PBO Act 2013 was an initiative of the civil society organizations and  before the commencement of the law, the government published on the Kenya Gazette on 30th of October 2013 the Miscellaneous Amendment Bill 2013 with the following sections inserted:
 
-Article 27A. (1) Any funding of a public benefits organization shall be made through the federation and not by any individual member organization
-A public organization shall not receive more than 15% of its total funding from external donors
-Notwithstanding subsection (2) the Cabinet Secretary responsible for finance may approve receipt of an amount of more than 15% where there are legitimate and compelling reasons for increasing the amount.
 
To counter these efforts the CSO Reference Group has carried out a number of activities- the legal amendments, impact statements, press statements, social media, face to face lobbying and outdoor actions are testimony of how we can work effectively together. The next few days are crucial. Between now and Wednesday this week we need to persuade Parliament to defer this contentious issues in the Miscellaneous Amendments Act. If we don’t put in our efforts these amendments could be law by December 5. We need to increase our actions.
 
We propose that you consider the following actions;
 
1.   Write or individually approach your members of the National Assembly, Senate and Governors to reject the PBO Act amendments on the Miscellaneous Amendment Bill 2013
2.   Please request all your partners, members of sectoral networks, members etc to do the same.
 
Please do not delay as there may not be another time to take this action.
 
Attached please find an information pack with PBO regulations workshop report, an analysis of the proposed amendments, the impact of the amendments on Kenyan economy, a letter in form of a flier addressed to Hon. Members you can use as reference when approaching this group
