or even more and would make merry with Good Amount rather than Small commission .....
* It an unsubstantiated allegation against me for which there is no proof and evidence and Mr Lahoty himself has never agreed too.
* This allegation is just to malign & demoralize me so that they become successful in their Mis-endeavors and win elections.
* This misconceived allegation even Mr Lahoty has rejected rather feel very painful that his name is dragged in this way by Manoj and KK Modi to gain political millage. This fact gets further proved as he seeks my Assistance in LTRAs matters in the court.
- Please also read the Trailing mails Dated 5th April 2014 to all the LTRA Members and 3rd Aprils 2014 to the MC members by me, which is self explanatory and to which neither Manoj nor Modi ever replied as they are admitted facts - Proving that i raised the voice and exposed them in April 14 itself in front of all the Members of association
- Trailing Mails send by Abhishek Mundra mail dated 02nd April 2014 which is reply to KK Modis mail dated 30th March 2014 , from which KK MODI STANDS exposed that he never wanted to file Legal Cases against PDL rather wanted to delay all the process and wanted INDIVIDUAL CONVERSATIONS AND NEGOTIATIONS with PDL much to the apprehensions to his personal gains.
On Giving Respect / Disrespecting KK Modi :
I must state that :
"RESPECT is one thing that you have EARN ... YOU CANNOT COMMAND ..."
I wish Mr Modi, you had earned the respect what you seek and not commanded from me and other MC Members whom you had inducted in MC , who were standing by you and supporting you but only till February 2015 ( ie. Mr Sunil Sethi , Aseem Asrani , Rishi Jain and even Mr Kanodia ) being your close associates then and you inducted them under the authority of a President to induct 5 executives but now they also have seen your TRUE FACE and have distanced from YOU and are STANDING AGAINST YOU and your way of functioning and against you TEAM.
Abhishek Mundra an initial & a very active executive by special invitation had also expressed the same opinion about the 2 ie. KK Mdi and Manoj Mittal and left the assostion and distanced from both of them.
You Mr Modi had Para-trooped in last elections from no-where & we made you the President of LTRA, but you are neither Worthy nor Apt for the Post ... I had looked upon you as an elderly, respected and matured person till first 2-3 months of our MC who can take everyone along and balance the situation.... But you failed Miserably , Rather you Back Stabbed and did Chugli for your benefit behind once back.
* Can you show any conversation, Mail or Text where i have called you MC / BC as claimed ???? - hence stop spreading lies ...
* Manoj & Mr Modi please stop giving certificates about my Class - Each one of us members who have ever interacted with you knows how petty you are and to which lowest level you both can stoop down too, especially when it is known to the entire world about you Manoj Mittal, you have not even left your immediate family where you live and your cousins by involving them in unnecessary legal battles just to disturb them with their shares and assets .... needs no further clarifications about your character Mr. Manoj Mittal.

KK Modi / Manoj and their team including Real Estate Brokers in UNITED claim that they have meet Sh. Arvind Kejriwal,CM Delhi who will help them against PDL with directing various departments to take Steps to STOP FAR .....
I put a question to them , can they tell which department is under Delhi Govt.s direct control ??????
Answer is NONE ...
Neither ANY COURT / MCD / DDA / DUAC / Delhi Police / Airport Authority / FIRE norEOW is under the control of CM but are under Central Govt.
only DMRC is under indirect control , which is also of no use at this STAGE ....
So, Modi & Manojs team is Misguiding again on this front too and playing with your sentiments and emotions at the time of Elections .... it is just their POLITICAL GIMICK....

I would like to bring to your notice what all has been conspiring in the TOP Office Bearers and their mishandling and misdeeds as below :
There are many things to bring to your notice but Specifying Only FEW :
1. Mr. Nilesh Sharma Advocate, was an Elected Office Bearer and a Treasurer & also part of the Legal Team. He was removed because they alleged that he is ineffective. 2. Mr. Ajay Srivastav Advocate, who has already successfully arm twisted PDL in the past & volunteered his time & services was purposely kept out of the said Legal Team alleging that he has his commercial interest and was not made a member of LTRA . 3. Mr. Rajesh Malhotra, his Wife is an `Addl. Session Judge`, he was the one to initiate legal action and lead us to Mr.Lahoty along with me, he was also later excluded from the Legal Team.
It is noteworthy, that all the above people who could have been an asset and spear headed this legal battle with PDL and even used their influences to fight and get benefits for all of us - were kept out ! For reasons best known to them !
4. Me, Mohit Aggarwal Lawyer, an Elected Vice President of LTRA , I am a part of this Legal Team. In the interest of the RWA, I as a Lawyer fixed up the first conference with Mr.Lahoty, not revealing that I am also a Flat Owner. This was purposely done so as to save `Conference Fee` for RWA of almost Rs 40 to 50,000/- which all Senior Advocates normally charge.
Later on ofcorse it was revealed to him that I am also a Flat owner. At some point of time when we paid Mr.Lahoty, in my absence, `it may have so occurred` that during discussions Mr.Lahoty may have mentioned that it is a common practice to pay 10% to the Lawyer who brings in the Case but in this Case Mohit is himself is a Flat Owner.
Thereafter, Mr.Modi & Mr.Mittal misconstrued it as per their suitability and used this as a weapon to tarnish my image by alleging that I had asked Mr.Lahoty for Commission ! This was spread to all Executives also. When they brought up this issue to me, I was extremely offended and hurt that how can they make such false allegations at me. I even persuaded them all to come with me to Mr. Lahoty and he himself will clarify and vouch for my not doing any such thing.
In their presence, I even called up Mr.Lahoty and told him that this is the allegation they are making on me and that I would like to bring these people to you for clearing the air. He agreed to do so BUT inspite of many requests to Mr.Mittal & Mr.Modi, they refused to go and stated that let us bury this matter here itself and not complicate it. Whereas, it is also important for you all to know that I was the one who called over Mr.Lahoty to Roshanara Club and he was graceful not to charge any money for that Conference. If I was tainted then why would Mr.Lahoty do so!
It simply appears that since I often have difference of opinions with Mr.Mittal and Mr.Modi on their slow down strategy instead of full force legal action, now they wanted to frame me with these false allegations so as to take me also out of the Legal Team. Next could be Abhishek Mundra on their target, to remove!
All the above, for intentions and reasons best known to them!
Further, read their below emails exchanged and you will have a very clear idea that they are purposely trying their best to avoid any legal action on PDL.
Further, alarming part is that Mr.Modi & Mr.Mittal have been holding closed door private meeting with PDL - without taking us Executives and without even the knowledge of us Executives! On every meeting they insist that PDL wants to meet only 2 people!
Even the Auth. Signatory on Cheques are only Mr.Mittal & Mr.Modi, and not even the "Treasurer" !
Now the time has come that I am extremely frustrated with their manipulations and tactics and I want all of you to know the reality.

It appears that they are in connivance and influenced by PDL and so they are purposely not wanting to take any legal action against PDL.

I appreciate your 'courage' in replying appropriately , with your wisdom and with the Good Consciousness to yourself and towards others who you represent , to the mail of a person who should have been in our side but does not seem so after reading this DISCRETE Mail just send to you and not other executives , specifically on 30th March on a day after all the Board members met on his call itself ie for the Executive board meeting on Saturday and decided we are going legal by 15th April n not negotiating beyond 12th April 2014 .
By reading this mail .... I'm v happy and content to see atleast you also have Nerves of Steal as ME (like the ONE MAN /person 'who is Said to be Derailing ..... N BLA BLA ' in the mail u r replying too ....) and that One Person is exposing and resenting openly against their Malpractice and Ill-will , of a person/s , who does not belong to the Masses who they represents n looks as if he/they have some other ulterior motive and intention and is not working in accordance of wishes and benefit of the masses but may be in connivance of Third Party.
I get more suspicion with the things as why just two ppl want to go & meet Bosses of PDL in person and not with all the Executives , and why we still don't have Third Signatures on the Bank Papers but only of two , also when nothing Concrete is given in writing to PDL in our official meeting with them on 25th march 2014 when it's was decided amongst executives to give a Specific Demand to PDL in writing after getting Vett either of the two controversial letters from Mr Lahoty on our Official Letter Head to PDL ... And many other things too ...besides NO TRANSPARENCY
I get more suspicion Abhishek when I see what we discuss in the Official Executive Board Meetings is never Brought on records and signed by all present and then it's Minutes are not circulated to all the executives to confirm what is required legally .
Also I'm happy that I'm that One Person who opposes them and is standing to my conscience , benefit and more particularly fighting for HAQ for myself and for other , and is Trying to get this DERAILED thing on its Right and Ought to be TRACK for Getting early Possession and Adequate Compensation for the Delay of our Dream FLats called Tropicana .

Dear Modi Ji I agree with the disturbing and stressful work environment in our RWA which makes it difficult for anyone to work with, also of the concept that we are working for a common cause and also socially but still because of few rifts we do feel discourage at times but fighter is one who keeps on fighting in spite of all the difficulties and then the story is written about him and his success so I would suggest you and Manoj both to not take such thing personally but let’s together find out the solution to get out of it and move on. It is very disturbing situation in our executive body where one person goes on de railing our main objective and we all try to hush up the ugly situation. By doing so we all are not just showing our helplessness and incapability in dealing with the difficult issues but also loosing on good constructive work of our members.In this kind of atmosphere I am not able to perform my duties well enough as president of rwa and seek your view on going forward. How ever the status in ref. to Tropicana we are in today, I request you to look into my following thoughts and give your view. To put pressure on PDL to start the construction in full swing and complete the project in a reasonable time and to get justified compensation for the inordinate delay. A. If we file our case immediately. 1.Filing case at this moment doesn't help us in any way in starting the construction immediately which is our prime objective. What is the guarantee that the construction will be started in next 3-4 months if we do not take this step? PDL is in bigger soup then us, our money is blocked which is there from last 10 yrs so it does not matter to me if it is blocked for another 3-4 yrs but if I do not take any step now then I will be fool who is falling in a pit with open eyes. 2. After filing the case sit and wait for any kind of relief from courts which in my view is not expected before one year. There will be a strategy to hold PDL by his balls and not horns any more, after case we will be going to various departments apart from EOW and FIR against him. A strategy will be formed for next one year for what all we have to do till the court is doing their proceedings like dharna’s, complaint in various wings, article in newspaper and a full video presentation of site on TV news channel. 3. All kind of dialogue with PDL will stop totally as already told by them. We shall not care for it at all, anyways we are just talking for last3months though we have got very crucial information in all this time but now the time has come that we do not need any more information but to declare war. 4. If any FDI is to come in near future it will stop for time being at least, as FDI will be more cautious to fund a project under a litigation with a strong lawyer Mr Lahoty and determined RWA like ours. I totally disagree that FDI has got to do anything with us, any FDI who is funding them at the moment must be aware of the RWA and the way we are moving, FDI”S are bankers and they move and take action only after evaluating all pros and cons/ risk factor and other probability that might come in this funding today or tomorrow because their money will be recovered after a stipulated time so I am sure they must have done all this by now so let’s not worry about that. Further it is PDL’S problem , not ours. It’s like PDL has taken and eaten away all our money and now we are at the mercy of the FDI to save our skin, this reminds me of the POOR Indians at the time of BRITISH RULE where they use to beg them for their own land/money/wealth. 5. Without any funding work at site can't start in immediate future. Yes agreed but what is the surety that after getting money he will start the work? Is he ready to give everything in writing/to make an agreement for all this with us? Let him think of how to arrange the fund and start work, it is not our job or rather we shall not put our brain in all this as it will jumble your motto and goal. 6. Future will be more bleak as PDL looks to be in no position to generate funds of its own as on today. As we are all aware that as on today most of the PDL projects are on stand still for want of funds irrespective of pressure builtup by respective rwas and also they have not paid salaries to their staff for months. I agree to this but this will not be the case because till today he/PDL has been very smart to not let any of the RWA to go to the court, take history and see that no RWA has gone against him till today and the one who were going ( Exotica), he created lot of confusion among them and then later gave the members a bone to chew to keep themselves quite. Let us not give him this chance, he will generate funds when time will come. Do you have any idea that his son is still spending more than 1crore/month in US/UK where he is studying, to start the project he only needs 50 crore which is very very small amount. Do not underestimate that when he will have a court case on him and with lawyer like LAHOTY standing against him, we will not be able to make him put 50 to 100 crores in project? I think we are underestimating our self and the RWA, Lets Change the thinking because half the battle is won or lost with inner feeling whether i can win o r not, If you think of all above then trust me you will surely lose the battle before fighting. B. We don't file our case immediately. 1.Understand the status of FDI by meeting the funders and other people concerned with this issue and 'IF' funding looks possible in immediate future and after complete satisfaction, wait for FDI to come. We can talk and meet them and also give them the assurance that if they make payment timely to PDL then we will not put any case, FDI and PDL both have to confirm in writing to us about all this and future progress. FDI have to do this because he is not doing any help to PDL or to us as he is coming as an business investor to make profit so he also equally needs the project as we do so first let’s not consider FDI as GOD and second as we are the majority owners so everything will be in consensus with us else we do not want FDI. 2. Meanwhile keep the dialogue on specially on compensation with PDL for few more days n if the dialogue fails, take a view considering the FDI status.
