Hi,

 

I just got the flyer for the HOA meeting.  I see it was postmarked on the 4th from Santa Clarita, CA.  The post office does not deliver my mail until about 5:00 PM and it arrived today on the 6th.  You need to mail things out earlier.

 

Still lots of problems in La Mirage.

 

As far as immediate concerns:

The leak in front of 240 Oasis is stopped, but the hole has been covered by a board for the past few weeks.

The garbage is still overflowing the dumpsters before each pickup.

The slow leak in front of 428 Palm is still seeping out.

 

Long term concerns:

I am interested in how we are going to start enforcing the HOA rules and how we will go about improving the appearance of the many abandoned units.

I would like to see if there has been an independent audit of the payment and expense records.  I have trouble seeing where the $37500 in monthly dues are making any impact.  It is certainly not in garbage pickup or water bills and there isn’t much else the HOA takes responsibility for.

 

Please send any minutes from the meeting if anyone else got the notice in time and attended.  This is not a good start.

Thanks for trying to set up a “meet and great.”  I am sorry I did not make it and do appreciate your effort.

 

I was hoping it was a board meeting too, but glad it was not since I missed it.  When can we expect a board meeting?  We had one last year and everyone showed up except the board.  Luckily, our HOA manager was able to call the board and remind them that they had a meeting so we did not have to wait more than a ½ hour for them.

 

Here is some owner information you may not have.  I will try to gather a few others that I am aware of.  I know several others.  I also know a few folks that are still “squatting” in units since the mass foreclosure a few years back.

Sam asked me to ask you what is happening with the water and landscaping.  He has not had anything in front of his home watered in quite a while and the weeds in many areas are knee high.

 

Also, the folks across the street from 304 Palm were asking me about the garbage situation.  The dumpsters are always full to overflowing.

 

I guess that bring me back to my questions in my earlier email.  Here they are again so you don’t have to dig for them.  I would appreciate your answering them directly and completely.  Sorry to sound negative, but I have to say we have not had a good experience with our board and both of the two previous management companies were not able to bring about any change.  Most of the problems that you should have encountered by now have been present for one or two years.  One of the biggest problem we face with HOA is that as minority owners we have absolutely no say in how the HOA is managed.  G-8 employees hold all 5 seats on the board and have never responded to any enquires.  In fact, the only time I have ever heard from them is when they called and tried to sell me their 200 units. 

 

As far as immediate concerns:

1.       The leak in front of 240 Oasis is stopped, but the hole has been covered by a board for the past few weeks.

2.       The sprinkler valve box in front of 232 Oasis has not functioned in over 10 months.  In the past, I would manually operate it when I was in the area.  However, now the wiring has been disconnected and the water is off.  A year ago I was told that the controller was “on order”, but I don’t believe it was ever ordered.

3.       The garbage is still overflowing the dumpsters before each pickup and they are still in the street.  I makes it look like a slum.

4.       The slow sprinkler leak in front of 428 Palm is still seeping out onto the road.

 

Long term concerns:

1.       I am interested in how we are going to start enforcing the HOA rules.  As the HOA manager it is your responsibility to enforce the CCRs. 

2.       What is planned for improving the appearance of the many abandoned units?  Since the HOA does not maintain the exterior of the units, it may be necessary to force the owners to do this maintenance.  I know that puts you in the difficult position of enforcing HOA rules on G-8 while acting as their rental management company.    

3.       I would like to know if there has ever been an independent audit of the payment and expense records.  I have trouble seeing where the $37,500 in monthly dues are making any impact.  It is certainly not in garbage pickup or water bills and there isn’t much else the HOA takes responsibility for. It is difficult to see how the funds are managed when the HOA management company and G-8’s rental manager are the same company.  The budget statements we occasionally get lack details and transparency.

4.       At one time we were told that units that are behind in paying HOA dues over a not clearly defined “long term” would be foreclosed on by the HOA and that the HOA would then take over the units.  I do not believe this ever came about.  I would like to know how many units are in arrears and what is owed on each.  I would also like to know what if any action has been taken.

 

Please realize that I understand you are at the mercy of the board and that my requests are not in any way an indication of how I feel about you or your management capability.  I am at the end of my patience with our board and intend to investigate every aspect of HOA management required under California law.  I and other private owners have invested both time and money in this community and wish to see it succeed.  Unfortunately, what we have experienced is a continued downward spiral in the maintenance of a large number of units that is painfully obvious to anyone visiting the community.  It is also obvious in the reduced rents and large number of unoccupied units owned by G-8.      

 

As you are probably aware, La Mirage has a bad reputation within the community of Ridgecrest.  In order to overcome this and succeed the HOA will have to work with the owners and tenants. If you get out in the community and meet the tenants you will find that the large majority are great people and they have a real concern for the area.  They want it to be the functional well managed community that it has the potential to become.  However, this will only be possible through proactive management and long term planning by the board.  I hope you succeed in bringing in fresh ideas and that you are able to convince the board of the need to do their job, too.

Please note that this was intended as a meet-and-greet and not a board meeting. I bought food and water from my own budget and mailed out invites after announcing the date over this email chain.

I do understand your frustration and will send the info that was discussed with the owners that attended as soon as possible. 

 

I plan on doing another meet-and-greet and will send out notifications earlier.

 

If every owner can forward their correct mailing address and email address to me that would be a great start. I have many of the owners info, but not all.
