Election Declared Null & Voild
Kenya’s
Supreme Court has declared the August 8, 2017 Presidential Elections null and
void and nullified Uhuru’s re-election. The Court has ordered the IEBC to
conduct fresh Presidential Elections in Kenya within 60 days. Chief Justice
David Maraga said the IEBC did not conduct the Elections in accordance with the
Constitution and the Laws. He said IEBC committed various irregularities and
illegalities which affected integrity of the election. Chief justice David
Maraga said, "Election is not an event but a process. After considering
the totality of the entire evidence, we are satisfied that the elections were
not conducted in accordance to the dictates of the Constitution and the
applicable principles." CJ added, "President Uhuru Kenyatta was
not validly elected on August 8."
Justice Njoki Ndungu and Justice Jackton Ojwang dissented and read out their decisions to throw out the petition filed by Raila Odinga. The majoriy of four judges ruled in favor of Raila’s Petition.
