I quote the following from the article;

1. The new measures and strategies to empower the bumiputera economy are
a violation of the Federal Constitution which promises equality, said
Universiti Malaya associate professor Dr Azmi Sharom.

2. He said the Bumiputera Economic Empowerment Agenda announced by Prime
Minister Datuk Seri Najib Razak on Saturday is not supported by law.

3. "These provisions are not mentioned in the constitution but no one is
coming out to say this," said Azmi...

4. Azmi said if these new measures were challenged in court, the
constitutionality and legality of Najib's announcement would be in grave
doubt.

COMMENTS :

* Mmmmm=C2=85this is news to me!

* (Itu semua bukan layman yang cakap, tapi a law professor who
is supposed to be well versed in the law, so we should scrutinize
carefully what he says).

* His key words are;

1) Bumi agenda unconstitutional

2) Violation of the constitution which promises equality

3) Not supported by law

4) Provisions not mentioned in the constitution.

5) Constitutionality and legality (of bumi agenda) in grave doubt.

OK, 2 counter-arguments I give;

* Since Independence, all the Malay and Bumiputra plannings and =20
economic policies by the Government had been enacted based on the =20
calculations founded on the composition of the plural communities. In
principle, this had been adopted as a social contract since a long time
ago by the people of Malaysia, as agreed to by the founding fathers of
our nation, protected and articulated in the Federal Constitution
through Article 153, Article 160 (2), Article 161A (6)(a). Also
Article 161A (6)(b).

* Appreciating the interest and struggles of Bumiputra, I wish
to quote seven wills by the Nine Malay Rulers when consenting to
the independence agreement to set up a federation. Truly: "We
declare and we keep for you and we allow you to declare and keep
for your children and grandchildren, other than the mountains,
lakes and forest reserves, Malay Reserve land up to a ratio of 50%,
the rest you, together with the other communities, may grab". This
will is very clear. It has stated the equity and the ownership of =20
the Malays and later expanded to Bumiputra, through the unification of
Sabah and Sarawak when Malaysia was set up 50 years ago.

So, constitutionality and legality of the Bumi agenda still in grave
doubt?

2) Another counter-argument I give;

* Kalaulah the bumi agenda is unconstitutional and a violation
of the constitution which promises equality, then the following pun

* Maybe the policies that we have for women, for OKU, low income
families, semua violation of the constitution lah since our
constitution promises equality, kan?

* (Hehe=C2=85.now, hope you can see the stupidity of that
argument!).

* What's my point? The thing is that we can dissect our =20
population according to race, gender, income level, age group, location
and bla, bla, bla. Govt policies can be targeted to each specific
group as they deem fit!

CONCLUSION.

* Do you remember the term "professor kangkong?"

* Well, many years ago, I recall that term being used widely to
describe some of our professors in public universities. They got =20
there by virtue of the bumi quota. The accusation being levelled is that
their qualifications or intellect being not up to par with their jobs,
so most of the time they would utter rubbish when they speak.
That's why the term professor kangkong! And sometimes these
professor kangkongs would also lupa diri. They got there through
the bumi quota (but think they're super smart and deserving) but
now they want to destroy the same "route" that future Bumis
can take.

* Now, I wouldn't want to accuse Dr. Azmi of being a =20
professor kangkong. But to do more justice to his statements, I think it
would be best if we have the opportunity to find out more the basis of
his arguments on why the constitutionality and legality of PM
Najib's Bumi agenda are in grave doubt. A brief news report
like the one above unfortunately would not cover the breath and
depth of his arguments. Maybe he has a good case. I don't know.

* Secondly, very rare that I hear a Chinese questioning the
rights of Chinese (say vernacular schools). Maybe, they don't want
to be label as traitors to their own race, eh? For Malays, maybe
such attitude is normal. So don't be surprised if Malays (like
Dr. Azmi) are going to be pit against Malays in issues such as this
one. This is the norm that I see. Maybe (I say maybe), the Malays
are better of being colonized or having other races as their
"master". Then, they would fight less amongst =20
themselves=C2=85=C2=85=C2=85hehehe.
