Thanks for forwarding the Owner Balances List from July 2010 along with the Approved Minutes of the Special BOD Meeting.
Reviewing the list my question becomes, how are you and the BOD going to determine who is going to pay for the new Special Assessment to make up for the delinquent accounts?
Are you only going to require payments from unit owners who are not on this list?

The only ones who should pay are those that are not paying. Foreclose their apt and sell them. End of discussion otherwise more people will be in trouble and it will get worse. Forget about what we need to fix first take care of those deliquent accounts and let's not make more delinquents.

Nope Mr. Kaplan, the association cannot issue impediment to parking.

So pool and gym, more like it.

Once again, these are inflated amounts, I know because I am on that list.  That number includes massive late fees over disputed amounts and internet, which I have a letter from the office from ages ago that they improperly charged for and would return that amount.  Our actual bad debt, my guess, is a hell of a lot less.  My number seems to go up about 1000K every month, despite the fact that I make every monthly payment, signed return receipt requested.  

The King Cole may be getting to the point of breaking - repeated Special assessments will just result in a bankrupt building.  Its high time we get some professionals in here to look at our situation, salaries that are paid, possible ways to save and shore up our budget.  To date, I have not seen a BOD do this.  This should have been their first step - it seems all too easy for them to keep rolling out Special Assessments and running up legal fees.

Which will only make matters worse and force the Board  to deny your use of common areas like the pool and gym and then  to start foreclosure on you.

Well I don't agree with what's going on. I feel the board has been making way too much money off of us. Making us pay more assesment isn't the answer that is something just putting more people in the whole. I think we should declare bankruptcy and not have to pay people that we owe money too and start all over again. Making assesments isn't getting is anywhere and will only out more people in trouble this is ridiculous.

We’re all furious at the situation, I’m sure.

 

But just fyi: The board is 100% volunteer. They get paid -0-.   They are only people who are willing to donate their time and efforts to help the King Cole.  Unfortunately, they have their hands tied in many arenas and on many issues….and there is very little they can do to solve certain problems. 

 

If you want to complain about this gravely serious situation (the same situation most condos are in right now)…then you should complain to the state government.

Thanks for your reply and thoughts, Marinell.  It sounds as though you have a pretty thorough understanding of the workings for all of this.   So, to help me better understand how other units are getting away w/o paying and why the association hasn’t been able to act against this, can you explain for me the details?  It sure is puzzling.

Agree to the first part. Partially agree to the second.
Let's work on obtaining more detailed and honest information about the accounting part and how the administration intends to collect the assessed amount from all unit owners, even those who are delinquent already (if not then what??), and explain to us what the money will be used for exactly, and maybe saved for (future repairs and projects), and how they plan to operate to not leading us back into the same financial mess a couple of years from now?  There are still some major repair projects that we have to address in the nearest future.
 
I know the law is a bit more on our side as far as taking stricter measures against delinquent accounts since July 2010, but it is not retrospective.  We really have to make up for the last years and work on a better tomorrow.
 
Once properly explained, I hope that everyone will agree that this assessment is unavoidable and urgent at this time and make arrangements to pay for it.

You guys need to stop and collaborate.  Do you really think pointing fingers at your neighbors and intra-fighting will get us anywhere but distracted from what the BoD is doing?  Seriously get a grip.  Mr. Whatley, I am not delinquent - there is an amount in dispute from over 4 years ago.  Rather than throw stones at me,  stop and consider the factual items I am telling you.  I have been more than upfront with all of you, why don't we band together.  I've already put my money where my mouth is.  I have a condo attorney handling my matter - which, believe it or not, the circumstances and outcome thereof will affect each and every one of you - for the better.

instead of becoming indignant with me, why don't you look to your BoD for answers?  David Cohen, upon his first election, promised me to get my matter straight.  More than two years went by with not even a peep, despite my many pleas to get it resolved.  Start asking the BoD questions about the matter.  I also want to point out, and those of you out there know who you are, that a good amount of all of you have called me wanting legal advice.  How bad can I be?

Again, let's get it together and pay attention to the real culprits - the BoD.

I have suggested that the BoD interview many large management companies to get in here and streamline our spending and contract management.  A large management company could leverage their volume of business to negotiate better contracts, better discounts on utilities and services etc . . . . I think a lot of our rampant spending and loss has been spent on a learning curve for each new BoD member that comes on board.  

Before we were assessed that amount, that is what we should have done.  There still is time for someone on the new BoD to pipe up, put the assessment on hold and at the very least, interview a handful of the large management companies at a public BoD meeting, so that the membership can hear.  Just see if anyone of them can give us a better solution than Special Assess our membership straight to bankruptcy.

I know, but I am really surprised about your outstanding number!!  Why?  Because I had asked for a Owners Balance Sheet of June, or May, and you had paid up except an amount of $900 (and change?) which in reality Darlene had explained that it had been paid as well, but hasn't been corrected by our accounting firm as of then.  Something is screwed up.
In any event, we do need this band aid badly, but we also have to make some drastic changes.  Agree.
