Hi asis,

I have paid all the due amount and worried about the completion, I have even sent an email asking the stage of cunstruction and their schedule for completion, but I haven't received any response from KP, in my email I have also mentioned stated that as per my understanding the project will not complete by dec 2015, if you look at sobha City they anounced the project much later then this project and they have more then 1500flats, and they are very much following the deadlines, their project is completed and they are handing over by sept, I got to know this because when I booked the flat in Raaga, one of my relative booked in sobha City at the same time, and he is getting the possession max by sept.

Let's meet for the discussion with KP team and see what they have to say about this.

Also there is one clause in the agreement, that post september, they will pay some compensation if construction is not yet completed.

Hi all..
No idea about the meeting that happened.. But today we visited the site and met the marketing manager.. He said the project will be complete by Dec 2015.
SBI has started giving loans for the project which is a good thing.
The rates have gone up.. Phase 1 it is now 4280/sft
He also said whatever penalty KPDL had promised in case of delay will be fulfilled from September till the possession.

Internal wiring is going on... Didn't see much improvement.. Just the building is up.. Not sure what's happening inside because we didn't visibly see any changes.

Request everyone to keep updating on the group for the benefit of all...

I was quite upset about KP's act about their delay in handing over and also the most worried Legal battle.
I got to speak to John GM-Sales as usual, he spoke about the delay due to untimely payment.hence couldn't show the progress.
However, he confirmed about the SUIT is resolved in the lower court and Ordinance will be passed in fortnight.
I also checked with my known sources advocate and he too confirmed the same.
Its a great news!

Thanks Himanshu, Asis, Sreekanth, Jay for sharing the case details and news of its closure.

However not very clear what this means really. Would appreciate if someone could help me with the following questions:

I. Does this mean the case has been resolved to the satisfaction of all parties concerned or is there further scope of this being dragged to some higher court for appeals etc?

II. Does the closure of this in the court means, that the property is now free of litigation / encumbrances and hence (hopefully) we may see better price appreciation going forward ?

III. Last I visited the site (in 2013) there was a quarry next to the site with blasts going on at regular fequency. KPDL had assured at that time that there was an court stay on further blasts. Not sure if the same is indeed in place. Perhaps those who visited the site recently may throw some light.

IV. While KPDL seems to be using the slow payment from buyers as an excuse for the slow work progress, it seems only an excuse. As most of the people who have shared their views here seem to have made a major chunk of the payment. I have myself paid all the demand notes sent till date (i.e around 80-85% of total payments). Hence is there a way we take this up strongly with KPDL? Individual followups may not help much as they would hide behind standard and oft repeated excuses. At least they should agree to pay delay related compensation for those who have made their payments on time.

I guess quarry blast is stopped and not much activity at least for last 6 months.
High court appeal is much possible by the Plaintiff (land owner) but out of 100 or 500 cases, 3 or 4 such orders which favours plaintiff.
but I don't think he may move to high court, since the high court takes the lower court reference and passes the ordinance.
Now RAAGA has priced to Rs.4500/- and they are not bringing down their price. This means the builder is confident about the product having clear titles and commanding prices apt to the market.
I think possession will be a delay atleast till Aug'16
