I respectfully suggest that you alter your Terms Of Service, to give
people more confidence that their links will not lost due to some
error (i.e. competitive malice or misunderstanding). I am using
kwout.com to make some very critical hyper-links to data buried deep
in technical pages. Should someone disagree with the conclusions or
advocacy of my work, they could in theory try to trick or pressure
kwout to destroy my work.
I think that in most cases, you do not need to delete the hyper-link,
nor the original coordinates of the capture, as these are content that
is owned by the person using your service, not by the target web
page. I think in most cases, deleting the captured image is
sufficient.
Obviously in the case of high volume of spam, you may want to delete
all the information. But in the case of "moral disputes", "copyright
claims" and other grey areas, then retaining the hyper-link and
coordinates of the captured image, would not increase your liability,
and would make your service more palatable for serious work. No one
wants to do serious work and have it all wasted by some outside
forces.
The relevant portion of the TOS is:
================
Deletion of Information
We may delete any kinds of information (text, image, hyperlink, etc.)
quoted from a web site without notice, if we believe that you have
violated or acted inconsistently with the TOS. We will not be liable
to you for the deletion of any kinds of information.
================
I think you could add the following sentence:
We will attempt to retain at least the hyper-link, and possibly the
coordinates of the original capture, if at our sole determination, we
decide that doing so would not increase our liability with regards to
the alleged violation for which we are taking the deletion action.
