I have not heard anything more from Mary. 

 

Mary,

 

People are asking if the walk is still on for the 4th of Feb.   Is this for certain?  Do you have a schedule?  We have lots of questions and still no budget from this year or last.  I would still like to know how the money was spent last year and what is planned for next. 

 

I recently asked my insurance company why my policy was twice as high in La Mirage than it was in La Jolla even though the condo in La Jolla is conservatively worth 7 times more.  I was told that the reason is that our La Mirage HOA does not maintain any exterior items.  I am OK with that since I have already fixed my roof and painted the trim and eves.  Now I hear rumors that this is planned with the HOA dollars.  It sounds a lot like a way for G-8 to get me to pay for their poor maintenance.  I thought the HOA would enforce the standard and see that the owners did the work.  I don’t believe having the HOA do exterior maintenance is in the CCRs.  Please point me to the correct section.

Hi John : A property walk has been scheduled for Feb 4th starting at 11am. I will be in attendance along with our Area Manager and site staff. 

 

I was onsite last week on Thursday and saw the issue regarding the trees. Clearly they were not handled properly. Landscapers were notified to never do that again. I'm inquiring on possibly having them replace the few effected trees and/or compensate with some seasonal color install. 

 

However, overall, the exterior grounds and lawns have cleaned up tremendously over the last 6 months. We had a property walk with G8 this afternoon and they too felt the same. Always room for upgrades, but marked improvement since early 2013 when we took over. 

 

Capital improvement items we are currently obtaining bids on.....

 

- Clubhouse Roof

- exterior signage upgrades

- asphalt repairs

- trash enclosure repairs

- tot lot equipment 

 

Just to name a few. Bids will be provided to the board for final approvals before work begins. 

 

Upcoming HOA meeting will be held on Feb  13th. Notices will be sent to all owners with time, location and agenda for those who wish to participate. Please feel free to send me any topics you may want to discuss (aside from those we've already covered). 

 

Year end financials will be distributed by month end, as noted in previous correspondence. 

 

Mr Ellis, I certainly do understand your concerns and continue to appreciate your attention to various matters within the community. But please acknowledge and understand that IRM took over management of both the rental and HOA units with best intentions to better the community. It has been challenging to juggle issues such as loss of revenue, past due a/p, crime, high vacancy, high turnover, etc. However I can say with confidence that we are turning this ship in the right direction. 

 

Moving forward, please refrain from threatening legal action , small claims court and attorneys. We're working towards the greater good for the community and it would be best to work together to succeed, rather than against us.

The end of the week arrived and we have not received a walk through schedule.  We need to be able to plan for this time and some folks need to travel to attend. 

 

I have also not received any of the requested documents or any response to my list of questions.  It has been past the 30 legal response time and I am wondering if I need to proceed to small claims court.  I really do not want to do this since it will end up costing the HOA several hundred dollars.  There are several California cases that clearly indicate the precedence.  I would be glad to send the references to you if you are unfamiliar with the case law.  However, I would have expected that you and our board would be aware of the law.  Also, be aware that California small claims court does not allow an attorney to represent you so you will be pretty much on your own in court.  All this seems silly since what I have requested should be freely available to every member of the HOA and should be part of the HOA records.  Our HOA generates close to $30,000 per month and will soon be generating more.  We have both a need and a right to know if this is being collected and how it is being spent as well as what is planned for the future.  I am sure that G-8 expects the same details.  I would hope that this information has not been unfairly distributed to the majority holder and not to those of us that are minority owners.

 

Lack of communication means we are left to make assumptions and it is not possible to run any business based on unconfirmed assumptions.

Mary/Jamie,

 

I drove through La Mirage Monday and saw the “Landscapers” topping several sycamore trees.  They have completely ruined them.  They don’t seem to know one tree from another and have topped species that should not be topped.  Here are some links to good trimming practices.  Please pass them on so they can learn before we end up with a bunch of dead trees from those few left living.  At this time of year it is too hard to tell dead wood from living and topping is not a good practice.

 

I still have not received a response to my questions or any history of expenditures for our HOA.  The law is very clear about the time it should take to receive a response.  I do not want to cause undue expense to the HOA, but there are many of us outside the G-8 controlled board that need the answers to those questions.

Mary,

 

My bad.  I just got back from travel and I checked my email before I checked my snail mail.  I did get the packet of information. 

 

I am looking forward to the walk through and would like to discuss the non-paying HOA members.  There is a significant amount of past due funding.

 

I do not think Pat Grey received the walk through information and there may be others, so it would be good to get an email notice out as well.
