제주 감귤 기사는 좀 오류인듯

UPOV는 1991년 Act가 이미 발효된지 꽤 됐습니다.
한 가지 단서는
종자산업법 제11조를 통해 품종보호를 받을 수 있는 작물의 종류를 제한할 수 있다는 조항입니다.
제11조(품종보호를 받을 수 있는 대상작물) 이 법에 따라 품종보호를 받을 수 있는 작물의 속(屬) 또는 종(種)은 농림수산식품
부령으로 정한다.
이에 따라 종자산업법 시행규칙 제20조는 품종보호대상작물을 정하고 있는데요,
제20조(품종보호대상작물) 법 제11조에 따라 품종보호를 받을 수 있는 작물의 속 또는 종은 다음 각 호와 같다. <개정
2001.8.3, 2008.2.4, 2008.3.3>
1. 벼(Oryza sativa L.)
2. 보리(Hordeum vulgare L.)
3. 콩(Glycine max (L.) Merrill)
4. 옥수수(Zea mays L.)
5. 감자(Solanum tuberosum L.)
6. 밀(Triticum aestivum L.)
7. 무(Raphanus sativus L.)
8. 배추(Brassica campestris L. spp. pekinensis(Lour.)Rupr.)
9. 양배추(Brassica oleracea L. var. capitata)
10. 고추(Capsicum annuum L.)
11. 토마토(Lycopersicon esculentum Mill.)
12. 오이(Cucumis sativus L.)
13. 참외(Cucumis melo L. var. makuwa Makino)
14. 수박(Citrullus vulgaris Schrad.)
15. 호박(Cucurbita spp.)
16. 파(Allium fistulosum L.)
17. 양파(Allium cepa L.)
18. 당근(Daucus carota L.)
19. 상추(Lactuca sativa L.)

이 리스트에는 감귤이 없습니다.
게다가 28호에는 장관 고시로 작물의 종류를 추가로 정할 수 있게 되어 있습니다.
이에 더하여, 농림수산식품부는 고시를 통해 종자산업법 대상 작물의 범위를 폭넓게 정하고 있습니다.
관련된 고시 중 가장 최근의 것은 고시 제2009-328호인데요.
품종보호대상작물
종자산업법 제11조 및 동법시행규칙 제20조제28호의 규정에 의한 품종보호대상작물은 딸기, 나무딸기, 감귤, 블루베리, 양앵
두 및 해조류를 제외한 모든 작물로 한다.
"감귤"이 들어있죠.
이러한 내용은 UPOV의 Gazette에 공개됩니다. UPOV Gazette and NewsLetter No. 103
July 2010에는 한국이 위의 작물들을 보호 대상에서 제외하고 있음을 발표하고 있습니다.
제 생각에는 감귤이 이 고시의 대상에서 제외되는 때가 2012년인 것 같습니다.
그리고 해조류도 역시 고시 대상에 들어있지만 조만간(2012년)에 고시에서 제외되는 것으로 보입니다.

이러한 특정 작물에 대한 보호 예외는 UPOV 조약 제3조(2)에 따라 10년의 유예기간 동안 허용이 됩니다.
Article 3
Genera and Species to be Protected
(1) [States already members of the Union] Each Contracting Party which
is bound by the Act of 1961/1972 or the Act of 1978 shall apply the
provisions of this Convention,
(i) at the date on which it becomes bound by this Convention, to
all plant genera and species to which it applies, on the said date,
the provisions of the Act of 1961/1972 or the Act of 1978 and,
(ii) at the latest by the expiration of a period of five years after
the said date, to all plant genera and species.
(2) [New members of the Union] Each Contracting Party which is not
bound by the Act of 1961/1972 or the Act of 1978 shall apply the
provisions of this Convention,
(i) at the date on which it becomes bound by this Convention, to at
least 15 plant genera or species and,
(ii) at the latest by the expiration of a period of 10 years from
the said date, to all plant genera and species.
한국이 UPOV에 가입한 일자는 2002년 1월 7일이고, 유예기간 10년을 적용받으면 2012년 1월 7일부터 UPOV의
full application이 적용되는군요. 따라서 2012년 1월 7일 이후부터는 작물에 대한 예외를 적용할 수 없게 되는
것이고, 따라서 감귤과 해조류에 대해서도 다른 작물과 동일한 보호를 해줘야 되니까 감귤 재배 농가들이 종자에 대한 로열티를 지급
해야 된다는 것이죠.
물론 소급효는 없고...
