There is no issue, Brian. This drug has been on the market for years and has been proven safe. The lawsuit brought here wasn't because of what the medication does; but because some wanted to challenge the FDA's safety/efficacy profile. In that regard the drug passes muster.
Now I'll fill in the bullshit for you; the drug is not safe for fetuses. But as of now fetuses don't have Constitutional protections; and that's how it should be.
This case was brought by people with no dog in the hunt. And whereas the SC got it right, they left the door open for other challenges on other grounds. This should be left to the FDA, not Congress or the States. It's a drug that does what it says it will, and is safe.
But fret not; when more restrictive abortion laws are passed by states and reach the SC, they may well change their tune based that premise. They just couldn't do it on the facts brought by these plaintiffs.
